AN ORDINANCE FIXING THE DATE FOR A PUBLIC HEARING ON PRO-
PERTY ON SIMPSON STREET, FROM ITS INTERSECTION WITH THE EAST
BOUNDARY LINE OF 25TH STREET, S. E., EAST APPROXIMATELY 342

DIRDCTING THE CITY CLERK OF THE CITY OF PARIS TO PUBLISH THE
SAME THREE (3) TINIES IN THE PARIS NEWS AS REQUIRED BY LAW;
APPROVING AND ACCEPTING THE FINAL ESTIMATE OF COSTS AND CON-
STRUCTION PLANS OF SUCH STR EET IMPROVEMENTS AS FILED BY THE
DIRBCTOR OF PUBLIC WORKS OF THE CITY OF PARIS; FIXING THE
CHARGFS TO BE ASSESSED AGAINST THE ABUTTING PROPERTY 04JNERS
AND WITH THE
AND THE CHARGFS TO BE PAID BY TH E CITY OF PARIS;
INTENTION OF FIXING A CHARGE AND LIEN AGAINST THE RFAL AND TRUE
OWNERS OF SAID PROPERTY FiND AGAINST THE SAID PROPERTY ITSELF.
WHEREAS, the City Council of the City of Paris, Paris,
Texas, hereby finds and determines :
l. That the City Council of the City of Paris, Paris,
Texas, has heretofore by ordinance duly enacted on
the 9th day of June, 1969, determined the necessity
for and ordered the improvement of Simpson Street,
from its intersection with the Ea.st Boundary Line
of 25th Street, S. E., East approximately 342 feet
to the East Boundary Line of Lot 26, Block 5 on the
North and on the South to the Ea.st Boundary Line of
Lot 1, Block 8, both in the Brookside Addition, by
installation of a six inch (611) soil cement base
with a one and one-half inch (1211) asphalt surface,
and according to the plans and specifications pre-
pared by the Director of Public Works.
2. That a notice duly executed in the name of the City
of Paris, Paris, Texas, of the enactment of said
above described ordinance has heretofore been filed
with the County Clerk of Lamar County, Texas, the
County in which said City of Paris is situated.
3. That the City Council has caused the Director of
Public Works to prepare and file estimates of the
costs of such improvements and estimates of the
amounts per front foot to be assessed against the
property abutting said street within the limits
defined and the real and true owners thereof.
BE IT ORDAINED BY TH E CITY COUNCIL OF THE CITY OF PARIS:
Section 1. The date for public hearing before the City
Council of the abutting property owners on the above described
property is hereby fixed at 7:00 o'clock P. M'e ty
Council Room, City Hall, Paris, Texas, on the 12th day of
January, 1970. That the City Clerk is hereby directed to pub-
lish in the Paris News, notice of the public hearing, three (3)
times prior to said public hearing, the first of said notices to
be published at least twenty-one (21) days prior to the date of
the public hearing, as required by law.
Section 2. That the report to the City Council by the
Director of Public Works, consisting of the final estimate of
costs of the improvements to the abutting property owners of
approximately $1.99 per front foot for paving and approximately
$1.69 per front foot for curb and gutter, as heretofore approved,
and the final construction plans and final estimate, as prepared
by said Director of Public Works, are in all things approved by
the City Council of the City of Paris. That the City of Paris is
to pay one-third of the costs of paving, in the amount of
$693.14, and the abutting property owners are to pay the remain-
ing costs of $1,855.14.
Section 3. That it is the intention of the City Council
to assess the abutting property owners and to fix a lien against
the abutting property, as provided for and under the terms and
provisions of Chapter 106 of the Acts of the First Called
Session of the 40th Legislature of the State of Texas, now de-
signated as Article 1105b, Vernon's Texas Civil Statutes, under
which law these proceedings are taken and had.
Passed and adopted by the City Council of the City of
Paris, in regular session convened, on this the 8th day of
December, 1969.
