Deliberate and act on a resolution approving Change Orders No. 2 and 3 to the contract with Bobby
Smallwood Construction Co. Inc., for the Clarksville Street Sidewalk Project; authorizing the City
Manager to negotiate and execute all necessary documents.
POLICY ISSUE(S):
Contract Change Order
BACKGROUND:
The Original bid amount was $237,006.62 and change order #1 was a deduction of $17,479.25. That
made the contract amount $219,527.37. Change order #2 will be a deduction of $407.99 and add seven
days to the construction time. The details to change order #2 are attached; the primary reason for the
change involved the Texas Department of Transportation (TxDOT) changes on a utility permit. Change
order # 3 will add $12,437.00 to the contract and add 14 additional days to the contract time. The new
contract amount would be $231,556.38. Change order #3 is needed because of an unforeseen condition
with an existing basement and a thin concrete sidewalk over it. The plan is to remove the existing
portion of sidewalk over the basement and replace it with thicker concrete and structural supports.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPROVING CHANGE ORDERS N0. TWO AND THREE TO THE CONTRACT
BETWEEN BOBBY SMALLWOOD CONSTRUCTION CO., INC. AND THE CITY
OF PARIS, TEXAS IN THE AMOUNT OF TWO HUNDRED THIRTY SEVEN
THOUSAND SIX DOLLARS AND 62/100 ($237,006.62) FOR CLARKSVILLE
STREET DOWNTOWN SIDEWALK PROJECT; MAKING OTHER FINDINGS
AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, on March 12 2012, the City Council of the City of Paris, Texas passed
Resolution No. 2012-024, awarding the contract for the Clarksville Street Downtown
Sidewalk Project to Bobby Smallwood Construction Co., Inc. of Paris, Texas in the amount of
Two Hundred Thirty Seven Thousand Six Dollars and 62/100 ($237,006.62); and,
WHEREAS, on March 26, 2012, the City Council approved Change Order No. One to
the contract for said project based on the actual materials to be used, and providing for a
net decrease amount of $17,479.25 in the contract price, for a revised contract price of
$219,527.37, the contract time was not increased. The date for completion of all work
was to be June 26, 2012; and,
WHEREAS, the City Engineer, Shawn Napier, acting as project engineer,
recommends that the City Council approve Change Orders No. two and three which will
amend the total contract cost to $231,556.38 and revise the completion date to August 13,
2012
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby
in all things approved.
Section 2. That Change Orders No. Two and Three to the Contract between Bobby
Smallwood Construction Co., Inc. and the City of Paris, Texas for the Clarksville Street
Downtown Sidewalk Project, attached hereto as Exhibits "A" and "B", providing for an
amended total contract price of $231,556.38, and a revised project completion date of
August 13, 2012, the same is hereby approved.
Section 3. That the City Manager be, and he is hereby, authorized and directed to
execute, on behalf of the City of Paris, Texas any necessary documents, upon the terms and
conditions in Exhibits "A" and "B", attached hereto.
Section 4. That this resolution shall be effective immediately upon passage.
