2010 ORD CONTAINING HEARING ON PROPERTIES LOCATEDIN COP BELONGING TO VARIOUS OWNERSORDINANCE NO. 2010 AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN THE CITY OF PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN ORDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAIN- ING IN THE PREMISES TO CONSTITUTE A NUISANCE AND TO BE A FIRE HAZARD TO LIFE AND PROPERTY AND A HI3ZARD TO THE LIFE AND WEL- FARE OF THE INHABITANTS OF THE AREA, AND ORDERING SAID RUBBISH, LUMBER AND REFUSE FROM THE HOUSES TO BE TORN DOWN AND REMOVED FROM THE PREMISES, IN ORDER TO ABATE SUCH NUISANCE. WHEREAS, a public hearing was, on the 8th day of March, 1971, called to order by the Mayor of the City of Paris, B. M. Felty, at 7:00 o'clock P. M., in the City Council Room, in the City of Paris, Texas; and, WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed a date for hearing on the resolu- tion referred to the Committee by the City Council on December 14, 1970, and said Committee fixed said hearing at 9:00 o'clock A. M., on the 19th day of February, 1971, and the hearing was had thereon. That proper notice was given to the owner or owners of the structures located at the followin g addresses: 145 llth Street, N. E. 766 lst Street, N. E. 774 lst Street, N. E. 522 Garrett Street 1225 15th Street, N. W. 1495 7th Street, N. W. 926 8th Street, S. E. 1213 9th Street, N. E. 227 4th Street, S. E. 229 4th Street, S. E. 237 4th Street, S. E. 954 2nd Street, N. E. 913 West Sherman Street That at said hearing the Committee listed the structures in- volved and introduced pictures of the various portions of the structures and various portions of the premises involved. That the Committee found that each of the above structures were in such state of deterioration and dilapidation as to create a serious fire hazard to life and property and that each of said buildings was dilapidated and was dangerous to life and property and dangerous structures to life and property. That said build- ings are in such a state of dilapidation and decay that none of said structures are capable of repair. It is further found that the condition of the premises and structures involved were such that the Committee recommended to the City Council that they be declared a nuisance and that the owners thereof be oxdered by the City Council to tear down and remove the same from the lots involved. That said Committee filed a complete report of its hearing and its findings with the City Clerk of the City of Paris on the 25th day of February, 1971; and, WHEREAS, the City Council further finds that proper no- tice was given to the owner or owners of the structures here- inafter listed. That at sai d hearing on the 19th day of February, 1971, the Committee listed the structures involved and introduced pictures of the various portions of the struc- tures and various portions of the premises involved. That the Committee found that each of the hereinafter listed structures was in such state of deterioration an d dilapidation as to create a serious fire hazard to life and property,and that each of said buildings was dilapidated and was dangerous to life and property and dangerous structures to life and proper- ty. That the owners of the property appeared before the Committee and requested time to repair the structures. That it was the recommendation of the Committee that the structures be condemned or repaired and that the respective owners there- of be given the time to abate said nuisance by repair or re- moval as is set out in connection with each of such addresses, as follows : 1387 7th Street, N. December 31, 1971 and it is so stated in the report of the Building Hazard Inspection Committee filed with the City Clerk of the City of Paris on the 25th day of February, 1971; and, WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed a date for hearing on the resolution referred to the Committee by the City Council on April 13, 1970, and that said Committee fixed said hearing at 9:00 o'clock A. M., on the 22nd day of May, 1970, and the hearing was had thereon. That at said hearing the followin g items were passed to the next meeting of the Buildin g Hazard Inspection Committee, which did meet on February 19, 1971: 848 72th Street, N. E. 1230 Hickozy Street (2 houses) and the structures were again found to be in a state of deteriora- tion and dilapidation as to create a serious fire hazard to life and property, and that each of said buildings was dilapidated axxd was dangerous to life and property and dangerous structures to life and property. It is further found that the condition of the premises and structures involved were such that the Committee recommended to the City Council that they be declared a nuisance and that the owners thereof be ordered by the City Council to tear down and remove the same from the lots involved, and it is so stated in the report of the Building Hazard Inspection Committee filed with the City Clerk of the City cf Paris on the 25th day of February, 1971; and, WHEFEAS, the City Council has fully heard and considered the testimony presented upon the hearing and a complete tran- script of the testimony reported by the Building Hazard Inspection Committee; NOW, THEREFORE, BE IT ORUAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the structures located at the following addresses: 145 llth Street, N. E. 766 lst Street, N. E. 774 lst Street, N. E. 522 Garrett Street 1225 15th Street, N. W. 1495 7th Street, N. W. 926 8th Street, S. E. 1213 9th Street, N. E. 227 4th Street, S. E. 229 4th Street, S. E. 237 4th Street, S. E. 954 2nd Street, N. E. 913 West Sherman Street 848 71-2th Street, N. E. 1230 Hickory Street (2 houses) are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, an d that the same con- stitute a fire hazard to life and property, and that the re- spective owners are hereby ordered to abate such nuisance within thirty (30) days from the date hereof. The City Clerk is di- rected to furnish the owners a copy of this ar dinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by injunction in the District Court of Lamar County, Texas, as provided for in Ordinance No. 1470. Section 2. That the structures hereinafter enumerated are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the re- spective owners are hereby ordered to abate such nuisances on or before the dates set out in connection with the addresses of each of such structures, as follows: 1387 7th Street, N. December 31, 1971 The City Clerk is directed to furnish the owners a copy of this ordi-ance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K. Haynes, is hereby di- rected to proceed to enforce this ordinance by injunction in the District Court of Lamar County, Texas, as provided in Ordinance No. 1470.
