AN ORDINANCE FIXING THE DATE FOR A PUBLIC HEARING ON PRO-
PERTY ON F11ST CHERRY STREET, FROM THE WEST BOUNDARY LINE OF
LOT 6, CITY BLOCK 227-A, AND THE WEST BOUNDARY LINE OF LOT 6,
CITY BLOCK 227, IN AN EASTERLY DIRDCTION APPROXIMATELY 581
FEET TO THE WEST BOUNDARY LINE OF 20TH STREET, N. E., BEING
THE EAST BOUNDARY LINE OF LOT 5, CITY BLOCK 227-D, AND THE
EAST BOUNDARY LINE OF LOT 10, CITY BLOCK 227-E, IN THE CITY
OF PARIS, TExAS; DIRDCTING THE CITY CLERK OF THE CITY OF
PARIS TO PUBLISH THE SAME THR EE (3) TIMES IN THE PARIS NEWS
AS R EQUIRED BY LAW; APPROVING AND ACCEPTING THE FINAL ESTI-
MATE,OF COSTS AND CONSTRUCTION PLANS OF SUCH STREET IMPROVE-
MENTS AS FILED BY THE DIRECTOR OF PUBLIC WORKS OF THE CITY
OF PARIS; FIXING THE CHARGFS TO BE ASSFSSED AGAINST THE
ABUTTING PROPERTY OWNERS AND THE CHARGES TO BE PAID BY THE
CITY OF PARIS; AND WITH THE INTENTION OF FIXING A CHARGE
AND LIFN AGAINST THE REAL AND TRUE OWNERS OF SAID PROPERTY
AND AGAINST THE SAID PROPERTY ITSELF.
WHEREAS, the City Council of the City of Paris, Paris,
Texas, hereby finds and determines:
1. That the City Council of the City o.f Paris, Paris,
Texas, has heretofore by ordinance duly enacted on
the 14th day of September, 1970, determined the
necessity for and ordered the improvement of Ea,st
Cherry Street, .from the West Boundary Line of
Lot 6, City Block 227-A, and the West Boundary Line
of Lot 6, City Block 227, in an Ea,sterly direction
approximately 581 feet to the West Boundary Line of
20th Street, N. E., being the East Boundary Line of
Lot 5, City Block 227-D, and the East Boundary Line
of Lot 10, City Block 227-14 by installation of
curb and gutter, storm sewer and paving, and accord-
ing to the plans and specifications prepared by the
Director of Public Works.
2. That a notice duly executed in the name of the City
of Paris, Paris, Texas, of the enactment of said
above described ordinance has heretof ore been filed
with the County Clerk of Lamar County, Texas, the
County in which said City of Paris is situated.
3. That the City Council has caused the Director of
Public Works to prepare and file estimates of the
costs of such improvements and estimates of the
amounts per front foot to be assessed against the
property abutting said street within the limits

to be published at least twenty-one (21) days prior to the
date of the public hearing, as required by law.
Section 2. That the report to the City Council by the
Director of Public Works, consisting of the final estimate
of costs of the improvements to the abutting property owners
of approximately $2.18 per front foot for curb and gutter,
plus any additional costs to extend driveways and other im-
provements to individual property as requested by property
owners, as heretofore approved, and the final construction
plans and final estimate, as prepared by said Director of
Public Works, are in all things approved by the City Council
of the City of Paris. That the City of Paris is to pay
all drainage costs, in the amount of $1,203.06, and the
abutting property owners are to pay the remaining costs of
$1,903.37.
Section 3. That it is the intention of the City Council
to assess the abutting property owners and to fix a lien against
the abutting property, as provided for and under the terms and
provisions of Chapter 106 of the Acts of the First Called
Session of the 40th Legislature of the State of Texas, now de-
signated as Article 1105b, Vernon's Texas Civil Statutes, under
which law these proceedings are taken and had.
Passed and adopted by the City Council of the City of
Paris, in regular session convened, on this the 14th day of
December, 1970.
