AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR
PUBLIC HEARINGS BEFORE THE PLANNING AND ZONING COMMISSION
OF THE CITY OF PARIS AND THE CITY COUNCIL OF THE CITY OF
PARIS ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY
THE CITY OF PARIS, PARIS, TEXAS, AND APPROPRIATE ZONING UPON
ANNEXATION, AND AUTHORIZING AND DIRECTING THE MAYOR TO
PUBLISH NOTICE OF SUCH PUBLIC HEARINGS.
BE IT ORDA INED BY THE CITY COUNCIL OF THE CITY OF
PA R IS:
Section l. That public hearings be held by and before the
Planning and Zoning Commission of the City of Paris, Paris, Texas, on
the 7th day of February, 1977, at 7:00 o'clock P. M. , in the Council
Room, City Hall, Paris, Texas, and by and before the City Council of
the City of Paris, Paris, Texas, on the 14th day of February, 1977, at
7:00 o'clock P. M. , in the Council Room, City Hall, Paris, Texas, giving
a11 interested persons the right to appear and be heard on the proposed
annexation and appropriate zoning upon annexation of the following de-
scribed property:
TRACT 1: BEGINNING at the Northeast corner of
a 4. 72 acre tract of land out of the Isaac Cruse Survey,
conveyed John R. Webster, Jr. , by deed dated January 10,
1976, recorded in Volume 575, Page 433, Deed Records,
Lamar County, Texas, said corner being in the South
Right of Way Line of U. S. Highway No. 82 and in the
present City Limit Line of the City of Paris;
THENCE S 1 degree 00 minutes W with the present
City Limit Line and the East Boundary Line of said
Webster tract, a distance of 504. 0 feet to a point;
THENCE N 88 degrees 55 minutes W, parallel with
and 504 feet South of the South Right of Way Line of
U. S. Highway No. 82, a distance of 632. 0 feet to a point,
at 540 feet crossing the most Easterly West Boundary Line
of a 54. 80 acre tract of land conveyed Lisle Mullins and
wife, Helen Mullins, by deed dated January 11, 1966, re-
corded in Volume 438, Page 292, Deed Records, Lamar
County, Texas;
THENCE N 1 degree 00 minutes E, 92 feet West
of and parallel with said West Boundary Line of the
Mullins tract, a distance of 504. 0 feet to a point in the
South Right of Way Line of U. S. Highway No. 82;
THENCE S 88 degrees 55 minutes E, along said
South Right of Way Line of U. S. Highway No. 82, a
distance of 632. 0 feet to the place of beginning and con-
taining 7.31 acres of land, more or less.
TRACT 2: BEGINNING at a point in the East
Boundary Line of Kaywood Addition, said point being
300 feet South of the South Right of Way Line of
U. S. Highway 82 and in the present City Limit Line;
THENCE S 0° 45' W with said East Boundary Line
of Kaywood Addition and its Southerly projection, a
distance of 2, 813 feet to a point in the North Right of
Way Line of Old Bonham Road;
THENCE S 89 ° 30' E with the North Right of Way
Line of Old Bonhan Road 1277. 0 feet to a point in the
East Right of Way Line of 41st S. W. , said point being
in the present City Limit Line;
THENCE N 10 00' E with the East Right of Way
Line of 41st S. W. and the present City Limit Line, a
distance of 2803 feet to a point;
THENCE N 89° 25' W across 41st S. W. and with
the present City Limit Line, a distance of 1277.0 feet
to the place of beginning and containing 82. 3 acres of
land, more or less.
Section 2. That the Mayor of the City of Paris, Paris, Texas,
is hereby authorized and directed to cause notice of such public hear-
ings to be published once in the newspaper having general circulation
in the City and in the above described territory not more than twenty
(20) days nor less than ten (10) days prior to the date of such public
hearings, all in accordance with the Municipal Annexa tio n Act
(Chapter 160, Acts of the 58th Legislature, Regular Session, 1963;
compiled as Article 970a, Vernon's Texas Civil Statutes).
Section 3. It is hereby declared to be the intention of the City
Council of the City of Paris that the sections, paragraphs, sentences,
clauses and phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall be de -
clared unconstitutional or invalid by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality or inva-
lidity shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in this or-
dinance of any unconstitutional or invalid phrases, clauses, sentences,
paragraphs or sections. It is further hereby declared to be the in-
tention of the City Council of the City of Paris to exclude any area or
areas described in the description of the property to be annexed, which
are not within said City's jurisdiction to annex and that such area or
areas should be carved out of the description of the property herein
described by the valid judgment or decree of any court of competent
jurisdiction, in order that such area or areas would not cause this
annexation ordinance to be found to be invalid, voidable or void.
Section 4. This ordinance shall take effect immediately upon
passage.
