2006 ORD SETTING DATE, TIME AND PLACE FOR PUBLIC HEARING ON PORPOSED ANNEXATIO OF CERTAIN PROPERTY BY COPORDINANCE NO. 2006 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF PARIS, PARIS, TEXAS, AND AUTHORIZING AND DIR ECTING THE MAYOR TO PUBLISH NOTICE OF SUCH PUBLIC HEARING, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section l. That on the 8th day of March, 1971, at 7:00 o'clock P. M., in the City Council Room of the City Hall of the City of Paris, Paris, Texas, the City Council will hold a public hearing giving all interested persons the right to appear and be heard on the proposed annexation by the City of Paris, Paris, Texas, of the following described property: Situated in the County of Lamar and State of Texas, and described as follows: BEGINNING at the point of intersection of the South East Right of Way Lin e of FM Highway 195 with the North East City Limit Line, said line being 600 feet North from and parallel to the centerline of the existing traffic lane of Loop Highway No. 286 N. E., which is the outside traffic lane of the proposed four lane di- vided Loop Highway 286 N. E.; THENCE in a Northeasterly direction along the South Ea.st R. O. W. Line of said FM Highway 195 a distance of 6400 feet more or less to the point of intersection with the South West R.O.W. Line of a county road; THFINCE in a Southeasterly direction with said R. O. W. Line of said county road a distance of 240 feet, more or less; THENCE South along said R. O. W. Line a distance of 850 feet, more or less; THENCE East along the South R. O. W. Line of a county road a distance of 2900 feet, more or less, to a point in the East Boundary Line of property belonging to Grady Todd; THENC E South along said East Boundary Line a dis- tance of 2520 feet, more or less, to a point in the North Boundary Line of the D. Welch Headright Survey, Abstract No. 1013; THENC E East with said North Boundary Line of D. Welch Survey a distance of 2100 feet, more or less, to the Northeast Corner of D. Welch Survey; THENCE South along East Boundary Line of D. Welch Headright Survey, passing at 400 feet, more or less, to the S. E. Corner of said survey, same being the N. E. Corner of Enoch Crow Headxight Survey Abstract No. 208, and continuing South along East Boundary Line of said Enoch Crow Survey in all a distance of 3570 feet, more or less, to a point in the South Right of Way Line of a county road known as Pine Mill Road; THENCE in an Easterly direction along the South Right of Way of said county road a distance of 1750 feet, more or less, to the point of intersection with the West Right of Way Line of a county road known as the Old Mansfield Road; THENCE South along said West Right of Way Line, passing at 1845 feet, more or less, the centerline of U. S. Highway No. 82, and continuing South in all a distance of 5120 feet to a point in the centerline of the Texas & Pacific Railroad Right of Way; THENCE in a Southwesterly direction with said centerline of the Texas & Pacific Railroad Right of Way a distance of 4450 feet, more or less, to the Eastern City Limit Line of the City of Paris, Texas, said line being 600 feet Ea.st from and parallel to the centerline of the existing traffic lane of Loop Highway No. 286 N. E., which is the outside traffic lane of the proposed four lane divided Loop Highway No. 286 N. E.; THENC E with said North Ea,st City Limit Line in a Northerly and Westerly direction 7900 feet, more or less, to the South Boundary Line of the O. L. Rainey property; THENCE East 820 feet, more or less, to the South East Corner of said Rainey property; THENCE North 1983 feet, more or less, to the North East Corner of said Rainey property; THENC E West 1275 feet, more or less, to the North West Corner of said Rainey property; THENCE South 1450 feet, more or less, to a point, said point being 600 feet perpendicular -to the center- line of the existing traffic lane of Loop Highway No. 286 N. E., which is the outside traffic lane of the proposed four lane divided Loop Highway No. 286 N. E.; THENCE in a Northwesterly direction with said City Limit Line, which is 600 feet outside of and parallel to the existing traffic lane of Loop Highway No. 286 N. E. , which is the outside traffic lane of the pro- posed four lane divided Loop Highway No. 286 N. E., 4600 feet to the place of beginning. Section 2. That the Mayor of the City of Paris, Paris, Texas, is hereby authorized and directed to cause notice o.f such public hearing to be published once in the newspaper having general circulation in the City and in the above de- scribed territory not more than twenty (20) days nor less than ten (10) days prior to the date of such public hearing, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as Article 970a, Vernon's Texas Civil Statures). Section 3. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, para- graphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of compe- tent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the de- scription of the property to be annexed, which are not within said Ci-ty's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the valid judgment or decree of any couxt of com- petent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void.
