A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AWARDING THE BID FOR THE CONSTRUCTION OF SINGLE-FAMILY
HOMES UNDER A HOME PROGRAM GRANT RECEIVED FROM THE TEXAS
DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS (TDHCA), IN
THE CITY OF PARIS, TEXAS TO WHITAKER HOMES, THE LOWEST
RESPONSIBLE BIDDER; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBjECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, advertise for bids for
furnishing plant, labor, materials, and equipment, and for performing all work required for
the construction of up to eleven (11) new homes under a Nome Program Grant, Contract
No. 1001273 received from the TDHCA in the City of Paris, Texas which bids were received
until 10:00 o'clock a.m., Wednesday, the 4th day of April, 2012; and,
WHEREAS, the lowest responsible bid providing the best value to the City was
received from Whitaker Homes, 2550 Lamar Ave., Paris, Texas, and the bid should be
awarded to Whitaker Homes in accordance with the unit prices bid and the other terms
and conditions set out in the bid documents attached hereto as Exhibit "A"; and,
WHEREAS, the form of the bid for such home construction project, included in
Exhibit "A" attached hereto, should in all things be approved, and the City Manager should
be authorized to execute the necessary documents for the home construction project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby
in all things approved.
Section 2. That the bid of Whitaker Homes, 2550 Lamar Ave., Paris, Texas, for the
construction of up to eleven (11) new homes under a Home Program Grant received from
TDHCA Contract No. 1001273 in the City of Paris, Texas is hereby accepted as the lowest
responsible bid which provides the best value to the City and the contract for this project is
hereby let conditioned upon said contractor meeting all of the terms and specifications
included in the bid documents attached hereto as Exhibit "A".
Section 3. That the City Manager be, and he is hereby, authorized and directed to
execute, on behalf of the City of Paris, the necessary documents with Whitaker Homes as
described in Exhibit "A" attached hereto.
Section 4. That this resolution shall be effective from and after the date of
passage.

project, and cornmunity organizations and public or private institutions operating

Redevelopment (SER), Opportunities Industrialization Center (OIC), Urban League,
Concentrated Employment Program, Hometown Plan, or the U.S. Employment
Service.
C. To maintain a list of all lower income residents who have applied wither on their own
or on referral from any source, aad to employ such person, if otherwise eligible and if
a vacancy exists.
D. To insert this plan in all bid documents and to require all bidders on subcontract to
submit an affirmative action plan including utilization goals and the specific steps
planned to accoraplish these goals.
E. To insure that subcontracts (greater than $10,000) which aze a typically let on a
negotiated rather than a bid basis in areas other than the project area are also let on a
negodated basis, whenever feasible, in a covered project area.
F. To formally contact unions, subcontractors, and trade associations to secure their
cooperation in this effort.
G. To insure that all appropriate project area business concerns are notified of pending
subcontractual opportunities.
H. To maintain records, including copies of correspondence, memoranda, et. which
document that all of the above affirmative action steps have been taken.

The City of Paris is soliciting proposals for the construction of single-family homes within the City
of Paris. One (1) to eleven (11) homes may be constructed under a HOME Program grant received
from the Texas Department of Housing and Community Affairs (TDHCA). These homes will average
between 800 and 1180 square feet.
Contract documents, including house plans are on file for review at the following places: City of
Paris, City Hall, 135 SE 1St St., Paris, TX 75460 and Resource Management and Consulting Co. 3727
Lamar, Paris, TX 75461.
Copies of the contract documents may be obtained from Resource Management & Consulting Co.
(Consultant) upon the payment of $25.00 (payable to Resource Management & Consulting Co.) or a
disk containing the bid documents can be obtained at no charge.
All proposals must be sealed and submitted by the bidder to the City of Paris on or before 10:00
a.m. on the 4th day of Apri12012. Bids will be publicly opened and read aloud on Apri14, 2012 at
10:15 a.m. Proposals may be delivered to the Paris City Hall, 135 SE 15t St., Paris, TX 75460. The
Contractor must ensure employees/applicants for employment are not discriminated against
because of race, color, religion, sex or national origin. Section 3 of the HUD Act of 1968 (12 U.S.C.
1701u) as amended, and implementing regulations at 24 CFR Part 135 is applicable to this project.
The City of Paris reserves the right to reject any and/or to waive any informality in the bidding.
Bids may be held by the City of Paris for a period not to exceed thirty (30) days from the date of the

GENERAL [NSTRUCTIONS AND NOTES
The City of Paris is soliciting proposals for the construction of single-family homes within the city lim'tts of
Paris. The homes will be constructed on the site of the existing home of the owner after their existing home
has been demolished. One to eleven homes wlll be constructed under a HOME Program grant received from
the Texas Department of Housing and Community Affairs (TDHCA).
Ail proposals must be submitted by the bidder to the City of Paris, 135 SE 1st St Paris, TX 75460 on er
before 10:00 a.m. on the 4th day of April 2012. Bids will be publicly opened and read aloud April 4, 2012
at 10:15 a.m. The City will select the general contractor that submits the most favorable bid and 'es
qualified to do the work with the lowest combined base bid for the house ptans including alternatives
selected by the City.
Without limiting any of the other obligativns or liabilities of the bidder (contractor), the contractor and
each subcontractor shall, during the term of the contract, acquire and maintain the hereinafter stipulated
minimum insurance with companies duly authorized to do business in State of Texas. Certificates of each
policy shall be delivered to the City before any work is started. The minimum insurance requirements are
as follows:
1. Workers' Compensation as required by state law;
2. Comprehensive general liability fully insuring contractor liability for injury to or death, in the
amount of at least $250,000;
3. Comprehensive automobile and truck liability insurance in accordance with state law; and
4. A performance bond on the part of the contractor for 100 percent of the contract price. A
"performance bond" is one executed in connection with a contract to secure fulfillment of all the
contractor's abligations under such contract
5. A payment bond on the part of the contractor for 100 percent of the contract price. A"payment
bond" is one executed in connection with a contract to assure payment as required by law of ail
persons supplying labor and material in the execution of the work provided for in the contract.
All contractvrs will be required to bid on the home based on the attached construction drawings/plans and
construction specifications. Al) houses will be constructed to meet the Texas Minimum Construction
Standards, inctuding certain accessibility requirements, Residential Energy Code and local/state codes.
The Contractor must ensure employees/applicants for employment are not discriminated against because
of race, co[or, religion, sex or national origin. Section 3 of the HUD Act of 1968 (12 U.S.C. 1701u) as
amended, and implementing regulations at 24 CFR Part 135 is applicable to this project.
Since the City will be funding this home with a grant received from TDHCA, payment for work will be made
only upon completion of the various stages of the home and after progress and final inspections have been
made and approved by the City or by their designated representatives. Payment wili be made within 45
business days after the approval of each invoice. Construction of the home shall be completed within 120
days from the date a notice to proceed is issued to the contractor unless a longer time period has been
stipulated as part of the bid price. Construction must begin within 10 working days from the issuance of
the notice to proceed.
All bid proposaLs must include, at a minimum:
1. Bid Sheet;
2. Detailed bid sheet for each plan;
3. Contractor Application, which lists contractor's qualificatians, experiences, and work references;
and
4. Affidavits incladed in bid packet
5. Evaluation Form
6. A full set of house plans, if submitting an alternative plan bid.

residents through: local advertising media, signs placed at the proposed site for the
project, and community ozganizations and public or private inskitutions operating
within and servicing the project area such as Service Employment and

Concentrated Employment Program, Hometown Plan, or the U.S. Employment

lA Overvtew
A. The purpose of the Texas Minimum Construcdon Specifications is to enswe that ell applicants
who receive new or rehabilitation conswction housing through prngmms funded by the HOME
Invcstment Partnerships Program (HOME Program) live in housing which is safe, decent and
affordable. Furthermore, the Texas Minimum Construcdon Specifications should easure the
investment of pubiic and homeawner funds as it is designecl to lengthen the term of affordability
and preserve habitability.
2.0 Definitione and Acronyma.
A. HOME Program means the HOME Investment Partnerships Program of the Texas Depattment of
Housing and Community Affairs.
B. TDHCA is an acronym for Texas Department of Housing and Communiry Affairs.
C. TMCSS is an acronym for Texas Minimum Constructioa Standards and Specifrcations.
D. Work Covered means all new and remodel construction work cal[ed for in the "work writt-up"
and plans.
3.0 The Contracting Process (for Rehabilitation Conshuctian Projects only)
3.1. Invitation w Bid, Bid Opening, and Award of Contract
3.2. W ithin ten (10) days of noHfication of a contract award, the successful bidder must provide the Contract
Administrator with the following:
A. A list of subcontractors.
B. Certificates of Insurance from the issuing company showing ewTent coverage stipulated in the
eontract documents. The Certificate of Insurance must also include a atatement to the effect that a
thirry (30) day notice of cancellaNon of insurance must be given to the Contract Administrator for
the following:
General liability with completed operadonal coverage of at leact one hundred thousand
dollars ($100,000).
2. Vehicle liability (state minimum).
3. Statutory Workman's compensation (if requlred).

4.4. Hardware: All hardware to be put in operating condition. New keys must be turned over to homoowner as
work is completed.
4.5, Utilities: Use existing or provide own at Contractor's expensc if existing is insuffcient. Homeowner must
provide all exisdng utilities as is aad must be responsible for continuous maintenance and payment of
existing utilities. Conhactor will be responsible to determine utility nads to provide adequate senitary
facility and to safely opemte equipment at all dmes on site.
4.6. Unforeseen damage or Change in Scope of Work: Discovery of defective etements made kirown to the
Contractor before or during the construetion process must be brought to the immediate attendon of the
Contract Administcator in writing. When repairs are made, the repairs must reasonebly match the
sunounding materials in original design and dimension as approved by the Contract Adtnintstrator.
4.7. Where additional work is necessary to meke repairs or to oorrect unforeseen dangerous conditions, the
Contractor must submit to the Contract Administrator a work writt-up of the work, cost of such work, and
the time necessary for such work. Unless it is determined there exists an iuunediate health and safety
danger, NO WORK MUST BE AUTHORIZED uptil agreed apun !n wrldng by the bomeowner,
Contractor, and Contract Admfnirtrator. Compensation for additional work will be negotiated in the
following manuec:
A. The deletion of work proposed, but not started; or if that is not possible;
B. An increase to the dollar amount of the contract, however, approval of euch increase require the
homeowner, contractor, Contract Administrator, and State of Texas HOME pragram written
appmval.
C. Additionel Work - No other work must be done to the project ot6er than the work agreed upon in
writing by the homeowner, Contract Administrator aad contractor or as necessary to romove
immodiate health and safety dangers during the construction phese.
4.8. The Job Site
A. At the job site the contractar must obtain and display all permits and inspection tags as required by
the local Iespectian Department
B. The Contractor must use the site and its facilitiea only for the conshuction stipulated in the "work
write-up". The electrical, sanitary waste, water, and gas systems must be used only for
construction purposes and during the eonstruction phaso or during warranty work.
C. Any discrepancy in the contract documents muat immediately be brought to the attention of the
ContTact Administrator.
5.0 Site Work
5.1. Materials
A. Al) on-site fill matarial must be soil or soil rcek mixture which is free of otganic metter or other
deleterious substances. It must contain no rocks or lumps over 6tl in greatost dimension, and not
more than 15% muat be larger than 2Y2 b' in greatest dimension.
Imported fill material- must conform with 2.1 but must have a maximura particle size of 2b' in
greatest dimension,
C. Fi11 must have a ptaaticity index (Pn of 12 or better unless placed under a fowndation in which
case the PI should be 2.

B. Pads must be monolithic concretc pad, 16dx16b'x4b'. They must be set on firm propared soil
below existing ground surface.
6.4. Steps
A. All steps must have treads a minimurn of ten inches and a maximum rise of sevccn inches. They
must span full width of door opening or they must be minimum 36t/ wide at potches.
B• Pre-cast steps must be standazd size with no defects. They must be set ]cvel with concrete bases
under each corner. When set, the rise from the top step to the wearing surface must be the same as
the rise for the steps or be in the wearing surface ptanc,
C. Hotlow poured steps must be formed and poured over an 8dx 16b' footer. Wall thiclmess must be
minimum of4d, The trrads must be broom finished.
6.5. Slab on Grade
A. All conerete sfabs must be poured monolithically and be a minimum of 4" thick. Reinforcing
must be 6bx 6d, Number 6 welded wire fabric uNess otherwise specified, Top of slab pourod on
existing grade must be a minimum of %z'd above surrounding soil level. All slab designs and
executions must concur with the requirements of the Southern Building code.
A. Before concrete is poured, a slab inspection must be requested from the Contract Administrator
and then pass inspection. All slabs and driveways must meet Contract Administrator codes.
B. Walks must be poured monolithic to expansion joints. Reinforcing must be 6b' x 6b', number 10
welded wire fabric. Width must be a minimum of36b, wide with a bmom 6nish. Control joints
must be spaced the width of the walk. Expaosion joints mast be spaced at a maximum of 203, at
all radius points, elevation changes (i.e. steps, porches, etc.) and at back of curb. Expansion joint
material can be'hb' asphalt impregnated material or %z`d redwood. Slab thickness must be a
minimum of4b.
C. Driveways must be monolithic poured slab with a broom finiah and a minimum theckness of 4",

A. All roofing must be applied in accordance with the Southem Building Code. Unless otherwise
specified all old roof covering, whether composition, wood, oc built up, must be removed prior to
installation of new roof.
B. Atl defective, rotten, or missing sheathing, overhangs, rafter ends, and fascia must be replaced.
C. Therc must not be any voids or obstructions in the sheathing, and knotholes must be wvered with
sheetmetal.
D. All roofing must be done in accordance with t6e maaufacturer's recommendations, and installcd in
such a manntr to prevent any leaks.
12.3. Demolition
A. Demolition of existing mofing must be done quickly to allow replacement before an inclcment
weather condition develops. Precautions must be taken to protect the existing house from water-
datnage at all time.
B. All torn off materiat must be deaped in piles and hauled away immediatelv.

A. Pre-hung units must be installed plumb and level W insure proper operation. Bottom of the door
may be cut off to allow proper ventilation and operation.
B. When a panel is to be inserted into an existing frame, the door opening must be level and made
capable of holding the new door. Recommended clearance from the door to jamb is 3/16". The
panel must be cut off to allow proper ventiladon and operaNon.
C. Bi-folding or louvered bi-folding doors must be used where specified. They must have fow
panels and 6ave pulls attached to the outside two. They must be installed plumb and must fit
evenly and snug between buttcd panels.
D. Pre-hung wooden doors vented a minimum of 100 square inches, top and bottom, must be used on
gas water heater closet door openings. Door must bo installed plurnb and level for proper
operation.
13.5. Storm Doois
A. If mounting surface is rotten or in any manner deteriocated, it must be replaced.
B. Storm doors must be instaUed with screw fasteners and must be caulkai and well fitted.
13.6. Screen Doors

filled. Nails must be countersunk.
B. Installation must be done with manufacturec's suggested adhesive. No joints must be permitted.
The vinyl must be Stted with no gaps showing at walls, door openings, or trim. Full cover must
be achieved. At doors or other areas of joining, metal strips must be installed to pratect floor
covering.

A. Sub-floor must be frce from holes and foreign materlal. Nails must be countersunk.

All lines must be locatcd in wall cavities and under foundation. Inclnde roof jacks and flashing

D. If lines can be repaired they must be repaired as needed to be in good operating condition and free

A. New or replaced Kitchen sink must be new stainless stai 6" deep double basin, 30" self rim unit
installed in kitchen to include strainers/drain plugs, water and waste line eorreetions. Rim must be
sealed to countertop with standard aealer (i.e. plumbers putty, dap sealer, etc). Water lines must
have cut off valves at sink. Faucets must be a washerless, cartridge type, single lever unit unless
otherwise specified. Unit must be chrome plated braes.
B. New or replaced lavatory - repiace with a cast iron porcelsin enamel unit if dameged. Mount
securely to wall frame located as per plans. Faucet must be washerless, chrome plated brass dual
control unit with water, DWV, and cut off valves. Vanity unit, when specified, must have
monolithic sink and top of resin cast marble, bese must be wood veneer on front and sides.
C. New or replaced Tub Unlt - install new white cnameled steel tub unit as per pians. To include new
trap overtlow and drain with stop valve, and water and waste connections. Valvc must be
washerless and high quality chrnme plated brass unit with dusl control, jewel handles. Install
plumbing access.
D. New or replaced Shower Tub Unit - install new white fiberglass shower/tub unit as per plans. To

1.0 Overview
1.1 The pwpose of the Texas Minimum Construction Standards (TMC Standards) is to ensure that all Texans
who receive new or cehabilitated housing serv'rces thinugh programs funded by the Texas Departmerrt of
Housing and Communiry Affairs (TDHCA) live in housing that is safe, decent and affordable. Furthermoro,
the Texas Minimum ConsUuction Standards should ensure that the inveshtwnt of public and homoowner
funds is designed to increase the value of the pmperty, lengthen the term of affordability, and preserve
habitsbility,
1.2 All work carried out with the assistance of funds provided through the TDHCA must be carried out in
accordance with these standards, musi meet minimum specifications and unless otherwise defined must meet
or cxceed industry and trade staudards.
1,3 Definitions and Acronyms
A. HOME Progrann meam the HOME Investment Parbnerships Progtam as a program of the Texas
Department of Housing and Community Affairs.
B. TDHCA is an acronym for Texas Deparqnent of Housing and Comtnunity Affairs.
C. TMCSiandards is an acronym for Texas Minimum Constivction Standards. TMC Standards was
formerly known as the Texas Minimum New and Rehabilitation Construction Standards
1.4 Inspections
A. Inspecrions must be catried out using the appropriate TMC SG►ndards checkliata. All rooms,
service porches, exterior areas, out buildinge, crawl spaces and attie spaces must be inciuded in all
inspections. Inspectiona will include all issues ineluded on the checklist but, when not indieated,
any evidecrt de8ciency or hazard will be noted. Whtn rural property is inspected, ai( out buildings
used by the household for storage, garege, etc., will be included with all yard areas. Otherwise ap
buildings and yacd space included on an individual lot will be inspected. Once HOME funds are
invested, all inspected areas must meet TMC Standards. No txceprions or deletions wi11 be
permitted.
1.5 Work Write-Ups
A. Work write-ups should be writtett with enough detail to epecify, each item to be repaired, quantity
of materials to be used and exact location of each nepair. Each item should relate to a spociftc
inspection ittm and should have a spxific line item cost estimate,
1.6 Cost Estimates
A. Cost estimates should be detailed for each repair item. Each repair item must reference a specific

H. Except for reconshuction or other required intermptions, the homeowner must provide all existing
utilities for use by the contracWr (as they relate w the consduction) and must be responsible for
contiauous maintensnce and payment of existing utilities.
1.8. In order to meet TDHCA Standards, contractors are responsible for, and must meet minimum requirements
as follows:
A. AIl contiactors muet cany and provide proof of a current general liability policy of at least one
hundred thousand dollars ($100,000).. This policy should cover all work dont under the HOME
program and be pro-paid througb the period of the contracL No geographic, time or other
limitation that excludes the HOME pragracn will be acceptable.
B. All contractors must be verified by TDHCA as not being debarred by the Federal Goverament.
Any contractor who is cnrrently debarred will not be eligible for payment and should not become
party to a HOME Program fiutdcd project.
C. Wheaever possible, Contract Administrators will give opportunities W Historically Underutilized

evenly applied criteria for contractor selection. These may include but are not limited ta;
1. Workers compensation insurence;
2. Verificadon of quality of work references;
3. Verification of credit referenees, and;
4. Verification of established line of credit
1.9 An approved contractor list may be croated bat must be accessible w atl applicants who meet the fair and
reasonable criteria pre-established by the Contract Administrator. Such criteria should be published as an
element of the Program Policy and Procedures and must be made available in writing upon demand by
intcresteci parties. It is recommettded that the published criterie, along wiih an advertisement to bid, be
posted in a public place. Any advertisement to bid shouid allow reasoaable time for an interested party to
mcet the criteria required by the Gontract Administrator.
1. 3 0 Conttactors will be selected through an itemized bid process. A sealed bid is the preferred method for
selecting bids. If the modified bid process is beiag followed, the homeowner may seleet any bid that is
within 15% of the cost estimate. Iiowever, the low bid is always preferred and the homeowner shoutd state
their preference for a higher bidder in writing. If the homeowner has deferred contiactor seiection to the
Contract Administratar the lowest and best bid will be selectad.
1.11 Contrectors will adhere to the tenns of the rehabilitation contact including these performance standards
and the general specifications. Whenever the need for clarification results in a change, suc6 issues will
result in a writtan change order prior to any work being completad. No work will be approved except that
which is estabfished in the contract and in written approved change orders. Any unforoswn or hidden
condition should be reported to the Conhact Administrator immediately. Any itcm that conflicts with these
staadards should be reported immediabely by the contiactor.
1.12 Whenever possible the contractor will make an effort to minimize the impact of the eoitsttvction on the

1.25 The Contract Administmtor will inspect such work as soon as possible (usuaily within one business day)
from receipt of such request.
1.26 The Contract Administrator will provide a completed Contractor Request for Payment form to the
contcactor. The contractor must sign for the work for which payment is autlwrized and then reyuest the
homeowner to exccute the Contractor Raquest for Payment form. Payments will be made thereafter.
1.27 All materials used must be new (unless otherwise specified in the Project Manual) and of a good quality.
All work must be done with skilled cmftsmen and aceomplished with caro. Contractor must provide
samples to the 6omeowner for selection for all materials as cited in the individual specificadons and
pmvide reasonsble time to the homeowner to make selections. Contractor must submit a lettcr to the
Contract Administrator, signed by the homeowner, stating that the homeowner approves of colors and
quality of items such as, but not limited to; paint, flooring materials, brick, shingles, vinyl siding,
door/window/drawer hardware, and counter tops.
1.28 Upon completion of consttuction, the contractor will;
A. Remove all construction debris from the site;
B. Clean and map all resilient floors;
C. Clean all new and exiating paint from other finished surfaces iqcluding window glass and mirrots;
D. Leave all newly instaUed items in oporating condition;
E. Light gas water heater pibts, stove/oven pilots and gas heater pilots;
F. Start all other clectricaE and mechanical systems;
G. Put all hardware in operatiag condidon;
H. Deliver new keys to homeowners as hardware is installed.
1.29 Discovery of defective elements made known to the coetracwr before or during the conshuction process
must be brought to the immediatc attention of the Contract Administrator in writing. When repaits are
made, the repairs must reasonably match the suaounding materials in original design and dimension as
approvod by the Contract Administrator.
130 Where additionsl work is necessary to make repairs or to correct unforescen dangerous conditions, tho
contractor must submit to the Contract Administrator a proposal consisting of what type of work is
nceded, the cost of such work, and the time nxessary for sueh woric to be completad. Unless it is
determined there exists an immediate health and safety danger, NO WORK MUST BE AUTHORIZED
until agreed upon in writing by the homeowner, conhactor, and Contract Administrator.
1.31. Compensarion for additional work will be negotiated in the following manner,
A. The deletion of work proposed, but not started; or if that is not possible;
B. An increase to the dopar amount of the contract (if funds are available).
1.32 No other work must be done to the project other than the work agreed upon ia writing by the homeowner,
Contract Administrator and contractor or as necessary to remove immediate health and safety dangers
during the construction p6ase.

service within h,velve (12) months of rehabilitation through a written receipt or statement.
4.2 Hazardous and Substandard Condidons
A. Must include any condition that threatens the health and or safety of the occupants. Substandard
conditions include any condition that threatens, defeats or will lead to the lack of fuactional
viability of a single feature of a home. These condiNons must include but not be limited to:
1. Infestations of pest, wood destroying insects, or vermin;
2. Untreated wood having direct ground contact and used for structural purposes;
3. Cluttered debris or stored materials suitable for rodent or insect habitat
B. Any other condition not mentioned that meets We definition of a hazardous or substandard
condition should be repaired and/or rehabilitated to meet industry standards.
5.0 Space and Uee
5.1 Minimum Space Standards for Ctiilings
A. Wherever possible, a habitable room in a dwelling or dwelling unit must have s ceiling height of
not less than 7'-6". At least h of the floor area of every habitable room located above the 1' floor,
must have a ceiliqg height of 7'-6". The floor area of that part of any room where ihe ceiling
height is less than 71-6" must not be coasidered as part of the floor area in r,omputing the total
floor area of the room for the purpose of determining maximum floor area.
B. Where the ceiling height of a habitable room is less than 7' and it would be cost-prohibitive to
raise said ceiling, the requiremcnt may be waived provided tho Contract Administrator does so in
writing.
C. A ceiling height of a minimum of 7', is acceptable in bathrooms, toilei roonts, hal]ways, utility
rooms, and kitchens.
5.2 Minimum Space Standards for Hallways
A. All rooms, except tcitchens snd/or kitchenettes and batha, haflways, storage rooms and porches
must have, a minimum width of 7'.
5.3 Minimum Space Standards for Kitchens
A. All kitchens must have adequate food storage facilities including at least thm linear fcet of
counter area for food preparation, adequate cabinet space in good repair.

12.1 Minimum Electrical Standerds
A. Thc minimum electrical service for each dwelling and/or dwelling unit must be 100 amps, or as
adjusted and approved, in writing, by the electrical inspector of the city in the absence of a city
electrical inspector, the rehabilitation technician for the city/state, may make a determination that a
lower scrvice is adequate, provided that such determination is in writing with the besis for such
determination inc[uded. Furthermore, lesstt scrvico should be approved by the service provider.
B. Service should be of a three wire type, with service entry on an approved weatherhead at least 12
feet from grade and not to extend beyond 2 feet unsupported.
C. Al] exposed wiring, service li»es and feeders must be protected and properly shielded in approved
conduit.
D. Every habitable room within such dwelting must contaiti, at a minimum, 2 separate and remote
waU type elecMc convenience outiets. Habitable rooms over 120 square feet, must contain, t~a
minimum 3 separate and remote wall type electric convenience outlets. All newly installed outlets

water, under pressure, end must be properly maintained in working oMer. Faucets should be fizc
from leaks or drips and should shut off completely
C. Every dwelling unit must contain a bathtub and/or shower. Bathtub and/or shower may be in the
same room as the f lush water closet and lavatory, or said bathtub and/or shower may be in a
separate room. T'hese facili6es must be properly connected to both hot and cold running water
lines, under pressure, and must be maintaincd in working otdec. Faucets should be free frnm teaks
or drips and should shut offcompletely.
D. Toilets and bathrooms must have doors with a privacy typc tock and such doors, lock and
' hardware must be operable and maintained in worlcing order.
E. Every dwelling must have supplied water-heating facilities which are properly installed; are
maintainod in working condition and free of leaks; are properly connected to any required hot
water lines; and, sre capablc of heating water to be drawn for every bath as well as general usage
F. Hot water storage assoceated with water hesting facilities must be not less than 30 gallans for a
single family dwelling. All water heatens must be properly vented and sealed and must be equipped
with a pressure relief valve and drip log.
G. Every kitchen sink, toilet, lavatory basin and bathtub/shower, must be maintained in working
condition and be properly connected to an approved water and sewer or septic system.
H. Potable water supply piping, water discharge outlets, back-flow prevention deviees or similar
equipment must be in serviceable condition fim from deterioration, cornosion and blcekage and
must not be so lceated as to make possible their submergence in any contaminated or polluted
liquid or substance.

15.1 Minimum Mechanical Systems Staederds
A. Each dwelling and/or dwelling unit must be supplied with its own heating system,
B. All heating facilities must be properly installed, be maintained in working condidon and be
capable of adequately hearing all habitable rooms, bathrooms, and toilet rooms contained therein,
or intended for use by the accupants thereof, to a tempeiature of at least 70 degrea F. (21-degrees
C. ) at a distance 3 fect above the floor when the outside temperature ia at or below minas 10
degrees F.
C. Ambient heat must be supplied from an.adequate heat source in an adjoining room or hallway;
D. Evcry supplied central heating system must comply with all of the following requiremtnts:
E. The central heatiug unit must be safe and in good worlcing condiqon.
F. Every heat duct, steam pipe, and hot water pipo must be free of leaks and must fiwction so that an
adequate amouni of heat is delivered where intended;
G. Every seal between any of the sections of a hot air furnace must be air-tight so noxious gases and
fumes will not escape into the heat ducts; Liner must be installed. The liner must meet or exceed
the requirements of the local building/heating code and mnst be installed according w same.
Where there are no local building/heating codes, equipment and installation must be inspected and
approved by a person qualified in this area as designated by the city/county/state
H. Whencver an exisdng structurc has as its source of central heat the old ocWpus rype conversion
furnace, the unit must be inspected by a qualified fvrnace inspector to determine if the unit is stili
safe, free from carbon-monoxide leakage and capable of supplying heat as rEquired above.
1. Every supplied epace heater must compty with all of the following requirements:
J. No space heater burning solid, liquid, or ga.seous fuels must be of a portable type;
K. Every space heater burning solid, liquid, or gaseous fuels must be properly vented to a chimney or
duet leading to outdoor space and must be so installed as to provide proper draft (except when a
functioning ODS system and a CO testing device is insta{led).
L Every fuel buming space heater must have a fur-resistant panel between it and the floor or floor
covering; whenever a space heater is located within 2 feet of a wall, said wall muet be protected
with insulation sufficient to prevent overheating of the wall.
M. Evcry space heater smoke pipe must be of a double walled variety and must be equippod with
approved type thimbles or guarda, properly constructed of non-flsmmable material. At the point

N. Whenever feasible, un-vented free standing space heaters thould be ramoved and replaced with
vented types. In rare situadons, whon vented rype units are not feasible, un-vented QDS equipped
units may be installed if approved by the City, County and State. In cases wherc ODS oquipped
heater are used a Carbon Monoxide testing device will be perraanently installed.

17.0 Mannfactared Housing
17.1 Minimum Manufactured Housing Standards
A. Construcdon standards for new manufactuned housing units are set by the National Manufactured
Housing Constcuction aad Safety Standards act of 1974, the Texas Manufactuned Housing
Standards Act (Article 5221 F) and HUD Code Standards 3280 and 3282.
B. All mannfactured housing must be installod on a permanent foundation.
C. All manufactured homes will be tied down through the installation of approved tie downs adequate
to meet state requirements.
D. All road transport accessories such as wheels, trucks and hitching devices must be removed in
order to make installation permanent.
17.2 Hazardous and Substandard Conditions
A. Hazardous conditioas must includo auy condition that tlu-eatens the health and or safety of the
occupants. Substandard conditions iaclude any coadition that tlveatens, defeats or wili lesd to
the lack of functional viability of e single feature of a home. These conditions must include but not
be limited to:
1. A manufactured home that is not permanently situatcd on a permanent foundation;
2. A manufachtned home that is not adequately tied down or affixed by an approved tie

4. PROGRESS PAYMENTS: The Contractor agrees that the total contract price shall be paid
in one or more payments, based upon the value of the work completed at the time the
progress payment is made. Such progress payments shall be disbursed at the time and in
the amounts specified in the Payment Schedule, after inspection and approval of the work
by Owner and the Contract Administrator, less a haldback of 10 perven# of the price of work
completed. The holdback shall be retained until final payment in order to protect the Owner
from any default by the Contractor. in the event the Contractor defaults, the holdback shall
be disbursed in ac.cordance with Part II, paragraph 10 of this Contract. Final payment shall
be due upon satisfactory completion and acceptance of the work as in compliance with this
Contract by the Owner and the Contract Administrator, permit sign-off, submission of
sat'rsfactory waiver(s) of liens or a bond satisfactory to the Owner and Contract
Administrator indemnifying the Owner against any lien, and submission of all waRanties
and guarantees. The Owner shalt not withhold payment to the Contractor except for
noncompliance with the terms of this Contract, and shall not request the Contractor to
perform work outside the scope af this Contract as a condiflon of receiving payment. The
Contractor acknowledges that it is a material breach of this Contract to request or accept a
progress or final payment which is in excess of the price of the work compieted at the time
such payment is requested, less the required hofdback.
5. WARRANTY: The Contractor warrants that all improvements, hardware and fixtures of
whatever kind or nature to be installed or constructed on the property by the Contractor or
the Contractor's subcontractors will be of good quality, suitable for their purpose and free
from defects in workmanship or materials, or other deficiencies. This is a full warranty
extending to the Owner and subsequent owners of the property; provided, however, that the
warranty set forth in this paragraph shall apply only to deficiencies and defects about which
the Owner or subsequent owner(s) shali have notified the Contractor at the address stated
above within one year, except for any extended warranty periods on roof shingles, kitchen
appliances, HVAC and water heater.
6. PARTIES TO CONTRACT: The Owner and Contractor agree that they are the sole parties
to this Contract and are solely responsible for its performance. The parties agree that the
Contract Administrator, Texas Department of Housing and Community Affairs, or the United
States Department of Housing and Urban Development do not assume any liability or
responsibility whatsoever for the performance of any term of this Contract.
PART II. Standard Terms
1. INSURANCE: During the continuance of the work under the Contract, the Contractor and all
subcontractors shall:
a. Maintain worker's compensation and employer's liability insurance in amounts
sufficient to protect themselves and the Owner from any liability or damage for
injury (including death) to any of their employees, including any liability or
damage which may arise by virtue of any statute or law in force or which may
hereafter be enacted; and
b. General Commercial liability insurance in amounts sufficient ta protect
themselves and the Owner(s) and the Ciiy of , Texas against ail risks
of damage or injury (including death) to property or persons wherever located,
resulting from any action ar aperation under this Contract or in connection with
the woric. Qwner and the City of Paris, Texas shall be names as additianal
insureds under this policy for the duration of the contract term.
The Contractor agrees to provide evidence to the Owner and Cantract Administrator of
such insurance prior to commencement of work. Fa(lure to provide adequate evidence of
insurance or failure to mainfaln the insurance as required by this paragraph shall be
grounds for terminating this Contract at the option of the Owner.
2. ASSlGNMENT: The Contractor agrees not to assign this Contract without urritten
concurrence by the Contract Administrator
3. CHANGE ORDERS: The Contractor agrees not to make any changes in the Schedule of
Work or the Specifications without written authorization by the Owner and written
concurrence by fhe Contract Administrator.
4. PERMITS AND CODES: The Contrac#or agrees to secure and pay for all necessary permits
and licenses required for the Contractor's performance of this Contract in compliance with
applicable local requirements; including local building and housing codes, where applicable,
whether or not specified in the Schedule of Worlc or Specifications.
5. HOLD HARMLESS: The Contractor agrees to defend, indemnify, and hold the Owner and
the City of and its elected officfals, offlcers and employses harmless from any
liability or claim for damages because of bodily injury, death, property damage, sickness,
disease or loss and expense arising from the Contractor's performance of this Contract.
Each contractor and subcontractor is acting in the capacity of an independent contract with
respect to the Owner. The Contractor further agrees to protect, defend and indemnify the
Owner from any Gaims by laborers, subcantractors or materialmen for unpaid work or labor
performed, or materials supplied in connection with this Cantract.
6. ELIGIBILITY: The Contractor represents that he or she is not listed on the Disbarred and
Suspended Con#ractors List of the U.S. Department of Housing and Urben Devetopment or
the Contract Administrator, and further agrees not to hire or utilize as a subcontractor or
supplier any person or firm that is so kisted.
7. FEDERAL LABOR STANDARDS: If this Contract (1) r.oncems the rehabilitation of
residential properties containing twelve (12) or more units or (2) calls for a price of $2,004
any financial interest or benefit, direct or indirect, in this Contract.
a. Any officer or employee of the Contract Administrator who exercises any function
or responsibility in connection with administration of a HOME Program contract;
b. Any member of the goveming body of the Contract Administrator;
c. Any member of the goveming body of the locaiity (as defined by 24 CFR 510.4
(R►);
d. Any member of or delegate to the Congress of the United States;
e. Any person employed by HUD at a grade level of GS-9 or above.
14. EQUAL OPPORTUNITY: The Contractar agrees to abide by all federal, state or local
regulatians relative to squal opportunity for all persons, without discrimination as to race,
color, religion, national origin, sex, familial status, or disability. On agreements of $10,000
or more, the Contractor agrees to abide by the following provisions of Executive Order
11245, and agrees to incorporate such language in all contracts for $10,000 or more which
he/she may enter into in connection with this agreement.
During the performance of this Contcact, the Contractor agrees as follows:
a. The Contractor will not discriminate against any employee or applicant for
employment because of race, color, religion, sex, national origin, disability or
famiiial status. The Contractor will take affirmative action to ensure that
applicants are employed, and that employees are treated during employment
without regard to their race, color, reiigion, sex, national origin, disability or
familial status. Such action shalf include, but not be limited to the following:
employment, upgrading, demotion, or transfer recruitment or recruitment
advertising; layoff or terminatfon; rates of pay or other fonns of compensation;
and selection for training, including apprenticeship. The Contractor agrees to
post in conspicuous places, available to employees and applicants for
employmen#, notices provided by the municipality setting forth the provisions of
this nondiscrimination clause.
b. The Contractor will, in a!I solicitations or advertisements for employees pfaced by
or on behalf of the Contractor, state that all qualified applicants will receive
consideration for emplayment without regard to their race, color, religion, sex,
national origin, disability or familial status.
c. The Contractor will send ta each labar union or representative of workers with
which he/she has a collective bargaining agreement or other contract or
understanding, a notice advising the said labor unian or worker's representative
of the Contractor commitments under this section and shall past copies of the
notice in conspicuous places available to employees and applicants for
employment.
Urban Development, and contracts work in cannection with the project be
awarded to business concerns which are located in, owned in substantial part by
persons residing in the same metropolitan area (or non-metropolitan county) as
the project.
b. The parties to this contract will comply with the provisions of said Section 3 and
regulations issued pursuant to thereto by the Secretary of Housing and Ucban
Develapment set forth in 24 CFR Part 135, and all applicable rules and orders of
the Department issued thereof prior to the execution of this contract. The parties
to this contract certify and agree that they are under no contractual or other
disability, which would prevent them from complying with these requirements.
C. The Contractor will send to each labor organization or representative of worlcers
with which they have a collective bargaining agreement or other oontract or
understanding, if any, a note advising the said labor organizatidn or woricers'
representative of his cammitments under the Section 3 clsuse and shall post
copies of the notice in conspicuous places available for employees and
applicants for emptoyment or training.
d. The Contractor wiN include this Section 3 clause in every subcontract for work
connected with the project and will, at the direction af the appiicant for, or
recipient of, federal financial assistance, take appropriate action pursuant to the
subcontract update finding that the subcontractor is in violatian of regulations
issued by the Secretary af Housing and Urban Development, 24 CFR Part 135.
The Contractor will not subcontract with any subcontractor where it has notice or
knowledge that the iatter has been found in violation of regulations under 24 CFR
Part 135 and will not let any subcon#ract unless the subcontractor has first
provided it with a preliminary statement of ability to comply with the requirements
of these regulations.
e. Compliance with the provisions of Section 3, the regulations set forth in 24 CFR
ParE 135, and all applicable rules and orders of the Department issued
thereunder prior to the execution of the contract shall be a condition of the
federal financial assistance provided to the project, binding upvn the applicant or
recipient for such assistance, its successors, and contracto►s and subcontractors,
its successors, and assigns to those sanctions specified by the grant or loan
agreement or contract through which federaf assistance is provided, and to such
sanctions as are specified by 24 CFR Part 135.
