AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVID-
ING THAT THE CODE OF ORDINANCFS, CITY OF PARIS, PARIS, TExAS,
BE AMENDED BY REVISING THE TITLE OF SECTION 12-12 AND BY ADDING
SUBPARAGRA.PH (c) TO SFCTION 12-12, PROVIDING FOR THE ISSUANCE
OF PERMITS PERMITTING OPEN FLAME TORCHES WITHIN THE CORPORATE
LIMITS OF THE CITY OF PARIS; PROVIDING FOR A. PENALTY NOT TO
EXCEED $200.00; REPEALING ALL ORDINANCFS OR PARTS OF QRDINANCFS
IN CONFLr T HEREWITH; AND PROVIDING FOR A.N EFFECTIVE DATE OF
FEBRUARY 1, 1973.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section l. That the title to Section 12-12 of the Code
of Ordinances of the City of Paris, Paris, Texas, be amended
so thdt such shall read as follows:
"Section 12-12. Outside fires and open flame
torches."
Section 2. That the Code of Ordinances of the City of
Paris, Paris, Texas, be amended by adding Subparagraph (c) to
Section 12-12, to read as follows:
"Section 12-12. Outside fires and open flame
torches.
(c) It shall be unlawful for any person to in-
stall, erect or maintain any open flame torch on any
premises within the corporate limits of the City of
Paris unless a permit is obtained for the installa-
tion or erection of such torch. Before beginning in-
stallation or erection of any open flame torch in the
city, an applicant must submit a written request to
the office of the f ire marshal and include a plot plan
showing the location of torches and their proximity to
building, vegetation and other combustibles, driveways,
parking areas, streets and walkways. Cutaway drawings
of the device and the method of installation must also
be submitted. All torch devices proposed to be in-
stalled must bear the seal of approval of the
American Gas Association or other nationally recog-
nized safety testing laboratories. If, after due
consideration of the above items, a permit is issued,
the installation must be made under the following
conditions:
(1) No combustibles, including shrubbery, shall
be located within ten feet of the open flame.
(2) A regulated orifice shall be placed within
the supply line of each torch of such size
to prevent a flame of over 18 inches in
height above the burner outlet when the
valve is fully open.
(3) Gas shall be delivered to the device at a
pressure not greater than the pressure
normally provided for residential installa-
tions.
(4) The height of the bottom of the burner of
the torch shall be at least eight feet
above the adjacent ground level.
(5) Torches adjacent to streets, parking areas,
driveways, or walkways shall be curbed or
otherwise barricaded to prevent mechanical
damage.
(6) Torches shall not be located closer than
ten feet to any street parking area,
driveways or walkways.
(7) Torches shall not be installed closer than
ten feet to any building or combustible
material.
(8) Installations shall be made in keeping with
the regulations of the plumbing division of
the City of Paris."
Section 3. Any person violating any of the provisions
of this ordinance shall be guilty of a misdemeanor, and upon
conviction shall be fined in any sum not to exceed $200.00.
Section 4. All ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed.
Section 5. This ordinance shall become effective on
February 1, 1973.
