AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR
A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN
PROPERTY BY THE CITY OF PARTS, PARIS, TEXAS, AND AUTHOR-
IZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH
PUBLIC HEARING.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section 1. That on the lOth day of May, 1976, at 7:00 0' clock
P. M. , in the Municipal Court Room, Police and Court Building, in the
City of Paris, Texas, the City Council will hold a public hearing giv-
ing all interested persons the right to appear and be heard on the
proposed annexation by the City of Paris, Paris, Texas, of the follow-
ing described property:
TRACT l: Situated in the Isaac Cruise Survey in
Lamar County, Texas, and being part of a 216.02 acre
tract of land conveyed Ernest Randle by deed recorded
in Vol. 272, Page 617, Deed Records of Lamar County,
Texas, and being more particularly described as follows:
BEGINNING at the Southwest Corner of a 1 acre
tract of land conveyed Darrell White by deed recorded
in Vol. 446, Page 80, of said Deed Records, and lying in
the present City Limit Line;
THENCE N 78 ° 30' E with the south line of said
White tract and the present City Limit Line, 100. 0 feet
to a point;
THENCE South, 160. 0 feet to a point;
THENCE West, 197. 0 feet to a point in the east line
of Gordon Lake Road (private);
THENCE North, with the east line of Gordon Lake
Road, 119. 86 feet to a point in the present City Limit
Line;
THENCE N 78 ° 30' E 101. 03 feet to the place of
beginning and containing 0. 64 acres of land more or
less.
TRACT 2: Situated partly within the Corporate Limits
of the City of Paris, County of Lamar, State of Texas, a
part of the Joseph Leach Survey and being a part of a
tract of land now owned by D. Wayne and G. Eugene
Brown and being a part of 57 acres of land conveyed
J. L. Jopling in Vol. 312, Page 509, of the Deed Records
of said County and State, and being further described as
follows :
BEGINNING at a stake in the East Boundary Line of
the above mentioned 57 acre tract, said stake being
South 987 feet from the Northeast corner of said 57 acre
tract;
THENCE South along the East Boundary Line of said
57 acre tract a distance of 633 feet to its Southeast
corner in the North Boundary Line of the Old Clarksville
Road;
THENCE along the North Boundary Line of the Old
Clarksville Road as follows: S 69 Degrees W 550 feet;
S 80 Degrees W 135 feet; S 87 Degrees W 143 feet, a
stake for corner;
THENCE along the East Boundary Line of Loop
Highway 286 as follows: N 36 Degrees W 369 feet;
N 57 Degrees W 122 feet; N 29 Degrees W 70 feet to
a stake for corner;
THENCE East 380 feet to a stake for corner;
THENCE North 405 feet to a stake for corner;
THENCE East 60 feet to a stake for corner;
THENCE North 185 feet to a stake for corner;
THENCE East 500 feet to a stake for corner;
THENCE South 135 feet to a stake for corner;
THENCE East 200 feet to the place of beginning
and containing 17. 502 acres, of which 5. 895 acres are
presently in the City Limits.
Section 2. Ihat the Mayor of the City of Paris, Paris, Texas,
is hereby authorized and directed to cause notice of such public hear-
ing to be published once in the newspaper having general circulation
in the City and in the above described territory not more than tventy
(20) days nor less than ten (10) days prior to the date of such public
hearing, all in accordance with the Municipal Annexation Act (Chapter
160, Acts of the 58th Legislature, Regular Session, 1963; compiled
as Article 970a, Vernon's Texas Civil Statutes).
Section 3. It is hereby declared to be the intention of the
City Council of the City of Paris that the sections, paragraphs, sen-
tences, clauses and phrases of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance
shall be declared unconstitutional or invalid by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality
or invalidity shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorpcr ation
in this ordinance of any unconstitutional or invalid phrases, clauses,
sentences, paragraphs or sections. It is further hereby declared to
be the intention of the City Council of the City of Paris to exclude any
area or areas described in the description of the property to be
annexed, which are not within said City`s jurisdiction to annex and
that such area or areas should be carved out of the description of
the property herein described by the valid judgment or decree of any
court of competent j urisdiction, in order that such area or areas
would not cause this annexation ordinance to be found to be invalid,
voidable or void.
Section 4. This ordinance shall take effect immediately upon
passage.
