AN ORDINANCE FIXING THE DATE FOR A PUBLIC HEARING
ON PROPERTY ON EAST CHERRY STREET, FROM THE SOUTH
WEST CORNER OF LOT 2A, CITY BLOCK 258A, AND THE NORTH
WEST CORNER OF LOT l, BLOCK A, FRY ADDITION, EACH OF
WHICH LIE IN THE EAST BOUNDARY LINE OF 20TH STREET,
N. E., IN AN EASTERLY DIRECTION APPROXIMATELY 1889 FEET
TO THE SOUTH EAST CORNER OF LOT 5, CITY BLOCK 258, AND
THE NORTH EAST CORNER OF LOT 8B, CITY BLOCK 257A, EACH
OF WHICH LIE IN THE WEST BOUNDARY LINE OF 25TH STREET,
N. E., IN THE CITY OF PARIS, TEXAS; DIRECTING THE CITY
CLERK OF THE CITY OF PARIS TO PUBLISH THE SAME THREE (3)
TIMES IN THE PARIS NEWS AS REQUIRED BY LAW; APPROVING
AND ACCEPTING THE FINAL ESTIMATE OF COSTS AND CON-
STRUCTION PLANS OF SUCH STREET IMPROVEMENTS AS FILED
BY THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF PARIS;
FIXING THE CHARGES TO BE ASSESSED AGAINST THE ABUTTING
PROPERTY OWNERS AND THE CHARGES TO BE PAID BY THE CITY
OF PARIS; AND WITH THE INTENTION OF FIXING A CHARGE AND
LIEN AGAINST THE REAL AND TRUE OWNERS OF SAID PROPERTY
AND AGAINST THE SAID PROPERTY ITSELF.
WHEREAS, the City Council of the City of Paris, Paris, Texas,
hereby finds and determines:
1. That the City Council of the City of Paris, Paris, Texas,
has heretofore by ordinance duly enacted on the 14th
day of October, 1974, determined the necessity for and
ordered the improvement of East Cherry Street, from
the South West Corner of Lot 2A, City Block 258A, and
the North West Corner of Lot l, Block A, Fry Addition,
each of which lie in the East Boundary Line of 20th
Street, N. E. , in an Easterly direction approximately
1889 feet to the South East Corner of Lot 5, City
Block 258, and the North East Corner of Lot 8B, City
Block 257A, each of which lie in the West Boundary Line
of 25th Street, N. E., by installation of curb and gutter,
storm sewer and paving, and according to the plans and
specifications prepared by the Director of Public Works.
2. That a notice duly executed in the name of the City of
Paris, Paris, Texas, of the enactment of said above
described ordinance has heretofore been filed with the
County Clerk of Lamar County, Texas, the County in
which said City of Paris is situated.
3. That the City Council has caused the Director of Public
Works to prepare and file estimates of the costs of
such improvements and estimates of the amounts per
front foot to be assessed against the property abutting
said street within the limits defined and the real and
true owners thereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section 1. The date for public hearing before the City Council
of the abutting property owners on the above described property is
hereby fixed at 7:00 o'clock P. M. , in the Municipal Court Room, Police
and Courts Building, Paris, Texas, on the lOth day of November, 1975.
The City Clerk is hereby directed to publish in the Paris News, notice
of the public hearing, three (3) times prior to said public hearing,
the first of said notices to be published at least twenty-one (21) days
prior to the date of the public hearing, as required by law.
Section 2. That the report to the City Council by the Director of
Public Works, consisting of the final estimate of the costs of the im-
provements to the abutting property owners of approximately $2. 80
per front foot for curb and gutter, plus any additional costs to extend
driveways and other improvements to individual property as requested
by property owners, as heretofore approved, and the final construction
plans and final estimate, as prepared by said Director of Public Works,
are in all things approved by the City Council of the City of Paris.
That the City of Paris is to pay all storm sewer and paving costs, in
the amount of $5, 898. 20 and the abutting property owners are to pay
the remaining costs of $13, 368. 98.
Section 3. That it is the intention of the City Council to assess
the abutting property owners and to fix a lien against the abutting pro-
perty, as provided frDr and under the terms and provisions of Chapter
106 of the Acts of the First Called Session of the 40th Legislature of
the State of Texas, now designated as Article 1105b, Vernon's Texas
Civil Statutes, under which law these proceedings were taken and had.
Passed and adopted by the City Council of the City of Paris, in
regular session convened, on this the 13th day of October, 1975.
