13 - Council Minutes (4/5/01)MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL APRIL 5, 2001 The City Council of the City of Paris met in regular session Thursday, April 5, 2001, 6:00 P. M., Paris Junior College, Applied Technology Building, Room 1016, 2400 Clarksville Street, Paris, Texas. Mayor Michael J. Pfiester called the meeting to order with the following Council Members present: Richard Manning, John F. Bell, Joe E. McCarthy, and Benny Plata. Also present were City Manager Michael E. Malone, City Attorney Larry W. Schenk, and City Clerk Mattie Cunningham. Invocation was given by Mayor Michael J. Pfiester. City Manager Malone presented the minutes of the Planning and Zoning Commission’s meeting held April 2, 2001, and attached hereto as Exhibit A to these minutes. Mayor Pf iester announced that there is an issue on the agenda that the Planning and Zoning Commission had denied and further explained th at there are not enough Council Members present to overturn a Planning and Zoning decision. City Attorney Schenk explained that the legal provision requires that if the Planning and Zoning Commission denies a rezoning request, or if there were a petition or a protest filed, it would take a three-quarters vote of the City Council to overturn the action of the Planning and Zoning Commission. City Attorney Schenk further explained that the rule requires a three-quarters vote of the Council Membe rs as a body unless they are disqualified by death or conflict of interest. City Attorney Schenk advised that there are two Council Members absent and that a three-quarter vote is not possible. City Attorney Schenk advised the City Council that they could undertake any part of the agenda other than the final vote on the matter. After discussion, a motion was made by Councilman Bell to move forward to Agenda Item No. 13, public hearing to consider the petition of Fred Eatherly for a change in zoning from a One-Family Dwelling District No. 2 (SF-2) to a Multiple-Family Dwelling District No. 1 (MF-1) on Lot 7, City Block 266, being located in the 1300 Block of F. M. 195, and Agenda Item No. 14, consideration of and action on an ordinance amending Z oning Ordinance No. 1710, changing the zoning from a One-Family Dwelling District No. 2 (SF-2) to a Multiple-Family Dwelling Distric t No. 1 (MF-1) on Lot 7, City Block 266. The Regular City Council Meeting April 5, 2001 Page 2 motion was seconded by Mayor Pro Tem Manning and carried 5 ayes, 0 nays. Mayor Pfiester declared the public hearing open on the petition of Fred Eatherly for a change in zoning from a One-Family Dwelling District No. 2 (SF- 2) to a Multiple-Family Dwelling District No. 1 (MF-1) on Lot 7, City Block 266, being located in the 1300 Block of F. M. 195. Mayor Pfiester called for proponents to appear, and Frank Bailey of Dallas, Texas, appeared before the City Council, advising them that he is the owner of the property and would like to modify the zoning after meeting with the Planning and Zoning Commission and because of the concerns the residents had. Mayor Pfiester advised that there were not enough Council Members present to vote on any type of modification, but at this time, the City Council is in the public hearing phase where anyone can come forward and speak in favor of the petition or against the petition. Mayor Pfiester stated that after the public hearing the City Council will discuss the outcome of the public hearing, and determine if th ey want to grant the zoning request that was applied for, change it to what they feel would appropriate, table it, or take some other action. Mr. Bailey said he grew up in Paris, Texas, in the two-story house next to the th driving range on 20 N. E. and inherited the property from his aunt. Mr. Bailey said they have been trying to come up with a use for his property. Mr. Bailey said some people have approached his rea ltor regarding low-income housing. Mr. Bailey said it was his goal to have something that he could be proud of. From a drawing, Mr. Bail e y pointed out where the property is located and advised that the property is in a flood area and a nything built there would have to be built on only a portion of the property. Mr. Bailey said he would like to get an idea of what they could get approved for this location and they are considering building houses in certain areas, with perhaps condos in the center, targeting people over 50 years old. Mr. Bailey reviewed with the City Council the two problems concerning his property, those being drainage and traffic and how these problems impact the development of his property. Mr. Bailey spoke of using a retention pond in the flood plain area. Mr. Bailey said that this could be a really nice area for Par is. Mr. Bailey asked the City Council to zone this p roperty as Planned Development instead of the Multiple- Regular City Council Meeting April 5, 2001 Page 3 Family Dwelling District No. 1. City Attorney Schenk again explained that Mr. B ailey was proposing a rezoning change. He said that even if Mr. Bailey proposes a Planned Devel opment rezoning change, that is a rezoning change, and there is a protest against any rezoning change to this property right now. Mr. Schenk stated that the Council mus t have a three-quarters vote of the qualified members of the City Council in order to approve the rezoning change, which would take six members in support of that. City Attorney Schenk said there are only five members present, but regardless, if Mr. Bailey wanted to make another proposal it will still be governed by the three-quarters vote. City Attorney Schenk said that, in his view, Mr. Bailey would have to go back before the Planning and Zoning Commission a nd start over with a new pr oposal. He said that the City Council is in a public hearing stage of this rezoning request and felt that the Council would have to complete that process, which involves giving Mr. Bailey the opportunity to speak to the issue and to hear any other individuals who are in favor of the rezoning change; then the public hearing will allow those in opposition to the rezoning a chance to speak. Mr. Bailey withdrew his rezoning petition and said he would resubmit a new petition for Planned Development. Mayor Pfiester announced that he would continue the public hearing if there were peop le in the audience who wished to speak regarding this rezoning change. Councilman Kevin Gray entered the council chambers and assumed his seat at the council table at 6:30 P. M. May or Pfiester announced that, with Council Member Gray’s arrival, there were now six members present and the Council could vo t e regarding the rezoning petition of Mr. Bailey if they chose to do so. Mayor Pfiester allowed Mr. Bailey to come forward and explain again what he wanted to do with his property for the benefit of Councilman Gray. th Mayor Pfiester called for opponents to appear, and Jerry Hollowell, 1340 20 Regular City Council Meeting April 5, 2001 Page 4 N.E., came forward telling the City Council that he had just purchased this property and explain ed that his reason for purchasing this home was because of the convenience and because his home was in a great neighborhood. Mr. Hollowell said that he had the privilege of walking door- to- door and meeting his neighbors and that all eighty-two homeowners that he talked to signed the petition that has been presented to the City Council. Mr. Hollowell said the objections that the homeowners have is the fast and heavy traffic on F. M. 195 th th (20 N. E.), a blind man’s curve in the 1300 Block of 20 N. E., noise level with additional apartment complexes and duplexes, and the fact that part of the property is in a flood zone, with the possibility of flooding a lot of the homes in the neighborhood. Mr. Holloway said they were not opposed to progress with good purpose or the r ight of Mr. Bailey to sell his property and if they were talk ing about single-family homes, they would not be in opposition to that zoning. Mr. Hollowell asked the City Council to vote against this rezoning change. Don Stuckey, 2350 Ballard, came forward telling the City Council that it is his feeling that there will be a drainage problem if they go to the lower end of this property, unless there is a lot of drainage work done. Mr. Stuckey said he was opposed to the building of apartments. nd John Grimbley, 1295 22 N. E., noted that his home is just around the corner from the property in question, and that he was opposed to the zoning change. Mr. Grimbley pointed out the drainage problem along with the traffic. Fran Tippit, 1820 Ballard, appeared before the City Council telling them that her house is adjacent to this property. Ms. Tippit said there is no guarantee what will be built on this property if the Multiple-Family Dwelling is allowed. She also stated that a turning lane is needed in or der to cut down on the traffic accidents as this is a very dangerous curve and adding more people is going to increase the traffic problem. nd Virginia Allen, 1240 22 N. E., came forward telling the City Council that she has lived at this location for six years. Ms. Allen said she is retired on disability, but she is younger than most of the residents, and she is constantly trying to get the drainage from off of the hill. Ms. Allen urged the City Council not to allow someone to develop something that will cause the residents more problems and stated that if the Council would come out and Regular City Council Meeting April 5, 2001 Page 5 look at their current drainage problems, they would understand why there is opposition to this rezoning. No one else appeared, and the public hearing was declared closed. Mayor Pfiester call ed for consideration of and action on an ordinance amending Zoning Ordinance No. 1710, changing the zoning from a One- Family Dwelling District No. 2 (SF-2) to a Multiple-Family Dwelling District No. 1 (MF-1) on Lot 7, City Block 266. A motion was made by Mayor Pro Tem Manning, seconded by Councilman McCarthy, to deny the rezoning change. The motion carried 6 ayes, 0 nays. Mayor Pfiester declared the publi c hearing open on the petition of Donald Lewis for a change in zoning from an Agricultural District (A) to a Commercial District (C) on Lots 6 & 7, City Block 322, being located in the 2000 Block of Spur 139. Mayor Pfiester called for proponents to appear, and Donald Lewis, Route 10 Box 7410, appeared in behalf of his petition. Mr. Lewis explained that this property that has been sold to Mark Buster for the Paris Farm Center along with another piece of land t hat he owns. Mr. Lewis stated that he is requesting the Commercial zoning for this property as it fronts on the Spur and the Loop and feels it is the logical use for the property and expressed his appreciation for the Council’s consideration. Mayor Pfiester called for opponents to appear, none appeared, and the public hearing was declared closed. ORDINANCE NO. 2001-016 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A COMMERCIAL DISTRICT (C) ON LOTS 6 AND 7, CITY BLOCK 322, ON PROPERTY BELONGING TO DONALD LEWIS, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A AGRICULTURAL DISTRICT (A); DESIGNATING THE BOUNDARIES OF THE COMMERCIAL DISTRICT (C) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL Regular City Council Meeting April 5, 2001 Page 6 OR D INANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE OF MAY 1, 2001, WAS PRESENTED. Mayor Pfiester declared the public hearing open on the petition o f Ray Spencer for a change in zoning from a One-Family Dwelling District No. 2 (SF- 2) to a Commercial District (C) on Lot 6, City Block 331, being located in the 3600 Block of Loop 286 N. W. Mayor Pfiester called for proponents to appear and Ray Spencer, Route 11, Paris, Texas, appeared before the City Council advising that he was speaking on behalf of the Paris Ch urch of God for the zoning of an Assisted Living Complex to be built on Lot 6, City Block 331, which is on the N. W. Loop. Mr. Spencer explained to the City Counci l that this is going to be a 40 unit complex with an estimated cost of 3.5 million dollars to build. He said the cost for a person living in the complex will be anywhere from $2,100.00 to $2,500.00. Mr. Spencer advised the City Council that they requested Commercial zoning, but if they cannot get the Commercial zoning, the Multi- Family Dwelling District will work for the m. They would accept that type zoning. Mr. Spencer explained that Paris has a great need for this type of operation. th Reverend O. D. Robinson, 230 46 S. W., came forward speaking in favor of the assisted living facilities, and asked for those in the audience who supported this operation to stand. Rita Mae Shook, 3520 W. Houston, was present speaking for the zoning change so that they can build a beautiful retirement home with assisted living for the senior citizens. Kelvin Black, 3545 West Houston, came forward also supporting the zoning change. Mr. Black stressed to the City Council that the property will only be used for the construction of an assisted living complex. th June Robinson, 230 46 S. W., appeared before the City Council sharing the vision of this project and how it came about. Ms. Robinson asked the City Regular City Council Meeting April 5, 2001 Page 7 Council to help them fulfill their vision. t h Mark Cunningh am, 3900 48 N. E., appeared before the City Council explaining that he and his dad own property adja cent to this property in question at 3605 N. W. Loop, and looking at it from a businessman’s point of view, he felt the development would increase the value of their property. Mr. Cunningham said the Loop is the best place to have commercial property and stated that he was in favor of the zoning change. Betty Hardy, Powderly, Texas, came forward telling the City Council that she is a member of the Paris Ch urch of God. Ms. Hardy said there are assisted living facilities on the north and east side of the city and it would be great to have one on the west side of the city. th Louis Bowerman, Sr., 261 26 S. E., appeared before the City Council stating that he is a member and trustee of t he Paris Church of God and considers himself a property owner in West Paris. Mr. Bowerman said he was in full support of the building of the assisted living facility by his church. t h Nick Hay nes, 1353 N. E. 20 Street, came forward advising that he was a member of the Paris Church of God Church along with being the Minister of Music. Mr. Haynes stated that he was in favor of this zoning change and that the City of Paris could use more progress. He said this facility would beautify the west side of Paris. Mr. Haynes stressed the need for this type facility. Mayor Pfiester called for opponents to appear, and Vergie McKinney, 3620 West Houston, appeared stating that what Mr. Spencer failed to tell the City Council was that they are going to borrow the money through HUD to build this complex. Ms. McKinney pointed out that there is a lake on this property and that your older citizens will be able to get around and this could cause a big problem because if one of the tenants got away, they could fall in the pool, get lost, or could be in the street. Ms. McKinney stated that she did not believe that the commercial zoning is the proper zoning for this property. th Deloria Redus, 320 S. W. 34 Street, appeared before the City Council advising that she has lived in West Paris about 48 years and she has always wanted things to come to West Paris. Ms. Redus said she did not have anything against assisted living, but she agrees with Ms. McKinney regarding Regular City Council Meeting April 5, 2001 Page 8 this complex. She felt that they did not have all the answers to questions, such as who is going to operate the facility, whether it has been okayed by HUD, and what would be put in its place if this project fell through. Ms. Redus did say that there is a need for assist ed living, but the city needs to find out more about this facility. Melissa Huie, 701 Parc Quest Drive, appeared before the City Council stating t hat she basically feels the same as Ms. Redus, but too many time she has heard promises about beautifying Paris and that the promises had simply fallen through. Ms. Huie said she feels that there should be specific stipulations on what is being presented tonight. Phillip Nance, 3610 Graham Street, appeared before the City Council in opposition to the commercial zoning because, if this falls through, someone can come in and put a car-wash, service station, or anything of that nature. Mr. Nance suggest using the Planned Development zoning for this property instead of Commercial zoning. Mr. Nance also pointed out the safety factor involved with this pro perty being on the Loop and building the structure between the pool and the Loop. No one else appeared, and the public hearing was declared closed by Mayor Pfiester. City Manager Malone a d vised that the Planning and Zoning Commission considered t his request for Commercial Zoning but recommended Planned Development (b), as there was opposition at their public hearing. City Attorney Schenk advised that this would fall under Section 8-301 of the Planning and Zoning Ordinance, Subsection (b) Planned Development, and this use is permitted. He said that the City Council, after a public hearing, proper notice, and after receiving the recommendation by the Planning and Zoning Commission could authorize the creation of a Planned Development District; a (b) District for housing development or Community Unit Development, and if that is approved, it would still be subject to the remaining pro visions of the ordinance that deal with Planned Development, including the requirement of a Comprehensive Site Plan, which would have to be filed and approved by the permitting section of the City of Paris. He said it would also have to come before the City Council again for approval of the site plan, Regular City Council Meeting April 5, 2001 Page 9 and that at that time, the City Council may impose conditions relative to the standard of development with regard to specifics of the Planned Development. After further discussion, Ray Spencer came forward advising that the people in West Virginia , who are going to build this project, will furnish everything that is needed, but they want assurance that the church has the right planning before they start the project. Mr. Spencer further advised they will meet all city requirements that will be needed and that if the church can get the right zoning, these people will do the balance of the work. City Attorney Schenk read the following requirements for a Planned Developme nt District: “The City Council shall require a comprehensive site plan of the development. Such site plan shall be approved and filed as part of the ordinance prior to the issuance of any Building Permit in a Planned Development District. E. Mayor Pfiester called for proponents to appear, and Tammie Green, General Regular City Council Meeting April 5, 2001 Page 11 Manager of Quality Homes, 300 N. E. Loop 286, appeared before the City Council advising that she was speaking as an agent for Calvin Gibson, owner of the property. Ms. Green said they have recently rezoned the property next to this property and placed a manufactured home it, and Mr. Gibson has been trying to sell this property for sometime and felt that with a ma nufactured home on the lot, it will sell. Ms. Green emphasized that this will enhance the neighborhood. Mayor Pfiester called for opponents to appear, none appeared, and the public hearing was declared closed. After disc ussion, a motion was made Councilman Bell, seconded by Councilman Gray, for adoption of the ordinance with the stipulation o f the placement of a double wide m anufactured home on the lot. The motion carried 6 ayes, 0 nays. Mayor Pfiester declared the public hearing open to consider the petition of George Fisher for a change in zoning from a One-Family Dwelling District No. 2 (SF-2) to a General Retail District (GR) on Lots 7 and 8, Block 7, Springlake Addition; Lots 8, 9, 10, 11, and 12, Block 8, Springlake Addition; and Lots 6, Regular City Council Meeting April 5, 2001 Page 12 7, 11, 11A, and 12, City Block 257-D, all being located in the 200 Block of N. Collegiate Drive. Mayor Pfiester called for proponents to appear, and George Fisher, Route 13, Box 174, came forwarding telling the City Council that this property is located on Collegiate Street and that he has talked to Eric Clifford, property owner to the north, and that he had a letter from him stating that he has no problem with the zoning change. Mr. Fisher said that he talked with Ray Spencer, the property owner to the southwest, along with David a nd Eddie Thomas, property owners to the west, and tha t they did not have a problem with the zoning change. Mr. Fisher said that his plan is to build for lease a retail strip center. He also stated that he would install privacy fencing. Ray Spencer came forward in support of the zoning change. No one else appeared, and the public hearing was declared closed. Resolution No. 2001-036, resolving that the City of Paris, Paris, Texas, hereby request federal Non-Primary Entitlement funds from the Texas Department of Transportation for improvements to Cox Field Airport as follows: ( 1 ) install Regular City Council Meeting April 5, 2001 Page 13 new water lines throughout the airport terminal and hangar area; (2) provide drainage and dirt work in preparation for the building of new T-hangars to be rented to the flying public; and (3) install taxi lanes around the new T-hangars to be built and rented to the flying public, was presented. A motion was made by Mayor Pro Tem Manning, seconded by Councilman McCarthy, for approval of the resolution. The motion carried 6 ayes, 0 nays. Resolution No. 2001-037, resolving that Addendum No. Two, to the existing Original Contract and Addendum No. One, for Emergency Removal of Storm Debris from the City of Paris between the City of Paris and Storm Reconstruction Services, Inc., is hereby approved, and the Mayor is hereby authorized to execute and the City Clerk to attest to said addendum, was presented. A motion was made by Councilman Bell, seconded by Mayor Pro Tem Manning, for approval of the resolution. The motion carried 6 ayes, 0 nays. City Attorney Schenk presented the following petitions for rezoning: Calvin Gibson, Lots 19 & 20, City Block 160, from a Two-Family Dwelling District to a One-Family Dwelling District No. 3; Leroy Cla r kson, Lot 7, City Block 189, from a Two-Family Dwelling District to a Commercial District; Kenneth Scott Baxley, Lot 2, City Block 342, from Agricu ltural District to a Commercial District. Mayor Pfiester referred the petitions to the Planning and Zoning Commission for their study and recommendation at their m eeting scheduled for May 7, 2001, and before the City Council May 10, 2001.
