W. , 591 FEET WFST TO THE WFST BOUNDARY LINE OF LOT 7, BLOCK A, MEADOWVIEW ADDITION, OWNED BY HARRELL A. TIPPITT, AND THE WEST BOUNDARY LINE OF LOT 11, CITY BLOCK 309, OWNED BY R. A. WILLIAMS, FACH OF WHICH LIE IN THE F.AST BOUNDARY LINE OF LOT 15, CITY BLOCK 309, IN THE CITY OF PARIS, TF.XAS; DIRBCTIDG THE CITY CLERK OF THE CITY OF PARIS TO PUBLISH THE SAME THREE (3) TIMES IN THE PARIS NEWS AS REQUIRED BY LAW; APPROVING AND ACCEPTING THE FINAL ESTIMATE OF COSTS AND CONSTRUCTION PLANS OF SUCH STREET IMPROVEMFNTS AS FILED BY THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF PARIS; FIXING THE CHARGES TO BE ASSFSSED AGAINST THE ABUTTING PROPERTY OWNFRS AND THE CHARGES TO BE PAID BY THE CITY OF PARIS; AND WITH THE INTIINTION OF FIXING A CHARGE AND LI EN AGAINST THE REAL AND TRUE OWNEF2S OF SAI D PROPERTY AND AGAINST THE SAI D PROPERTY ITSII.F. Whereas, the City Council of the City of Paris, Paris, Texas, hereby finds and determines: l. That the City Council of the City of Paris, Paris, Texas, has heretofore by ordinance duly enacted on the 14th day of September, 1970, determined the ne- cessity for and ordered the improvement of Brown Avenue, from the West Bou.ndary Line of 19th Street, S. W., 591 feet West to the West Boundary Line of Lot 7, Block A, Meadowview Addition, owned by Harrell A. Tippitt, and the West Bourxi.ary Line of Lot 11, City Block 309, owned by R. A. Williams, each of which lie in the East Boundary Line of Lot 15, City Block 309, by installation of a six inch (611) soil cement base with a one and one-half inch (1211) asphalt surface, andaccording to the plans and specifications prepared by the Director of Public Works. 2. That a notice duly executed in the name of the City of Paris, Paris, Texas, of the enactment of said above described ordinance has heretofore been filed with the County Clerk of Lamar County, Texas, the County in which said City of Paris is situated. 3. That the City Council has caused the Director of Public Works to prepare and file estimates of the costs of such improvements and estimates of the amounts per front foot to be assessed against the property abutting said street within the limits defined and the real and true owners thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PAR I S, T FXAS : Section 1. The date for public hearing before the City Council of the abutting property owners on the above described property is hereby fixed at 7:00 o'clock P. M., in the City Council Room, City Hall, Paris, Texas, on the 14th day of June, 1971. That the City Clerk is hereby directed to publish in the Paris News, notice of the public hearing, three (3) times prior to said public hearing, the first of said notices to be pub- lished at least twenty-one (21) days prior to the date of the public hearing, as required by law. Section 2. That the report to the City Council by the Director of Public Works, consisting of the final estimate of costs of the improvements to the abutting property owners of approximately $2.53 per front foot for paving and approximately $2.30 per front foot for curb and gutter, plus any additional costs to extend driveways and other improvements to individual property as requested by property owners, as hg etofore approved, and the final construction plans and final estimate, as prepared by said Director of Public Works, are in all things approved by the City Council of the City of Paris. That the City of Paris is to pay one-third of the costs of paving and all drainage costs, in the amount of $2,125.55, and the abutting property owners are to pay the remaining costs of $6,523.00. Section 3. That it is the intention of the City Council to assess the abutting property owners and to fix a lien against the abutting property, as provided for and under the terms and provisions of Chapter 106 of the Acts of the First Called Session of the 40th Legislature of the State of Texas, now de- signated as Article 1105b, Vernon's Texas Civil Statutes, under which law these proceedings are taken and had.
