AN ORDINANCE FIXING THE DATE FOR A PUBLIC HEARING ON PROPERTY ON F. M. HIGHWAY NO. 1507, FROM THE EAST BOUNDARY LINE OF STATE HIGHWAY 19 AND 24, EAST TO THE EAST BOUNDARY LINE OF PARIS INDEPENDENT SCHOOL DISTRICT PROPERTY, 1. 585 MILES, IN THE CITY OF PARIS, TEXAS; DIRECT- ING THE CITY CLERK OF THE CITY OF PARIS TO PUBLISH THE SAME THREE (3) TIMES IN THE PARIS NEWS AS REQUIRED BY LAW; APPROVING AND ACCEPTING THE FINAL ESTIMATE OF COSTS AND CONSTRUCTION PLANS OF SUCH STREET AND HIGH- WAY IMl'ROVEMENTS PREPARED BY THE TEXAS HIGHWAY DEPARTMENT AND FURNISHED TO THE DEPARTMENT OF PUBLIC WORI<S OF THE CITY OF PARIS AND FILED WITH THE CITY COUNCIL; FIXING THE CHARGES TO BE ASSESSED AGAINST THE ABUTTING PROPERTY OWNERS AND THE CHARGES TO BE PAID BY THE CITY OF PARIS; AND WITH THE INTENTION OF FIXING A CHARGE AND LIEN AGAINST THE REAL AND TRUE OWNERS OF SAID PROPERTY AND AGAINST THE SAID PROPERTY ITSELF. WHEREAS, the City Council of the City of Paris, Paris, Texas, hereby finds and determines: 1. That the City Council of the City of Paris, Paris, Texas, has heretofore by ordinance duly enac ted on the 13th day of October, 1975, determined the necessity for and or- dered the improvement of F. M. Highway No. 1507, from the East Boundary Line of State Highway 19 and 24, East to the East Boundary Line of Paris Independent School District Property, l. 585 miles, by cooperating with the Texas Highway Department in the widening, shaping and partial relocation of said public street and highway, and providing for curb and gutter on each side of said street and highway and providing for storm sewer and paving, and according to the plans and specifications prepared by the Texas Highway Department and furnished to the Department of Public Works of the City of Paris. 2. That a notice duly executed in the name of the City of Paris, Paris, Texas, of the enactment of said above de- scribed ordinance has heretofore been filed with the County Clerk of Lamar County, Texas, the County in which said City of Paris is situated. 3. That the City Council has caused the Department of Public Works to file estimates of the costs of such improvements and estimates of the amounts per front foot to be assessed against the property abutting said street and highway within the limits defined and the real and true owners thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. The date for public hearing before the City Council of the abutting property owners on the above described property is hereby fixed at 7:00 o'clock P. M. , in the City Council Room, City Hall, Paris, Texas, on the 14th day of June, 1976. That the City Clerk is hereby directed to publish in the Paris News, notice of the public hear - ing, three (3) times prior to said public hearing, the first of said notices to be published at least twenty-one (21) days prior to the date of the public hearing, as required by law. Section 2. That the report to the City Council by the Director of Public Works, consisting of the final estimate of costs of the im- provements to the abutting property owners of approximately $2. 70 per front foot for curb and gutter, and the final construction plans prepared by the Texas Highway Department and furnished to the Department of Public Works of the City of Paris, and final estimate, as prepared by said Director of Public Works, are in all things approved by the City Council of the City of Paris. That the City of Paris is to pay for intersections, in the amount of $4, 714. 58, and the abutting property owners are to pay the remaining costs of $41, 274. 34. Section 3. That it is the intention of the City Council to assess the abutting property owners and to fix a lien against the abutting property, as provided for and under the terms and provisions of Chapter 106 of the Acts of the First Called Session of the 40th Legislature of the State of Texas, now designated as Article 1105b, Vernon's Texas Civil Statutes, under which law these proceedings are taken and had.
