851 FEET TO THE WEST BOUNDARY LINE OF LOT 8, BLOCK C,
AND LOT 17, BLOCK D, PORTER' S SECOND ADDITION, AND ON
WEST SHERMAN STREET, FROM THE WEST BOUNDARY LINE OF
25TH STREET, S. W., WEST APPROXIMATELY 861 FEET TO THE
WEST BOUNDARY LINE OF LOT 13, BLOCK A, PORTER'S FIRST
ADDITION, AND LOT l, BLOCK C, PORTER'S SECOND ADDITION, IN
THE CITY OF PARIS, TEXAS; DIRECTING THE CITY CLERK OF THE
CITY OF PARIS TO PUBLISH THE SAME THREE (3) TIMES IN THE
PARIS NEWS AS REQUIRED BY LAW; APPROVING AND ACCEPTING
THE FINAL ESTIMATES OF COSTS AND CONSTRUCTION PLANS OF
SUCH STREET IMPROVEMENTS AS FILED BY THE DIRECTOR OF
PUBLIC WORKS OF THE CITY OF PARIS; FIXING THE CHARGES TO
BE ASSESSED AGAINST THE ABUTTING PROPERTY OWNERS AND
THE CHARGES TO BE PAID BY THE CITY OF PARIS; AND WITH THE
INTENTION OF FIXING A CHARGE AND LIEN AGAINST THE REAL
AND TRUE OWNERS OF SAID PROPERTY AND A.GAINST THE SAID
PROPERTY ITSELF.
Whereas, the City Council of the City of Paris, Paris, Texas,
hereby finds and determines:
l. That the City Council of the City of Paris, Paris, Texas,
has heretofore by ordinance duly enacted on the 8th day
of January, 1973, determined the necessity for and or-
dered the improvement of the following streets:
(a) West Brame Street, from the West Boundary Line
of 25th Street, S. W. , West approximately 851 feet
to the West Boundary Line of Lot 8, Block C, and
Lot 17, Block D, Porter's Second Addition.
(b) West Sherman Street, from the West Boundary Line
of 25th Street, S. W. , West approximately 861 feet
to the West Boundary Line of Lot 13, Block A,
Porter's First Addition, and Lot 1, Block C,
Porter's Second Addition.
by installation of a six inch (6") white rock base and a
double seal of asphalt penetration surfacing, and accord-
ing to the plans and specifications prepared by the
Director of Public Works.
2. That a notice duly executed in the name of the City of
Paris, Paris, Texas, of the enactment of said above
described ordinance has heretofore been filed with the
County Clerk of Lamar County, Texas, the County in
which said City of Paris is situated.
3. That the City Council has caused the Director of Public
Works to prepare and file estimates of the costs of
such improvements and estimates of the amounts per
front foot to be assessed against the property abutting
said streets within the limits defined and the real and
true owners thereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PARIS:
Section l. The date for public hearing before the City Council
of the abutting property owners on the above described property is
hereby fixed at 7:00 o'clock P. M. , in the City Council Room, City Hall,
Paris, Texas, on the 10th day of March, 1975. That the City Clerk is
hereby directed to publish in the Paris News, notice of the public hear -
ing, three (3) times prior to said public hearing, the first of said
notices to be published at least twenty-one (21) days prior to the date
of the public hearing, as required by law.
Section 2. That the report to the City Council by the Director
of Public Works, consisting of the final estimate of the costs of the
improvements to the abutting property owners of $1. 32 per front foot
for the materials for paving, as heretofore approved, and the final
construction plans and final estimates, as prepared by said Director
of Public Works, are in all things approved by the City Council of the
City of Paris. That the City of Paris is to pay all of the labcr and
equipment costs of constructing sa.id street, in the amount of
$1, 884. 10, and the abutting property owners are to pay the remaining
costs of $2, 088. 90, on West Brame Street. That the City of Paris is
to pay all of the labor and equipment costs of constructing said street,
in the amount of $1, 846. 12, and the abutting property owners are to
pay the remaining costs of $2, 119. 92, on West Sherman Street.
Section 3. That it is the intention of the City Council to assess
the abutting property owners and to fix a lien against the abutting pro-
perty, as provided for and under the terms and provisons of Chapter
106 of the Acts of the F.irst Called Session of the 40th Legislature of
the State of Texas, now designated as Article 1105b, Vernon's Texas
Civil Statutes, under which law these proceedings are taken and had.
Passed and adopted by the City Council of the City of Paris, in
regular session convened, on this the lOth day of February, 1975.
