2034 ORD PROVIDING EXTENSION OF CERTAIN BOUNDARY LIMITS OF COP AND ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 129.1 ACRESORDINANCE NO. 2034 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNFXATION OF CERTAIN TERRITORY CONSISTING OF 129.1 ACRFS, MORE OR LFSS, 4VHICH IS LFSS THAN TEN PER CENT (10%) OF THE TERRITORY INCLUDED WITHIN ITS PRESENT CITY LIMITS, WHICH SAID TERRITORY LIFS ADJACENT TO AND ADJOINS THE PRESENT BOUNDA.RY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS. WHIIZFAS, a public hearing before the City Council of the City of Paris, Paris, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described territory: Situated in the County of Lamar and State of Texas, and described as follows; BEGINNING at a point that is 600 feet South of the center line of the outside lane of Loop Highway 286, and is also 600 feet West of and parallel to the center line of F. M. Highway 1507. Said point being in the present city limit line as established by Ordinance No. 1816 dated February 3, 1967. THENCE in a Southeasterly direction and at 600 feet parallel to the center line of F. M. Highway 1507 to a point of intersection with an extension of a line being 600 feet East of and parallel to the center line of F. M. Highway 905; THENCE in a Northerly direction along said line, an extension thereof being 600 feet East of and parallel to the center line of F. M. Highway 905 to a point in the present city limit line, said point being 40 feet West of the most Eastern South East Corner of city limits as established by Ordinance No. 1816 dated February 3, 1967; THENC E West along existing city limit line a dis- tance of 640 feet to a concrete marker West where the boundary line of F. M. Highway 905 meets the South Boundary Line of Loop Highway 286; THENC E North 52° 34' West along the South Boundary Line of said Loop Highway a distance of 305.3 feet to a concrete marker; THENCE Southwest along the South Boundary Line of said Loop Highway 286 a distance of 1767.9 feet to a point; THENC E South 32° 56' West a distance of 150.5 feet to a point where the West Boundary Line of F. M. Highway 1507 meets the South Boundary Line of Loop Highway 286, said point beingin the present city limit line; THENCE South and East along the West Boundary Line of F. M. Highway 1507 and the present city limits to a point that is 600 feet parallel to the center line of Loop Highway 286 and is also the most Southern South East Corner of the city limits as established by Ordinance No. 1816 dated February 3, 1967; THENC E West along existing city limit line to the place of beginning. was held at Paris, Texas, on the lOth day of May, 1971, which date is not more than twenty nor less than ten days prior to the institution of annexation proceedings; and, WHEREAS, notice of such public hearin g was published in a newspaper having general circulation in the City of Paris, Texas, and in the above described territory, on the 25th d.a,y of April, 1971, which date is not more than twenty nor less than ten days prior to the date of such public hearing; and, WHEREAS, the total corporate area of the City of Paris, Paris, Texas, on the first day of January, 1971, was 11,597.5040 acres; and, WHER EAS, the population of the City of Paris, Paris, Texas, is in excess of 5,000 and less than 25,000 inhabitants; and, WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Paris, Paris, Texas; and, WHEREAS, the above described territory lies adjacent to and adjoins the City of Paris, Paris, Texas; and, WHEREAS, the above described territory contains 129.1 acres, more or less, which is less than ten per cent (10%) of the present acreage contained in the corporate limits of the City of Paris, Texas; NOW, THERE,F'ORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARISI PARIS, TFxAS: Section 1. The following described land and territory lying adjacent to and adjoining the City of Paris, Paris, Texas, is hereby added and annexed to the City of Paris, Paris, Texas, and said territory hereinafter described shall hereafter be in- cluded within the boundary limits of the City o.f Paris, Texas, and the present boundary limits of said city, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Paris, Texas, to-wit: Situated in the County of Lamar and State of Texas, and described as follows: BEGINNING at a point that is 600 feet South of the center line of the outside lane of Loop Highway 286, and is also 600 feet West of and parallel to the center line of F. M. Highway 1507. Said point being in the present city limit line as established by Ordinance No. 1816 dated February 3, 1967. THENC E in a Saa.theasterly direction and at 600 feet parallel to the center line of F. M. Highway 1507 to a point of intersection with an extension of a line being 600 feet East o.f and parallel to the center line of F. M. Hi ghway 905 ; THENLE in a Northerly direction along said line, an extension thereof being 600 feet East of and parallel to the center line of F. M. Highway 905 to a point in the present city limit line, said point being 40 feet West of the most Eastern South East Corner of city limits as established by Ordinance No. 1816 dated February 3, 1967; THENC E West along existing city limit line a dis- tance of 640 feet to a concrete marker West where the boundary line of F. Highway 1507 and the present city limits to a point that is 600 feet parallel to the center line of Loop Highway 286 and is also the most Southern South East Corner of the city limits as established by Ordinance No. 1816 dated February 3, 1967; THENC E West along existing city limit line to the place of beginning. Section 2. The above described territory and area so annexed shall be a part of the City of Paris, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Paris, Paris, Texas, and the in- habitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Paris, Paris, Texas. That the above property shall be annexed under the zoning classifica,tion of One-Family Dwelling District No. 2 (SF-2) as is provided for under Zoning Ordinance No. 1710 of the City of Paris, Paris, Texas. Section 3. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, para- graphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sen- tences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or in- valid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas de- scribed in the description of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the valid judgment or de- cree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, void.a,ble or void. Section 4. This ordinance shall be published and passed in the manner provided in Article II, Section 7, of the Charter of the City of Paris, Paris, Texas.
