AN ORDINANCE AMENDING ORDINANCE NO. 1953, SFCTION 6, TO
PROVIDE FOR A FRANCHISE TAX OF $50.00 PER VEHIRI' UNGITHE E
OPERATION OF THE TAXICAB BUSINESS; SECTION 9, ES2UIRI
HOLDER OF THE FRANCHISE LIABILITY INSURANCE TO BE CONDITIONED
ON PAYMENT DIRBCTLY TO EVERY JUDGMFNT CREDITOR, RATHER 'rHAN
PAYING TO THE MAYOR OF THE CITY OF PARIS FOR THE BENEFIT OF
JUDGMENT CREDITORS, AND REQUIRING A COPY OF THE INSURANCE PO-
LICY, WITH AMENDMFNTS, TO BE MAINTAINED IN THE OFFICE OF THE
CITY CLERK OF THE CITY OF PARIS; AND SECTION 12, BY DELETING
AND REDESIGNATING SUB-PARAGRAPH (d) AS SUB-
SUB-PARAGRAPH (c)
PARAGRAPH (c REPEALING ALL ORDINANCFS OR PARTS OF ORDINANCES
IN CONFLICT HEFZEWITH; AND PROVIDING FOR AN F~FECTIVE DATE OF
JULy l, 1971.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS :
Section l. That Sections 6 and 9 of Ordirmce No. 1953
of the City of Paris, Paris, Texas, be amended so that such
shall read as follows:
"Section 6. The grantees shall, during the life
of this franchise, pay to the City of Paris at the
office of the City Clerk in laeTU Vehicle usedhinUtheed
States a sum equal to $50.00 p
operation of said taxicab business, which remittance
shall be made annually on or before the lOth day of
July each year. The payments stipulated and provided
in this section shall be in lieu of any other tax or
assessment or charge by the City of Paris which may
now or may hereafter be in force during the term of
this franchise, excluding only ad valorem taxes.
Any neglect, omission or refusal by the grantees
herein to pay such tax when due and as specified,
shall ipso facto work a forfeiture of this franchise
and of all rights hereunder."
"Section 9. At all times during the effective
period of this franchise grantees shall have procured
and kept in full force and effect policy or policies
of public liability insurance, covering each motor
vehicle to be operated and operated under this fran-
chise, conditioned that the holder of thefranchise
ment
shall well and truly pay directly to every jud9
cre.ditor who has been injured through the negligent
operation of any such motor vehicle by the grantees
or their employees, or whose property has been da-
maged, any amount or amounts of money that shall have
been awarded by final judgment of any court of com-
petent jurisdiction against such grantees on account
of any such injury or damage, not exceeding for bodily
injury or death to any one person the sum of Ten
Thousand Dollars ($10,000.00), or the sum of Z~venty
Thousand Dollars ($20,000.00) for all persons injured
in any one accident or occasion, anty damages
Five Thousand Dollars ($5,000 00) for proper
arising out of any one accident or occasion. Any such
policy of insurance shall further provide that each
such cause of action shall survive in case of death
of any injured or damaged person for the benefit of
the beneficiary of any such person, and shall, fur-
ther provide that such policy shall be subject to
successive recoveries during the time that the same
may continue in effect. Any such policy of insurance
shall be issued by an approved insurance company, au-
thorized to do business in the State of Texas, and a
copy of any such policy or amendments thereto shall
be delivered to the office of the City Clerk of the
City of Paris, Paris, Texas."
Section 2. That Section 12 of Ordinance No. 1953 of the
City of Paris, Paris, Texas, be amended by deleting the follow-
ing sub-paragraph and renumbering Sub-paragraph (d) to be Sub-
paragraph (c):
11(c) To prescribe the number of taxicabs to
be operated by grantees, applying thereto the
principles of public necessity and convenience;"
Section 3. Al1 ordinances or parts of ordinances 1n
conflict herewith are hereby repealed.
Section 4. This ordinance shall become eff ective on
July 1, 1971.
