17-K - Curb & Gutter PolicyAGENDA INFORMATION SHEET PROJECT: A resolution approving a new policy regarding inspection and installation of private curb, gutter, and driveway culverts. BACKGROUND: The City of Paris has a policy dated January 8, 1999, regarding the inspection and installation of private property curb, gutter, and driveway culverts. Unfortunately, this policy gives some responsibility to the City of Paris for private property projects. Our engineering department has prepared the grade for concrete forms and sized culverts for driveway approaches. Additionally, our street department has made necessary street repairs and placed culverts on private property. The Public Works Department was asked to review this policy and submit the appropriate revisions. The revised policy diverts all aspects of these projects with exception of inspection to the property owners or contractors. Our engineering department will continue to inspect each project, checking for c ompliance. Any project that fails to comply with the current City of Paris standards will be denied. At that time, the engineering department will issue a request for changes to the property owner or contractor. DESCRIPTION: The attached resolution would authorize a new policy and place sole responsibility on the property owners or contractors instead of partial responsibility on the City of Paris. The City of Paris Public Works Department and Engineering Department have reviewed the new policy and have determined that the implementation of such policy is in the best interests of the citizens of the City of Paris and best serves the public health, safety, and welfare. COST: There will be no direct cost to the City of Paris, with exception of staff upkeep. RECOMMENDED ACTION: A pproval of the resolution authorizing a new policy regardin g inspection and installation of curb, gutter, and driveway culverts in the city of Paris. WHEREAS, the City of Paris has a prior policy dated January 8, 1999 regarding the City’s involvement in the inspection and installation of private curbs, gutters, and driveway culverts; and, WHEREAS, the Director of Public Works has reviewed the aforesaid existing policy and has determined that changes are necessary to reflect the City’s primary goal of inspecting said installations rather than being responsible for the actual engineering or design of same; and, WHEREAS, the City Council has reviewed the recommendations of the Director of Public Works and finds and determines implementation of a revised policy for the installation of curbs, gutters, and driveway culverts is in the best interests of the citizens of the City of Paris and best NOW, THEREFORE, serves the public health, safety, and welfare; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That a new policy governing the City’s involvement in the installation of curbs, gutters, and driveway culverts, a copy of which is attached hereto as Exhibit A and for all purposes incorporated herein, is hereby in all things approved and authorized. Section 3. That the Department of Public Works shall hereafter implement the aforesaid new policy regarding the installation of curbs, gutters, and driveway culverts, and the prior policy regarding same shall be and is hereby in all things rescinded. Schenk, City Attorney Policy Statement June 7, 2001 City of Paris Nothing stated in this policy shall be interpreted to supercede any requireme nts of the Subdivision Ordinance. I. Curb and Gutter A. Single Family Residence Should a resident desire to construct curb and gutter on their property, the following procedure shall apply. 1. The resident/owner shall contract with a bonded contractor and registered engineer to install the curb and gutter section in accordance with the City of Paris Standards. 2. The contractor must obtain a concrete permit from the City of Paris Engineering Department. 3. Once the contractor has prepared the appropriate grade and frame work for the curb and gutter section, the contractor shall contact the City of Paris Engineering Departme nt for its first site inspection/approval. 4. Following the approval of the s ite, the contractor has permission to complete the curb and gutter secti on in accordance with the City of Paris Standards. 5. The resident/owner is responsible for backfilling the yard side of the new curb with appropriate topsoil and maintain any settlement. 6. The resident/owner is respo nsible for making any street repairs associated to the project and to “tie” the new curb and gutter section into the street with similar material as removed. 7. Once the contractor has completed the section of curb and gutter, the contractor shall contact the City of Paris Engineering Department for the second and final site inspection/approval. 8. The resident/owner is responsible for all cost related to the project. EXHIBIT A 9. The City of Paris Public Works Department will maintain the street and curb and gutter in a manner consistent with city maintenance procedures once project is complete. II. Drive Culverts s t All drive culverts must be reinforced concrete pipe (RCP), class III, 1 quality or high density polyethylene pipe (HDPE). For drive culverts located on state maintained roads, safety end treatments will be required. A detail of safety end treatments is included herein. A. Single Family Residence Should a resident desire to construct a new drive where no curb and gutter exist, the following procedure shall apply. 1. The resident/owner shall contract with a bonded contractor and registered engineer to install the new drive culvert and new drive in accordance with the City of Paris Standards. 2. The contractor must obtain a permit from the City of Paris Engineering Department. 3. The resident/owner shall purchase the appropriate s ized culvert according to the City of Paris Standards and have it delivered to the project site. 4. If safety end treatment is required, the resident/owner will be resp onsible for its construction. Construction of safety end treatments must meet all state and local standards. 5. Once the contractor has installed the appropriate culvert, the contractor shall contact the City of Paris Engineering Department for the site inspection /approval. This inspection will take place prior to installing the drive surface from the edge of th e pavement to the street R.O.W. 6. Following appr oval of the site, the contractor has permission to complete the drive surface. 7. The resident/owner is responsible for all cost related to the project. 8. The City of Paris Public Works Department will maintain the culvert in a manner consistent with city maintenance procedures once project is complete. CURB AND GUTTER A. Single Family Residence Should a citizen desire to construct curb and gutter for their lot, the following procedure will apply. 1. Contact the City Engineer's office to make inquiry end start engineering investigation. 2. The City Engineer or his representative will contact property owner advise them whether project is feasible. 3. If the project is feasible, it will be the property owner's sole responsibility tO: a. Contract with a bonded concrete contractor to install the curb and gutter section in accordance with City of Paris standards. b. The concrete contractor must obtain a concrete permit from the City Engineer's office. c. The project owner is solely responsible for payments to the contractor and any other arrangements which may be entered into. d. Backfill yard side of new curb with dirt and maintain any settlement. 4. The City of P~ris will be responsible for and will pay for a. Any e~neefing studies to determine feasibility. b. Provide any construction grade stakes for the owners' contractor to use. c. Make any street repairs and "tie" new curb and gutter section into the street. Any other property owner requesting curb and gutter construction will be totally responsible for pr6viding a complete finished project, meeting the City of Paris standards. The property owner will be responsible for all costs. The city will conduct the engineering investigation to determine if new curb and gutter at the desired location are feasible, at no cost to the owner. The City of Paris will maintain the street and the curb and gutter in a manner conSistent with city maintenance procedures. DRIVE CULVERTS All drive culverts must be reinforced concrete pipe (RCP), class III, 1'~ quality. For drive culverts located on state maintained roads, safety end treatments will be requked. Contact the City Engineer's office to give precise location. The City Engineer will make an investigation to determine what size culvert is required and advise the owner of size and whether safety end treatments are required. 2. The owner will then order the required pipe and have it delivered to the project site. Call the City Engineer to advise that pipe is on site. The owner shall dearly mark on the ground the desired location of the drive culvert installation. Once the City Engineer is advised that the pipe is on site, he shall issue a work order to the Public Works department to install culvert. Public Work; will then schedule to install the culvert and perform ,ny ditch grading they may deem appropriate and install appropriate drive surface from the edge of pavement to the street tLO.W. However, if the owner plans to build a concrete drlve, the total cost of concrete work will be'the owners. The cry will not build concrete drive approaches. All cost, except concrete drives, associated with the installation of the culvert, ditch grading (if required) and drive approach will be borne by the City. 5. Safety End Tre. atments. If safety end treatments are required, the property owner will be- solely responsible for its construction. Construction of safety end treatments must meet any and all state and local standards. Failure to comply with conStruction standards may result in the drive culvert being removed. For.any other drive cul~/er~ request, the owner shall request the culvert as stated in Paragraph II.
