ORDINANC E NO. 2062 . <br />AN ORDINANCE PROVIDING FOR PARTICIPATION IN THE TEXAS <br />MtTNICIPAL RETIREMENT SYSTF.M BY THE CITY OF PARIS, PARIS, TF.XAS. <br />WHEREAS, the Constitution of the State of Texas was <br />amended on November 7, 1944, by the addition of Section 51-f, <br />Article III, which authorized the Legislature to establish a <br />state-wide retirement and disability pension system for city <br />employees; and, <br />WHER EAS, Chapter 75, Acts 50th Legislature (1947) as <br />amended, established the Texas Municipal Retirement System, <br />and authorizes the governing body of each city or town to <br />elect, at its option, to have one or more of the city <br />departments participate in such System; and, <br />WHEREAS, the governing body of the City of Paris, Paris, <br />Texas, finds that it will be in the public interest for the <br />cityto have its employees, participate in the Texas Municipal <br />Retirement System as hereinafter provided; NOW, THEREFCR E, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />PAR I S , TFxAS : <br />Section l. That, on behalf of the City of Paris, Paris, <br />Texas, the City Council hereby exercises its option and elects <br />to have the city and all of the employees of all departments <br />now existing or hereafter established (excepting the .following <br />departments: City of Paris Fire Department) participate in the <br />Texas Municipal Retirement System as provided in Chapter 75, <br />Acts of the 50th Legislature, as amended (Article 6243h of <br />Vernon's Civil Statutes of Texas): and all of the benefits and <br />obligations of such System are hereby accepted as to such em- <br />ployees. <br />Section 2. The City Manager is hereby directed to notify <br />the Board of Trustees of the Texas Municipal Retirement System <br />that the City of Paris, Paris, Texas, has elected to partici- <br />pate and have the employees of the above departments partici- <br />pate in said System. <br />Section 3. Each person who becomes an employee of any <br />participating department on or after the effective date of par- <br />ticipation of such department shall become a member of the <br />Texas Municipal Retirement System as a condition of his employ- <br />ment. The City of Paris, Paris, Texas, may in the future re- <br />fuse to add new departments or new employees to such System, <br />but shall never discontinue as to any participants. <br />Section 4. In accordance with the provisions of the <br />statute, the deposits to be made to the Texas Municipal <br />Retirement System on account of current service of the em- <br />ployees of the several participating departments are hereby <br />fixed at the rate of five percent (5/lo) of the earnings of <br />each employee of said departments, and in determining the de- <br />posits to be made on account of such service the maximum <br />earnings of this city is Full Salary. <br />
