AN ORDINANCE PROVIDING FOR THE EXTENSION OF CFRTAIN
BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE
ANNEKATION OF CERTAIN TERRITORY CONSISTING OF 25.73 ACRFS,
MORE OR LFSS, WHICH IS LESS THAN TEN PER CIIVT (10976) OF THE
TERRITORY INCLUDED WITHIN ITS PRFSENT CITY LIMITS, WHICH
SAID TERRITORY LIES ADJACIIVT TO AND ADJOINS THE PRESENT
BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND
PROVIDING ZONING CLASSIFICATIONS FOR THE SAME.
WHEREAS, a public hearing before the City Council of the
City of Paris, Paris, Texas, where all interested persons were
provided with an opportunity to be heard on the proposed
annexation of the following described territory:
TRACT 1: Situated in the County of Lamar and State
of Texas, and described as follows:
BEGINNING at a point in the East Boundary Line of
the Stillhouse Road that is the present South West
Corner of a tract of land conveyed.Richard B. Swint and
wife, Susan Brown Swint, by Bessie Lee Haynes, et al,
by deed recorded Book 526, Page 880, Deed Records, Lamar
County, Texas; said point being in the present North
City Limit Line as established by Ordinance No. 1666,
dated April 13, 1964.
THENCE S 60° E with the South Boundary Line of said
Swint tract and the present city limit line to an ell
corner in said City Limit Line at 300 feet and con-
tinuing S 60° E with the Swint South Boundary Line to
his South East Corner, in all a distance of 1337 feet;
THENCE North a distance of 1357 feet with Swint's
East Boundary Line to his North East Corner;
THENCE N 890 40' W a distance of 672 feet to
Swint's North West Corner and the East Boundary Line of
Stillhouse Road;
THIIVCE N 55° W a distance of 80 feet across
Stillhouse Road to a point in the West Boundary Line of
said Road;
THENCE S 350 W with the West Boundary Line of
Stillhouse Road to a point in the present city limit
line as established by Ordinance No. 1666;
THENCE S 60° E along said present city limit line,
crossing Stillhouse Road, a distance of 80 feet to the
place of beginning and containing 24.95 acres.
TRACT 2: Situated in the County of Lamar and State
of Texas, and described as follows:
BEGINNING at a point in the East Boundary Line
of U. S. Highway 271 as established by Right-of-Way
Deed from Estelle Council, a widow, to State of
Texas, recorded Book 482, Page 268, Deed Records,
Lamar County, Texas, and being the South West Corner
of a tract of la,nd conveyed Nathan J. Bell, et al,
by Estelle Council, a widow, by deed dated
September 13, 1971. Said point being in the present
most Northerly City Limit Line as established by
City of Paris Ordinance No. 1569, passed
November 13, 1961;
THENC E in a Northerly direction with the East
Boundary Line of U. S. Highway 271 as follows:
N 310 15' W a distance of 74.2 feet;
N 4° W a distance of 115 feet to a stake for
corner;
THENC E S 85° E along the North Boundary Line
of said Bell tract a distance of 200 feet to a
point;
THEIVCE S 4° E a distance of 175 feet along the
East Boundary Line to the South East Corner of said
Bell tract, which point lies in the present City
Limit Line;
THENCE N 85° W along the present City Limit
Line and the North Boundary Line of Stone Avenue
a distance of 165 feet to the place of beginning
and containing 0.78 acres.
was held at Paris, Texas, on the llth day of October, 1971,
which date is not more than twenty nor less than ten days prior
to the institution of annexation proceedings; and,
WHEREAS, notice of such public hearing was published in
a newspaper having general circulation in the City of Paris,
Texas, and in the above described territory, on the 24th day
of September, 1971, which date is not more than twenty not less
than ten days prior to the date of such public hearing; and,
WHEREAS, the total corporate area of the City of Paris,
Paris, Texas, on the first day of January, 1971, was
11,597.5040 acres; and,
WHEREAS, the population of the City of Paris, Paris,
Texas, is in excess of 5,000 and less than 25,000 inhabitants;
and,
WHERFAS, the above described territory lies within the
extraterritorial jurisdiction of the City of Paris, Paris,
Texas; and,
WHER EAS, the above described territory lies adjacent to
and adjoins the City of Paris, Paris, Texas; and,
WHEREAS, the above described territory contains 24.95
acres in Tract 1 and 0.78 acres in Tract 2 for a total of 25.73
acres, more or less, which when added to other property annexed
in the year 1971 is less than ten per cent (10%) of the present
acreage contained in the corporate limits of the City of Paris,
Texas; and,
WHIIZEAS, the above described territory should be pro-
perly zoned as of the date of annexation; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS :
Section 1. The following described land and territory
lying adjacent to and adjoining the City of Paris, Paris, Texas,
is hereby added and annexed to the City of Paris, Par is, Texas,
and said territory hereinafter described shall hereafter be in-
cluded within the boundary limits of the City of Paris, Texas,
and the present boundary limits of said city, at the various
points contiguous to the area hereinafter described, are
altered and amended so as to include said area within the cor-
porate limits of the City of Paris, Texas, to-wit:
TRACT 1: Situated in the County of Lamar and State
of Texas, and described as follows:
BEGINNING at a point in the East Boundary Line of
the Stillhouse Road that is the present South West
Corner of a tract of land conveyed Richard B. Swint and
wife, Susan Brown Swint, by Bessie Lee Haynes, et al,
by deed recorded Book 526, Page 880, Deed Records, Lamar
County, Texas; said point being in the present North
City Limit Line as established by Ordinance No. 1666,
dated April 13, 1964.
THENCE S 60° E with the South Boundary Line of said
Swint tract and the present city limit line to an ell
corner in said City Limit Line at 300 feet and con-
tinuing S 60° E with the Swint South Baundary Line to
his South East Corner, in all a distance of 1337 feet;
THENCE North a distance of 1357 feet with Swint's
Ea,st Boundary Line to his North East Corner;
THENCE N 89° 40' W a distance of 672 feet to
Swint's North West Corner and the East Boundary Line of
Stillhouse Road;
THENCE N 550 W a distance of 80 feet across
Stillhouse Road to a point in the West Boundary Line of
said Road;
THENCE S 35° W with the West Boundary Line of
Stillhouse Road to a point in the present city limit
line as established by Ordinance No. 1666;
THENCE S 60° E along said present city limit line,
crossing Stillhouse Road, a distance of 80 feet to the
place of beginning and containing 24.95 acres.
TRACT 2: Situated in the County of Lamar and State
of Texas, and described as follows:
BEGINNING at a point in the East Boundary Line
of U. S. Highway 271 as established by Right-of-Way
Deed from Estelle Council, a widow, to State of
Texas, recorded Book 482, Page 268, Deed Records,
Lamar County, Texas, and being the South West Corner
of a tract of land conveyed Nathan J. Bell, et al,
by Estelle Council, a widow, by deed dated
September 13, 1971. Said point being in the present
most Northerly City Limit Line as established by
City of Paris Ordinance No. 15691 passed
November 13, 1961;
THENC E in a Northerly direction with the East
Boundary Line of U. S. Highway 271 as follows:
N 31° 15' W a distance of 74.2 feet;
N 40 W a distance of 115 feet to a stake for
corner ;
THFl\TCE S 850 E along the North Boundary Line
of said Bell tract a distance of 200 feet to a
point;
THENCE S 4° E a distance of 175 feet along the
East Boundary Line to the South East Corner of said
Bell tract, which point lies in the present City
Limit Line;
THENCE N 85° W along the present City Limit
Line and the North Boundary Line of Stone Avenue
a distance of 165 feet to the place of beginning
and containing 0.78 acres.
Section 2. The above described territory and area so
annexed shall be a part of the City of Paris, Texas, and the
property so added hereby shall bear its pro rata part of the
taxes levied by the City of Paris, Paris, Texas, and the in-
habitants thereof shall be entitled to all of the rights and
privileges of all the citizens and shall be bound by the acts,
ordinances, resolutions and regulations of the City of Paris,
Paris, Texas.
Section 3. The above described property is hereby annexed
under zoning classifications provided for in Zoning Ordinance
No. 1710 of the City of Paris, Paris, Texas, as follows:

Section 4. It is hereby declared to be the intention of
the City Council of the City of Paris that the sectio ns, para-
graphs, sentences, clauses and phrases of this ordinance are
severable, and if any phrase, clause, sentence, paragraph or
section of this ordinance shall be declared unconstitutional
or invalid by the valid judgment or decree of any court of com-
petent jurisdiction, such unconstitutionality or invalidity
shall not affect any of the remaining phrases, clauses, sen-
tences, paragraphs and sec tions of this ordinarce, since the
same would have been enacted by the City Council without the
incorporation in this ordinance of any unconstitutional or in-
valid phrases, clauses, sentences, paragraphs or sections. It
is further hereby declared to be the intention of the City
Council of the City of Paris to exclude any area or areas de-
scribed in the description of the property to be annexed,
which are not within said City's jurisdiction to annex and
that such area or areas should be carved out of the description
of the property herein described by the valid judgment or de-
cree of any court of competent jurisdiction, in order that such
area or areas would not cause this annexation ordinance to be
found to be invalid, voidable or void.
Section 5. This ordinance shall be published and passed
in the manner provided in Article II, Section 7, of the Charter
of the City of Paris, Paris, Texas.
