The City of Paris was awarded a$200,000.00 EPA Brownfield Grant to clean up the Grand Theater.
The City's match for the grant was $40,000.00, for a total project budget of $240,000.00.
The City of Paris contracted with Terracon to determine what hazardous materials and waste are on site
and to developed plans and specifications for removal of the waste. The next step is for Terracon to
provide oversight of NCM Demolition and Remediation, LP to do the Phase II removal of the hazardous
materials and waste in accordance with applicable state and federal regulations.
The costs are as follows: Architectural Inventory by Denney Architects $6,185.00 (not to exceed
$15,000.00), administrative fees by Municipal Development Services $10,000.00, Environmental
services by Terracon $40,575.00 (contract amount $66,480.00) and 911 Restoration $71,777.00. The
remaining fund balance is just over $63,000.00.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AWARDING A CONTRACT TO NCM DEMOLITION AND REMEDIATION, LP,
CORPORATION FOR THE GRAND THEATER HAZARDOUS MATERIALS
REMEDIATION PHASE II PROJECT; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, the City of Paris contracted with Terracon to determine what hazardous
materials and waste are on site and developed plans and specifications for removal of the
waste. The next step is for Terracon to provide oversight of NCM Demolition and
Remediation, LP., to for Phase II removal of the hazardous materials and waste in
accordance with applicable state and federal regulations ; and,
WHEREAS, the lowest responsible bid providing the best value to the City was
received from NCM Demolition and Remediation, LP; and,
WHEREAS, the contract should be awarded to NCM Demolition and Remediation, LP
in accordance with the unit prices bid and the other terms and conditions set out in the
Terracon bid and the Request For Bid and Master Specifications for the Grand Theater
Hazardous Materials Remediation Phase II Project, attached hereto as Exhibit "A"; and,
WHEREAS, the City Manager should be authorized to execute the necessary
documents on behalf of the City of Paris, in the form attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby in
all things approved.
Section 2. That the bid of NCM Demolition and Remediation, LP, for the Grand
Theater Hazardous Materials Remediation Phase II Project in the City of Paris is hereby
accepted as the lowest responsible bid which provides the best value to the City and the
contract for this project is hereby let conditioned upon said contractor meeting all of the
terms and specifications included in the Agreement, Bid Documents and Project
Specifications for the Grand Theater Hazardous Materials Remediation Phase II Project
attached hereto as Exhibit "A" and timely execution of a written contract with the City of
Paris.
Section 3. That the City Manager of the City of Paris, be, and he is hereby authorized
and directed to execute on behalf of the City of Paris the Grand Theater Hazardous
Materials Remediation Phase II Project for the work referenced herein in substantially the
form attached hereto as Exhibit "A".

THIS AGREEMENT is entered into by and between the City of Paris, Texas, a home rule
municipal corporation, hereinafter called "CITY," and NCM Demolition and Remediation, LP
with main offices located at 9090 N. Stemmons, Suite C, Dallas, Texas 75247; hereinafter called
"CONTRACTOR", effective as of June 25, 2012.
1.01 CITY employs CONTRACTOR to perform and CONTRACTOR agrees to perform
Hazardous Clean-up Remediation (the "Work") in accordance with this Agreement, Bid
Documents, scope of work and project specifications (including all addendum to the bid
documents) for Grand Theater Remediation Phase II attached hereto and incorporated
herein as Exhibit "A", and CONTRACTOR's Bid attached hereto and incorporated
herein as Exhibit "B" (hereinafter collectively referred to as the `Bid Documents".)
1.02 CONTRACTOR shall complete Work assigned under this Agreement within fourteen
(14) calendar days following City's Notice to Proceed. Additional time to complete the
Wark will be allowed by the CITY only in the instance of weather delays which make
performance impractical, as determined exclusively by and approved by the CITY.
Weather delays will be considered by the CITY only if requested immediately by the
CONTRACTOR.
1.03 CONTRACTOR Agrees to furnish all labor, materials and equipment necessary to
complete the Hazardous Materials Remediation Phase II Project at the Grand Theater,
Paris, Texas for a total cost of FORTY SEVEN THOUSAND FIVE HUNDRED
THIRTY NINE DOLLARS AND 65/100, ($47,539.65). CONTRACTOR must submit
invoices to CITY within thirty (30) days of completion of the Work. No additional
charges will be permitted unless approved in advance in writing by CITY as a change
order. No extra charges will be permitted for weather delays. CONTRACTOR will be
paid within thirty (30) days of receipt of invoice by CITY for Work completed in
conformance with this Agreement, the Bid Documents, and City Work Orders. Nothing
herein shall require CITY to expend more funds than that amount approved by the City
Council.
1.04 CONTRACTOR covenants and agrees that CONTRACTOR is an independent contractor
and not an officer, agent, servant, or employee of CITY; that CONTRACTOR shall have
exclusive control of and exclusive right to control the details of the Work performed
hereunder and all persons performing same, and shall be responsible for the acts and
omissions of its officers, agents, employees, contractors, subcontractors and consultants;
that the doctrine of respondeat superior shall not apply as between CITY and
CONTRACTOR, its officers, agents, employees, contractors, subcontractors, and
consultants, and nothing herein shall be construed as creating a partnership or joint
enterprise between CITY and CONTRACTOR.
1.05 CONTRACTOR shall be responsible for the safety of operations and shall provide
appropriate safety warnings for the protection of the work area. Provision of safety
includes use of appropriate barricades, traffic control, control of the use of equipment
near traffic or pedestrians, and provision of other controls and warnings as needed.
1.06 CITY shall not be liable to CONTRACTOR, CONTRACTOR's agents, servants,
employees, patrons, customers, visitors, guests, or invitees, nor any pedestrian or
bystander for any damage or injury caused by the acts or negligence of CONTRACTOR,
CONTRACTOR's officers, employees, agents, or servants, or resulting from the
operation of any device or equipment located upon the contracted property, or any
appurtenance thereof, nor for any damage or injury from any defect or want of repair of
any structure or device on the contracted property.
1.07 CONTRACTOR agrees to defend, indemnify, save, and hold the CITY, its elected
officials, officers, and employees and agents harmless from any and all demands, debts,
liabilities, suits, claims, and causes of action of every kind on account of injury or
damage to any person or property, arising from or connected with the services and
contractual duties provided by the CONTRACTOR hereunder.
1.08 CONTRACTOR must, at all times during the term of this Agreement, keep and maintain
in full force and effect a policy or policies of insurance, providing at least $500,000.00
per occurrence and $1,000,000.00 aggregate for bodily injury or death and $500,000.00
for any single occurrence for injury to or destruction of property, indemnifying all
persons for any and all damages, personal injuries, or property damages sustained as the
result of the negligence of CONTRACTOR, its agents, servants, or employees, and shall
pay all premiums due thereon when due.
1.09 It is expressly provided that all insurance policies required hereunder shall and must be
written by a reputable insurance company or companies licensed and authorized to write
insurance policies by the State of Texas, and where appropriate must show the CITY, its
elected officials, officers, and employees as an additional insured, subject to approval by
the City Attorney of the City of Paris; and the CONTRACTOR's insurance carrier or
carriers shall deliver a copy of any such policies to the City Clerk of the City of Paris, or
furnish to said City Clerk a current letter or certificate from such company or companies,
evidencing the fact that such insurance is in full force and shall remain in effect at all
times during this contract period. All such policies shall be written so that CITY will be
notified of cancellation or of any restrictive amendment of the policies at least thirty (30)
days prior to the effective date of such cancellation or amendment. Notice shall be made
to the CITY by certified mail, return receipt requested, addressed to the City of Paris at
the following address: City Clerk, City of Paris, P.O. Box 9037, Paris, Texas
75461-9037.
1.10 CONTRACTOR shall timely perform and complete the Work herein in accordance with
this Agreement and the Bid Documents attached. In the event CONTRACTOR shall
default in any covenant, condition, provision, or stipulation herein contained, CITY will
notify CONTRACTOR verbally or, at its discretion, in writing, that a default has
occurred. Notice when given shall include a description of the default and the time within
which CONTRACTOR must correct or remedy the default. CONTRACTOR remains
solely responsible to complete the work as contracted, whether notified of a default by
CITY or not, and failure of CITY to notify of such default shall not excuse
CONTRACTOR's obligations hereunder.
111 CITY will not be responsible for CONTRACTOR's faulty work or additional work
required by CONTRACTOR's errors or omissions or mechanical breakdown of
CONTRACTOR's equipment. The buildings are presumed to be vacant, but it shall be
CONTRACTOR's responsibilitv to inspect the structures for inhabitants before
commencing with Remediation. The properties are also subject to illegal dumping and
other misuse, and it is expressly the CONTRACTOR's obligation to use caution while
performing the work at all times.
112 CITY may terminate this Agreement for cause or at its convenience at any time during
the period of performance. If termination is for cause, CONTRACTOR shall immediately
cease further services and shall be compensated only for that work completed up to the
date of termination and completed in full conformance with this Agreement including the
Bid Documents attached. If terminarion is for the CITY's convenience, CONTRACTOR
shall be compensated for that work completed or partially completed up to the date of
termination and performed in full conformance with this Agreement and the Bid
Documents attached; CONTRACTOR shall also be compensated for any additional
charges reasonably incurred by CONTRACTOR in preparation for the performance of
any further services required by this Agreement, said additional charges to be determined
by the CITY. Other than as stated herein, CONTRACTOR shall have no other claim or
recourse against the CITY for termination of the Agreement.
1.13 This Agreement may not be subcontracted, in whole or in part, without the CITY's
express written approval in advance of the services.
1.14 CONTRACTOR shall not discriminate against any employee because of race, color,
religion, sex, national origin, age, or disability.
1.15 The provisions of this Agreement are severable, and if any provision or part of this
Agreement or the application thereof to any person or circumstance shall ever be held by
any court of competent jurisdiction to be invalid or unconstitutional for any reason, the
remainder of this Agreement shall not be affected thereby.
1.16 This Agreement embodies the entire understanding between the parties and there are no
prior effective representations, warranties, or agreements, written or oral, between the
parties.
1.17 This Agreement shall be subject to all present and future valid laws of the United States,
State of Texas, and Ordinances of the City of Paris, Texas.
1.18 All services to be performed hereunder shall be and are to be rendered exclusively in
Lamar County, Texas. Venue for any State Court cause of action arising out of or in any
way related to this contract shall lie exclusively in the courts of Lamar County, Texas,
and venue for any Federal Court cause of action shall lie exclusively in the U.S. District
Court for the Eastern District of Texas, Tyler Division.
1.19 By executing this Agreement, the CONTRACTOR hereby certifies that the only person
or persons interested in this Agreement as principals are named herein, and the
CONTRACTOR during the bid process or otherwise has not, either directly or indirectly,
entered into any agreement, participated in any collusion, or otherwise taken any action
in restraint of free competitive bidding in connection with the services contracted herein.
Collusion in the bid process will constitute a substantial breach of the contract and justify
termination of the Agreement by the CITY for cause.
Executed in duplicates, each of which is deemed to be an original and effective as of the day and
date first written in this Agreement.
This Agreement will be effective on June 25, 2012.

Project Overview
This project consists of the remediation of hazardous materials at the Grand Theater including
asbestos containing materials (ACM), lead based paint (LBP), building materials which exhibited
fungal contamination and pigeon-related debris (PRD). The site specific asbestos abatement
design, lead abatement work plan, and fungal-biological hazard remediation protocol, are
provided in separate sections within this document. In building work areas where asbestos
abatement, lead abatement and fungal-biological hazard remediation overlap, the more
stringent remedial work practice, based on state and federal regulations, will take precedent.
It is important to note that the building has historical significance and it is the Owner's intent to
preserve the identified original components of historical value throughout the remediation
project.
The work areas that comprise Phase II are demarcated on Figure G-1 presented within the
individual scope of work for each hazardous material.
The contractor will perform the hazardous materials remediation in a sequence that ensures
compliance with applicable state and federal asbestos, lead and fungal regulations. The defined
sequencing will avoid combining regulated waste generated as part of the remediation. The
contractor will provided a detailed schedule of the remediation sequence which will include at a
minimum containment and non-containment areas, regulated areas, order in which identified
hazardous materials will be remediated, waste packaging and disposal to ensure regulatory
compliance with applicable state and federal regulations.
The Contractor selected to perform the remediation work will demonstrate experience
performing abatement of each of the hazardous materials identified. Prior to beginning work at
the site the Contractor will attend a preconstruction meeting to coordinate all site activities with
the Owner and their designated representative. In addition prior to beginning any remediation
activities the contractor will conduct an orientation meeting with their personnel. The purpose of
the meeting will be to inform each employee of the historical significance of the structure and
the specific procedures to be followed in protecting the finishes and fixtures that are in each
work area, as well as a safety review regarding the project and the hazardous materials to be
remediated.

a) CONTRACTOR will be responsible for site security throughout the remediation
project.
b) Due to the deterioration of interior building materials the work area will require
extensive precleaning prior to beginning remediation activities. The precleaning
may consist of the clean-up of asbestos, lead and fungal contaminated debris.
These activities will be performed after the installation of critical barriers
separating each work area and installing a three chambered decontamination
system. Placement in the work area of negative air machines which will be
exhausted to the outside.
c) CONTRACTOR will remove the air supply vents/ registers and any designated
lighting from the ceiling on the first and second floor. These items will be cleaned
and decontaminated and stored in a designated area for re-use by the Owner.
d) CONTRACTOR will remove and dispose of the carpet in the first floor lobby as
asbestos waste.
e) CONTRACTOR is responsible for providing all scaffolding, ladders and/or
staging necessary to accomplish the work of this contract. The type, erection and
use of scaffolding, including provisions for fall protection and employee training,
shall comply with OSHA 29 CFR 1962, SUBPART L.
fl CONTRACTOR is responsible for Fall Protection for his employees.
CONTRACTOR is solely responsible for protection CONTRACTOR's employees
form fall hazards. Fall protections protocols must comply with all applicable
provision of OSHA 29 CFR 1926.500, SUBPART L. Documentation of training for
each employee will be provided prior to beginning work.

h) CONTRACTOR will be responsible for the cleaning/decontamination of identified
items which the Owner intends to save due to their historical significance. These
items may consist of various equipment, projectors and/or related equipment.
Once these items are cleaned they will be stored in a designated area provided
by the Owner. These items will be identified by the Consultant prior to beginning
remediation.
i) Remaining equipment, fixtures and items in the proposed works area are
considered contaminated and will be disposed of asbestos waste. These items
may consist of desks, signs and other, ceiling grid, lightning, and other items
within the work area.
j) CONTRACTOR will demolish and remove all theater seating in the designated
work area on the first floor lobby. The seating may be decontaminated and
disposed of as general construction waster.
k) CONTRACTOR will provide a continuous fire watch whenever an active
containment is in operation.
I) If the CONTRACTOR does not perform load out through the decontamination
chamber a separate waste load out chamber will be connected to the work area,
with material ingress and egress through a flapped doorway constructed of six
millimeter polyethylene sheeting. The exit of the waste load out area will also be
constructed with six millimeter polyethylene flapped doorway. The water used
during the waste load out procedures as a result of cleaning the outside of the
bags will be properly filtered prior to discharge. No personnel may use this for
ingress or egress in the containment area.
m) Drawings provided depict the general locations of the identified asbestos-
containing materials (ACM's) to be abated. The drawings show the basic
configuration of the identified ACM's and are provided for informational purposes.
The CONTRACTOR will perform work for materials present, regardless of actual
quantities or extent of material and no increase in Contract amount will be
allowed for quantity adjustment.
n) Owner will provide sources of power and water for the project, it will be the
CONTRACTOR's responsibility to route each to the area of usage at the
CONTRACTOR's expense.
o) CONTRACTOR's fee will include the cost of the electrician/plumber expe
abatement area "make safe." ^

p) CONTRACTOR will include the cost of the TDSHS notification fee in their base
bid.
q) AIA Contract A-101 2007 will be used for this project as the contract with the
owner. Supplementary Condition to the Standard Form of Agreement Between
Owner and CONTRACTOR.
3.0 WORK PRACTICES
3.1 Respiratory Protection
Throughout the project, respirators shall be provided by the CONTRACTOR. The
CONTRACTOR will provide respirators which are applicable and suitable for the
purpose intended in accordance with OSHA 1910.134 - Respirator Standard. The
CONTRACTOR will ensure that the respirators are equipped with filter cartridges
designed for asbestos-containing dusts and mists, vapors, and color-coded in
accordance with ANSI Z228.2 (1980).
3.2 Protective Clothing
During removal of the ACM, at least one protective suit will be worn by each worker.
Boots and gloves will be made available to each worker as needed. All protective suits
will be properly disposed of at the conclusion of the work. The workers performing the
abatement will decontaminate thoroughly in three-chambered wet decontamination
system attached to each containment.
3.3 Containment
The asbestos containing materials will be abated in a full containment constructed of two
(2) layers of 4-mil polyethylene sheeting on the walls and two (2) layers of 6-mil

from the rest of the building for the purpose of changing into protective ciothing.
Construct using polyethylene sheeting, at least 6-mil in thickness, to provide an airtight
seal between the Changing Room and the rest of the building. Locate so that access to
Work Area from Changing Room is through Shower Room. Separate Changing Room
from the building by a sheet polyethylene flapped doorway.
Maintain floor of changing room dry and clean at all times. Do not allow overflow water
from shower to wet floor in changing room. Damp wipe all surfaces twice after each shift
change with a disinfectant solution.
Provide a continuously adequate supply of disposable bath towels.
Provide posted information for all emergency phone numbers and procedures.
Shower Room: Provide a completely water tight operational shower to be used for transit
by cleanly dressed workers entering the Work Area from the Changing Room, or for
showering by workers exiting the Work Area after undressing in the Equipment Room.
Construct room by providing a shower pan and 2 shower walls in a configuration that will
cause water running down walls to drip into pan. Install a freely draining floor in the
shower pan at an elevation that is at the top of pan.
Separate this room from the rest of the building with airtight walls fabricated of 6 mil
polyethylene sheeting.
Separate this room from the Changing and Equipment Rooms with airtight walls
fabricated of 6 mil polyethylene sheeting.
Provide splash-proof entrances to Changing and Equipment Rooms with 2 doors
arranged in the following configuration:
At each entrance to the Shower Room construct a doorframe out of lumber, PVC Pipe or
equivalent. Attach to this door frame two overlapping flaps fastened at the head (top)
and jambs (sides). Overlap the flaps that present a shingle-like configuration to the water
stream from the shower. Arrange so that any air movement out of the Work Area will
cause the flaps to seal against the door frame.
Provide shower head and controls. Provide temporary extensions of existing hot and
cold water and drainage, as necessary for a complete and operable shower.
Provide a continuously adequate supply of soap and maintain in sanitary condition.
Arrange so that water from showering does not splash into the Changing or Equipment
Rooms. /

Equipment Room (contaminated area): Require work equipment, footwear and
additional contaminated work clothing to be left here. This is a change and transit area
for workers. Separate this room from the work area by a 6 mil polyethylene flap
doorway. Separate this room from the rest of the building with airtight walls fabricated of
6 mil polyethylene sheeting. Separate this room from the Shower Room and Work Area
with airtight walls fabricated of 6 mil polyethylene sheeting.
Work Area: Separate work area from the Equipment Room by polyethylene barriers. If
the airborne asbestos level in the work area is expected to be high, as in dry removal,
add an intermediate cleaning space between the Equipment room and the Work area.
Damp wipe clean all surfaces after each shift change. Provide one additional floor layer
of 6 mil polyethylene sheeting per shift change and remove contaminated layer after
each shift.
Waste Load Out Area: the CONTRACTOR will conduct the waste load out in areas
separate from any non-project personnel or passers-by.
3.4 Removal
The CONTRACTOR will perform the removal and disposal in accordance with current
local, state and federal regulations.
Acoustical Ceilinq Texture: acoustical ceiling texture will be removed in a full
containment. Spray asbestos containing material(s) with amended water or removal
encapsulant. Allow time for amended water or removal encapsulant to saturate the
material. Do not over saturate to cause excess dripping. If amended water is used,
spray material repeatedly during the work process to maintain a continuously wet
condition. The acoustical texture will be removed from the plaster substrate. The clean
surfaces will be encapsulated after passing a visual inspection conducted by a Terracon
representative. The abated material will be bagged and disposed of in accordance with
the asbestos abatement design.
Floor Tile/Mastic : floor tile/mastic will be removed in a full containment. Spray
asbestos containing flooring/mastic with amended water or removal encapsulant. Allow
time for amended water or removal encapsulant to saturate the material. Do not over
saturate to cause excess dripping. The flooring/mastic will be removed from the
substrate. Once the flooring is removed the mastic remover may be applied to the floor
mastic remaining on the substrate (where applicable). If mastic remover is use will

using a mopping action or with the use of low speed buffers. The clean surfaces will be
encapsulated after passing a visual inspection conducted by a Terracon representative.
The abated material will be bagged and disposed in accordance with the asbestos
abatement design.
Thermal Pipe/Fittinq Insulation: the thermal pipe and/or fitting insulation that is not
present within a contained area may be removed using the glove bag method. Prior to
beginning the glove bag removal operations the area will be properly demarcated as a
regulated area. A drop cloth consisting of six millimeter plastic will be placed beneath the
work area. The drop cloth will extended a minimum of three feet in each direction
beyond the material being removed. A remote three-chambered wet decontamination
system will be centrally located adjacent to the regulated work area for the workers to
proper decontaminate. The glove bag technique used will be in strict accordance with
OSHA 1926.1101. The clean surfaces will be encapsulated after passing a visual
inspection conducted by a Terracon representative.
Thermal Tape: may be removed as a component. Spray thermal tape with amended
water or removal encapsulant. In order to remove the thermal tape (TT) as a component
the CONTRACTOR will completely cover the TT with duct tape or a similar material and
place a drop cloth beneath the ductwork. The drop cloth will consist of six millimeter
polyethylene. The drop cloth will extended a minimum of three feet in each direction
beyond the material being removed. The area will be properly demarcated during the
component removal. Sections of the metal duct may be "cut" on either side of the TT,
taking care not to disturb the TT. A central wet decontamination unit will be set-up for
use by the workers performing the component removal. The team performing the
component removal will consist of a minimum of two workers at all times. The area of
abatement removal will pass a visual inspection conducted by a Terracon
representative. The abated material will be bagged and disposed in accordance with the
asbestos abatement design.
3.5 Disposal
1. Once the regulated ACM is removed, it will be double bagged and labeled In
accordance with Texas Department of State Health Services (TDSHS) and
OSHA guidelines. Pre-printed Generator Labels shall be affixed to each
bag or wrapped component prior to being placed in the lined waste disposal
dumpster or trailer. The use of bladder bags, onion bags or any other
disposal bags deemed unconventional by the consultant will not be
permitted, unless authorized in writing by the Consultant prior to
contract award. ,

3. The area between the bag-out area and the prepared waste receptacle shall
be regulated with barrier tape during bag-out operations. The waste
dumpster or trailer shall remain secured during all other periods.
4. The waste will be disposed in an approved landfill. The waste will be
transported to the landfill in a lined closed top receptacle. Verification of
disposal at the landfill will be provided to the OWNER by CONTRACTOR via
the Uniform Hazardous Waste Manifest signed by the landfill. .

removed. The CONTRACTOR is responsible for the accuracy and timelines of the
notification. The execution of a ContractNVork Order for this project by the OWNER
shall constitute written authorization for the CONTRACTOR to complete and sign the
Notification on the OWNER'S behalf. CONTRACTOR'S bid will include the cost of the
TDSHS fee and will be paid by the CONTRACTOR. The CONTRACTOR shall be
responsible for payment of notification fees included in the Demolition/Renovation
Notification Form. On Notification form, OWNER shall be listed as stated in the contract
with the OWNER.
The CONTRACTOR will be responsible for routing water and electricity to the work
areas. Water and electrical service are present on the site at this time.
The CONTRACTOR is to be current and in good standing on all asbestos abatement
notification fees. The OWNER reserves the right to verify CONTRACTOR'S standing.
The CONTRACTOR shall maintain all records required by TDSHS Texas Asbestos
Health Protection Rules Section 295.62 Operations: Recordkeeping
CONTRACTOR parking and disposal dumpster areas will be as designated by the
OWNER. The CONTRACTOR will keep work and parking areas clean.
Prior to any asbestos abatement activities the CONTRACTOR will provide a licensed
electrician to provide power lock-out and tag-out of all circuits to be affected by the
asbestos abatement activities. Lock-out/Tag-out must meet OSHA 1910.147
requirements. All electrical circuits in the regulated and/or contained area shall have
ground-fault interrupter (GFCI) units installed.
Exhaust negative pressure ventilation system to outside of building.
The CONTRACTOR shall be responsible for installing hard barriers in any window
openings utilized for exhaust of negative pressure and shall ensure that the building can
be secured between work periods. If necessary, a hard barrier decontamination unit
shall be constructed at the site to ensure building security.
The CONTRACTOR shall arrange the use of on-site toilet facilities with the OWNER or
provide temporary self-contained toilet units for use by CONTRACTOR'S personnel
throughout the duration of abatement activities.
The CONTRACTOR shall install one fire extinguisher in the work area for each 1,000
square feet of work area or fraction thereof. Additional fire extinguishers shall be
installed in the Equipment Room and Clean Room of the decontamination unit.

Polvethvlene Wrap: Provide minimum 6 mil polyethylene sheeting as a wrapping for
large sections of rigid waste material and for construction of floors and critical barriers in
the containment areas. Provide minimum 4 mil polyethylene sheeting for construction of
walls of the containment.
Removal Encapsulant: Provide a penetrating type encapsulant designed specifically for
removal of ACM. Utilize an encapsulant that will meet or exceed the results produced by
use of Amended Water, as described above.
7.0 AIR MONITORING SERVICES
The responsibility for performing visual inspections and air monitoring services is
delegated to Terracon's on-site State of Texas licensed project manager/air monitoring
technician.
The CONSULTANT shall verify that the Work performed is in compliance with applicable
regulations and that the building areas beyond the Work Area and the outside
environment remain free of contamination. This section also sets forth airborne fiber
levels both inside and outside the Work Area as permissible exposure limits (PELs), and
describes the action required by the CONTRACTOR if a permissible exposure limit is
met or exceeded.
AIR MONITORING:
The CONSULTANT will be conducting air monitoring throughout the course of the
project.
Work Area Isolation: The CONSULTANT will monitor airborne fiber counts outside the
Work Area. The purpose of this air monitoring will be to detect faults in the Work Area
isolation including, but not limited to, contamination of the building outside of the Work
Area with airborne asbestos fibers, failure of filtration or rupture in the ventilation system,
or contamination of the exterior of the building with airborne asbestos fibers.
Should any of the above occur, the CONTRACTOR shall immediately cease asbestos
abatement activities until the fault is corrected. Work shall not recommence until
authorized by the CONSULTANT.
Work Area Airborne Fiber Count: The CONSULTANT will monitor airborne fiber counts
in the Work Area. The purpose of this air monitoring will be to detect airborne fiber
counts which may significantly challenge the integrity of Work Area isolation proce

that protect the balance of the building or outside of the building from contamination by
airborne fibers.
AIRBORNE FIBER COUNTS:
Inside Work Area: Maintain an average airborne count in the Work Area of less than 0.1
fibers per cubic centimeter. If the fiber counts rise above this figure for any sample
taken, revise work procedures to lower fiber counts. If the Time Weighted Average
(l1NA) fiber count for any Work shift or eight (8) hour period exceeds 0.1 fibers per cubic
centimeter, stop work and leave ventilation system in operation. Do not recommence
work until authorized by the CONSULTANT.
Outside Work Area: Maintain an average airborne count outside the Work Area below
the Permissible Exposure Limit (PEL) of 0.1 f/cc of air.
If any air sample taken outside the Work Area exceeds the PEL, immediately stop work
until the source of the elevated fiber readings can be determined by the CONSULTANT.
Immediately take corrective as instructed by the CONSULTANT.
Decontaminate the affected area in accordance industry standard methods.
ANALYTICAL METHODS:
The following methods will be utilized at the discretion of the CONSULTANT in collecting

The CONSULTANT will conduct the following key Project inspections and no work by
the CONTRACTOR will proceed beyond these points until all discrepancies noted during
the inspection have been corrected.
The CONSULTANT'S inspections do not relieve the CONTRACTOR of Contract
obligations and are not designed to locate all project discrepancies. The
CONTRACTOR is responsible for project quality.
First Key Inspection:
Inspection of Work Area Prior to Start of Removal: Removal operations shall not
proceed until the CONSULTANT has completed inspection of the Work Area
preparations and until all discrepancies noted have been corrected.
Second Key Inspection:
Inspection Durinq Removal: Removal Work shall not be conducted unless the
CONSULTANT is on the Project site. Daily inspection of the Work Area and Work
practices will be conducted; upon discovery and report of a discrepancy the
CONTRACTOR shall immediately stop Work and correct the discrepancy.
Third Key Inspection:
Inspection of Work Area After Completion of Removal Work, but Prior to Encapsulation
and Containment Disassemblv: A visual inspection of the Work site and/or Containment
areas and removal surfaces will be conducted at this point by the CONSULTANT and
encapsulation and/or containment disassembly shall not proceed until discrepancies
noted have been corrected.
Fourth Key Inspection:

Final Key Inspection:
Proiect Closeout Inspection: A final inspection will be conducted by the CONSULTANT
after the CONTRACTOR has removed all barrier tape, drop-cloths, equipment, and
supplies. A project "Punch List" will be provided of any items requiring correction or
completion. Punch List items shall be completed prior to issuance of final completion
notice by the CONTRACTOR.

Discrepancies or needed corrective measures observed by the CONSULTANT will be
reported to the CONTRACTOR'S Superintendent on-site and shall be immediately
corrected.
The above inspections are not necessarily single events. Failed inspections will be re-
conducted and time classified as retests and charged back to the CONTRACTOR in
accordance with the project documents. Inspections will require 24 hours advance
notice to the CONSULTANT.
PERSONAL MONITORING:
The CONTRACTOR shall perform air monitoring as required to meet OSHA
requirements for maintenance of Time Weighted Average (TWA) and excursion limit
fiber counts for types of respiratory protection provided. The OWNER will not be
providing air monitoring services to meet these OSHA requirements. Note: Results of
Personal Monitoring shall be submitted to the CONSULTANT within 72 hours of the time
samples are obtained. A listing of all personal monitoring results obtained during the
project shall be submitted to the CONSULTANT with the CONTRACTOR closeout
submittals.
LABORATORY TESTING:
The CONSULTANT will perform field analysis of the air samples. A microscope and
field laboratory will be set up at the jobsite, at the option of the CONSULTANT, so that
verbal reports on air samples can be obtained promptly after collection.
Reports to the OWNER by the CONSULTANT will include air monitoring data and
pertinent information on work being conducted such as: work hours, number of workers,
procedures used, CONTRACTOR discrepancies and corrective measures, containment
methods and construction, and amount of ACM removed.

PROJECT SUMMARY:
The Grand Theater, Phase II Fungal Biological Hazard Remediation project is demarcated
in the attached drawing (Figure G-1).
Terracon documented water damage, fungal growth, and biological contamination
associated with pigeon infestation in the Grand Theater in the location identified in the
attached drawing (Figures F-1 and F-2). Additionally, non-regulated fungal growth may be
present on water damaged building materials at various locations within the contained work
area. Biological-hazard contamination related to historical pigeon infestation is present as
pigeon feces and pigeon carcasses and for the purposes of this report will be described as
"pigeon related debris". Pigeon related debris (PRD) is present on the majority of horizontal
surfaces in the building areas that comprise Phase II. The quantity and location of water
damage/wood rot, fungal growth, and PRD in the referenced locations is further described in
Section 10.0, and the site diagrams in Appendix A.
The remedial activities will be conducted in general accordance with the Texas Department
of State Health Services (TDSHS) regulations contained in "The Texas Mold Assessment
and Remediation Ru/es", (TMARR). In general, the remediation of regulated fungal growth
will consist of the removal and disposal of building materials as referenced in Section 10.0
and demarcated in the drawings presented in Appendix A. The general debris and the PRD
that comprise the defined biological-hazard in Phase II locations will be removed and
disposed as construction debris, unless the material is further contaminated with asbestos
or lead paint as defined in Terracon's corollary Scope of Work for Hazardous Materials
Abatement, Terracon Project No. 94107645, dated June 4, 2012. The remediation work will
be conducted within containment(s) under negative pressure with HEPA filtered exhaust.
The remedial work conducted in Phase II building locations will require the use of full face N-
100 respirators. Due to the potential for elevated concentrations of biological pathogens
related to PRD, Terracon recommends that the use of Powered Air Purifying Respirators
(PAPR) should be considered.

Terracon has documented the presence of asbestos containing materials (ACM) and lead
based paint (LBP) in the majority of the Phase II building locations. The abatement of ACM
and LBP will be conducted prior to or simultaneous to fungal and PRD remediation. The
asbestos and LBP abatement specifications are provided in the Scope of Work for
Hazardous Materials Abatement, Terracon Project No. 94107645, dated June 4, 2012.
1.0 SAFETY PRACTICES
The contractor is responsible for all OSHA safety practices associated with worker
protection. In addition, the contractor shall ensure that all electrical and fire hazard safety
protocols are followed in compliance with typical construction regulations. It is the
contractor's responsibility to ensure that workers on scaffold platforms or working from
ladders or other elevated platforms should be safe and secure from slipping or falling.
2.0 ACCESS TO WORK AREA
A secure work area will be established. Only licensed/registered individuals qualified to
wear respiratory protection will enter the vacant building work area during the project. The
contractor will ensure that access to the work area is periodically monitored.
3.0 MOVEABLE/NON-MOVEABLE OBJECTS
Not applicable.
4.0 HEATING, VENTILATION, AND AIR CONDITIONING SYSTEM EQUIPMENT
Not applicable.
5.0 DECONTAMINATION SYSTEM
a) The Phase 11 remediation work area will be entered through the decontamination
system previously constructed for the ACM-LBP abatement as referenced in Scope
of Work for Hazardous Materials Abatement, Terracon Project No. 94107645, June
4, 2012.
6.0 CONTAINMENT/CRITICAL BARRIERS
a) The Phase II work areas will have the majority of the required containments and
critical barriers in place from the previous ACM-LBP abatement as referenced in
Scope of Work for Hazardous Materials Abatement, Terracon Project No. 94107645,
June 4, 2012. The TMARR stipulates that a vacant building with controlled access
does not require negatively pressurized, contained work areas, if only licensed

individuals enter the vacant building during the duration of the fungal remediation
project (Rule § 295.322, Minimum Work Practices and Procedures for Mold
Remediation: (d) Containment is not required if only persons who are licensed or
registered under this subchapter occupy the building in which the remediation takes
place at any time between the start-date and stop-date for the project).
b) The remedial work areas will have a minimum of four (4) air changes per hour and
will be operated continuously for the duration of the project. The duration of the
Fungal-Biological Hazard Remediation project for the purposes of this requirement
will be considered from the time containment is established through the time
acceptable post remediation clearance results are provided by the Mold Assessment
Consultant (MAC). The containment/critical barriers must remain in place until
interim written notification of post remediation clearance has been received from the
MAC. The contained works will be exhausted to the outdoor environment and not
operated under recirculation mode unless the MAC has given approval of short-term
recirculation due to building security issues or extended worker absence. Prior to
Final Clearance air sample collection the contained work areas will have been
operating under exhaust for a minimum of 72 hours.
7.0 VENTILATION
a) The Phase II remediation work area will be ventilated with the previously established
ventilation system as defined for the ACM-LBP abatement as referenced in Scope of
Work for Hazardous Materials Abatement, Terracon Project No. 94107645, June 4,
2012. Containment/critical barriers must remain in place until interim written
notification of post remediation clearance has been received from the MAC.
b) The Phase II containment must be maintained at a negative pressure differential of 5
Pascal, or, 0.02 inches of water, with HEPA filtered negative air machines (NAMS)
that are exhausted to the immediate outdoor environment. The containment should
have a minimum of four (4) air changes per hour and shall be operated continuously
for the duration of the project. The negative pressure differential will be continuously
monitored with a manometer. The containment/critical barriers must remain in place
until interim written notification of post remediation clearance has been received from
the MAC.
8.0 PPE DURING FUNGAL REMEDIATION
Workers will wear personal protective equipment consisting of, at a minimum, full face N-100
respirators, disposable heavy duty work gloves and full body disposable coveralls while
performing remedial work. If a worker cuts himself or has a skin abrasion during the

remedial work the worker should leave containment as previously described and clean,
disinfect and securely bandage the injury prior to returning to the remediation work area.
It is the Contractor's responsibility to ensure that his employees are afforded the respiratory
protection as required by the OSHA standard for respiratory protection (29 CFR 1910.134,
December, 2008) or the respiratory protection requested by the employee. The Contractor
shall ensure the workers are instructed and trained in the proper use, maintenance, and
care of respiratory protection in accordance with Title 29 CFR 1910.134. It is the
contractor's responsibility to ensure that workers on scaffold platforms or working from
ladders or other elevated platforms should be safe and secure from slipping or falling.
9.0 CLEANING/DECONTAMINATION
The gross removal of PRD will consist of pre-wetting the PRD with a quaternary ammonium
chloride disinfectant solution to reduce hydrophobicity and mitigate dust generation prior to
handling. The PRD will be continuously wetted using an airless spray pump as desiccated
layers are uncovered during the removal process. The PRD should not be saturated but
lightly misted with the quaternary ammonium chloride disinfectant solution. Examples of
approved biocide/disinfectants include Fosters 40/800 (quaternary ammonium chloride),
Shockwave0 (quaternary ammonium chloride), or an equivalent product when approved by
the MAC prior to application. Material Safety Data Sheets for all chemicals used during the
remediation must be maintained onsite by the MRC.
PRD will be cleaned from remaining environmental surfaces by mechanical cleaning and
decontamination procedures using HEPA vacuuming and wet wiping. After gross removal
of PRD, surfaces should be HEPA vacuumed to remove loose materials and provide the first
stage of decontamination. The second stage of decontamination and disinfection of the
substrate is wet wiping, which will be performed with water amended with an appropriately
labeled and EPA registered biocide, and used on non-porous or semi-porous substrates. A
wire brush or other abrasive techniques will be required to clean non-porous and semi-
porous surfaces. Removal of PRD and fungal growth from the referenced surFaces will
continue until no PRD or fungal growth is visible. Stains on the surFace of wood, concrete or
other building materials left in place should be lightly sanded or wire brushed to remove the
first layer of the substrate. Run off of aqueous cleaning solutions must be controlled and
contained within the defined work areas.
The environmental surfaces within the containment area, including floors, walls and other
environmental surfaces, will be re-cleaned prior to the Post Remedial Verification (PRV).

10.0 REMOVAL OF BUILDING MATERIALS

The PRD and general contaminated debris will be placed in double bags and discarded as
construction debris.
The materials to be disposed as construction debris will be placed in double bags and the bags
decontaminated prior to removal from the contained work areas.
11.0 PROJECT MODIFICATION
The MAC, on an individual basis, will consider modifications designed to expedite or
enhance the fungal remediation procedure. The MAC must approve deviations from the
fungal-biological hazard remediation procedure described.
12.0 POST REMEDIATION VERIFICATION CRITERIA
The project will be cleared by, 1) visual inspection, and 2) total bioaerosol analysis.
The post remedial visual inspection and sample collection will be conducted while
containments/critical barriers are in place and properly depressurized. The
containment(s) may not be removed or completely depressurized until final clearance
has been achieved and written, interim notice provided by the MAC to the MRC.
ii. The visual inspection criteria will consist of an evaluation of the remediation area to
determine if the remediation has been properly conducted in accordance with the
project specifications, applicable state regulations and the fungal growth, defined
biological-hazards, and extraneous debris within the work areas has been properly
removed.

iii. Representative air samples shall be collected from within the work areas, the outdoor
environment, and analyzed by standard optical light microscopy methodology. Total
bioaerosol analysis must be conducted by a licensed Mold Analysis Laboratory. Any
area whose air test does not meet post remediation criteria will be re-tested following
cleaning and air scrubbing of those areas.
iv. Total bioaerosol analytical clearance criteria will be based on qualitative and quantitative
similarity between the indoor samples and the ambient outdoor control samples
collected contemporaneously. Air samples will be collected and analyzed in a manner
that provides a minimum detection limit of 43 spores/m3. Fungal aerosols in the indoor
environment should not exceed the contemporaneously collected outdoor control
samples by more than 650 spore/m3, or by more than 50 % of the "high" results for
Typical Outdoor Spore Levels (Texas) as reported in the EMLab P& K IAQ Pocket
Reference Guide, 6th Edition. The consultant may make numeric exceptions for
frequently isolated genera such as Cladosporium or other typical phylloplane fungi.
13.0 WASTE DISPOSAL
Waste materials will be double bagged or wrapped in opaque six (6) mil polyethylene
unlabeled disposal bags. Disposal bags will be HEPA vacuumed prior to removal from the
work areas. Debris will be disposed as construction waste and placed in an enclosed,
secured dumpster provided by the contractor unless otherwise noted.
14.0 CONTRACTOR RESPONSIBILITIES
In the contained areas the remediation contractor will assume full responsibility and liability for
compliance with all applicable federal, state and local regulations pertaining to work practices,
transport, disposal, and protection of workers, visitors to the site and persons occupying areas
adjacent to the site. The Contractor will hold the Owner, the General Contractor and the
Consultant harmless for failure to comply on the part of himself, his employees or his
subcontractors. Federal, state and local regulations include, but are not limited to, the
following:

15.0 PROJECT SUBMITTALS

At the conclusion of the remedial project the MRC will submit the following:
■ A Certificate of Mold Remediation Damage in accordance with TDSHS regulations
contained in the TMARR (25 TAC §295.301-295.338).
16.0 MITIGATION OF MOISTURE
The building owner is responsible for the mitigation of moisture intrusion and the required
remedial actions should be provided to the MAC.

1.0 INTRODUCTION
The work will consist of the abatement of lead based paint (LBP) identified within the
scope of work. The lead paint abatement design is dated June 4, 2012. The contractor
performing the LBP abatement will be a TDSHS certified lead firm. During the LBP
activities a TDSHS lead abatement supervisor will be on-site at all times and the work
will only be performed by TDSHS lead certified workers.
2.0 MATERIAL DESCRIPTION AND QUANITITIES
Briefly and without force and effect upon the contract documents, the work of the
Contract can be summarized as including removal and disposal of damaged flaking lead
containing paint associated with:

NOTES:
a) CONTRACTOR will be responsible for site security throughout the remediation
project.
CONTRACTOR will remove and dispose of all the theater seating in each
theater. The seats may be cleaned and decontaminated and disposed of as
general construction debris. They CONTRACTOR must take special care not to
inadvertently remove materials containing lead paint outside the scope of lead
remediation.
b) CONTRACTOR will remove the lay-in ceiling tile system in second floor men and
women's restroom. These materials will be disposed of contaminated with lead.
c) CONTRACTOR will remove the carpet in the second floor lobby and office area
as contaminated with lead.
d) CONTRACTOR will remove the wall curtains in the first floor theaters within the
work area. These materials will be disposed of as contaminated with lead.
e) CONTRACTOR will remove the water damaged ceiling on the south end of the
second floor lobby inclusive of the plaster, wire mesh and metal supports.
fl CONTRACTOR will remove the damaged plaster walls in each work area to the
brick substrate.
g) CONTRACTOR is responsible for providing all scaffolding, ladders and/or
staging necessary to accomplish the work of this contract. The type, erection and
use of scaffolding, including provisions for fall protection and employee training,
shall comply with OSHA 29 CFR 1962, SUBPART L.
h) CONTRACTOR is responsible for Fall Protection for his employees.

form fall hazards. Fall protections protocols must comply with all applicable
provision of OSHA 29 CFR 1926.500, SUBPART L. Documentation of training for
each employee will be provided prior to beginning work.
i) CONTRACTOR will be responsible for the cleaning/decontamination of identified
items which the Owner intends to save due to their historical significance. Once
these items are cleaned they will be stored in a designated area provided by the
Owner. These items will be identified by the Consultant prior to beginning
remediation.
j) Remaining equipment, fixtures and items in the proposed works area are
considered contaminated and will be disposed of asbestos waste or lead waste.
k) CONTRACTOR will provide a continuous fire watch whenever an active
containment is in operation.
I) Drawings provided depict the generat locations of the identified lead containing
paint to be remediated. The drawings show the basic configuration or general
locations of the lead containing paint and are provided for informational
purposes. The CONTRACTOR will perform work for materials present,
regardless of actual quantities, extent of materials, even if the item is not
depicted on the drawings. No increase in Contract amount will be allowed for
quantity adjustment.
m) Owner will provide sources of power and water for the project, it will be the
CONTRACTOR's responsibility to route each to the area of usage at the
CONTRACTOR's expense.
n) CONTRACTOR's fee will include the cost of the electrician/plumber expense for
abatement area "make safe."
3.0 WORK PRACTICES
3.1 Respiratory Protection
Throughout the project, respirators shall be provided by the Contractor. The Contractor
will provide respirators which are applicable and suitable for the purpose intended in
accordance with OSHA 1910.134 - Respirator Standard. The Contractor will ensure
that the respirators are equipped with filter cartridges designed for lead paint, dusts and
mists, vapors, and color-coded in accordance with ANSI Z228.2 (1980).
3.2 Protective Clothing
During removal of the loose and flaking LBP, at least one protective suit will be worn by

each worker. Boots and gloves will be made available to each worker as needed. All
protective suits will be properly disposed of at the conclusion of the work. The workers
performing the abatement will decontaminate thoroughly in three-chambered wet
decontamination system attached to each containment.
3.3 Containment
Summary:
The work of this section includes containment construction guidelines for Work Areas
inside and outside of the building, unless the materials are being removed as a
component.
Inspection:
Make detailed inspection of the Work Area prior to beginning. Report in writing
unsatisfactory conditions encountered; do not begin Work until conditions are correct.
Beginning Work signifies acceptance of conditions.
Site Protection:
Protect items, materials, and structures designated to remain after completion of Project.
If wall, ceiling, or floor mounted items are removed to facilitate containment construction,
inventory removed items and replace in operating condition at completion of Project.
Replace, or repair to the satisfaction of the OWNER, elements that become damaged or
lost prior to Final Acceptance at no additional cost to OWNER.
Containment Construction:
Carry out the following installation procedures sequentially unless directed otherwise, in
writing:
Provide Worker Protection per Section 3.1 and 3.2.
Post warning signs in accordance with applicable State and Federal Regulations.
HEPA vacuum and Wet-Clean openings that will be covered by Critical Barriers.
Critical Barriers:
Openings to the Work Area: Completely separate the Work Area from other portions of
the building, the outside, and from openings to adjacent areas (doorways, windows, etc.)
by sheet plastic barriers at least 6 mil in thickness.

Individually seal ventilation openings in walls (supply and exhaust), wall mounted fixtures,
connectors, and other wall and floor openings into the Work Area with polyethylene
sheeting at least 6 mil in thickness, taped securely in place with adhesive tape.
Maintain seal until Work, including work of Final Clearance Section, is completed.
Exercise care in sealing active lighting and other fixture to avoid melting or burning of
sheeting. Seal the perimeter and seams of sheet plastic barriers with adhesive tape.
Cover floor drains to prevent liquids from any source entering the sewer system.
Provide leak protection to floor surface adequate to prevent water leaks to floors below the
Work area or to areas outside the containment.
Complete Pre-Cleaning and Decontamination procedures before proceeding beyond this
point.
Primary Barrier (first layer), install as necessary for the type of Containment Construction
required:
Floor: One layer of clear polyethylene sheeting, 6 mil thick minimum. Cover floor,
including Critical Barriers, and turn polyethylene up walls at least six inches (6"). Form a
sharp right angle bend at junction of floor and wall so that there is no radius which could
be stepped on causing the wall attachment to be pulled loose. Both spray-glue and
adhesive tape seams in floor covering.
Wall and/or Ceiling: One layer of clear polyethylene sheeting, 4 or 6 mil thick as
indicated. Cover walls and/or ceiling in Work Area, including Critical Barriers. Support,
as required to maintain barrier throughout Project Duration. Attach edge of sheeting at
least eight inches (8") away from lead material. Seal perimeters and joints including the
floor covering joint with adhesive tape. Do not locate seals at wall to wall joints.
Secondary Barrier (second layer), install as necessary for the type of Containment
Construction required:
Floor: One layer of clear polyethylene sheeting, 6 mil thick minimum. Overlap first barrier
and turn polyethylene up walls at least twelve inches (12"). Utilize the same installation
procedures as Primary Barrier. Locate seams in top layer at a minimum of six (6) feet
from, or at right angles to, seams in bottom (first) layer. Install sheeting so that this top
layer can be removed independently of bottom layer.
Wall and/or Ceiling: One layer of clear polyethylene sheeting, 4 or 6 mil thick as
indicated. Overlap and attach second layer of polyethylene eight inches (8") beyond first
layer, as close as possible to lead material without causing disturbance of material.
Install sheeting so that this top layer can be removed independently of bottom layer. Do

not locate seams at wall to wall joints.
Drop Cloth: Over the floor sheeting, install as a drop cloth, a clear 6 mil sheet plastic in
areas where lead removal work is to be carried out. Completely cover floor with sheet
plastic. Where the work is within 10 feet of a wall, extend the Drop Cloth up wall. Support
sheet plastic on wall with duct tape, seal top of Drop Cloth plastic to wall Barrier with duct
tape so that debris is unable to get behind it. Provide cross strips of duct tape at wall
support as necessary to support sheet plastic and prevent its falling during removal
operations.
Install Drop Cloth at the beginning of each work shift. Install only sufficient plastic for
work of that shift. Remove Drop Cloth at end of each work shift or as work in an area is
completed. Fold plastic toward center of sheet and pack in disposal bags. Keep
material on sheet continuously wet until bagged.
Install Walkways of 6 mil plastic between active removal areas and decontamination units
to protect top floor layer from tracked material. Install walkways at the beginning of, and
remove at the end of each work shift.
Emergency Exits: At each existing door from the Work Area, provide the following means
for emergency exiting:
Arrange exit door so that it is secure from outside the Work Area but permits exiting from
the Work Area. Mark outline of door on wall sheeting with luminescent paint or tape at
least one inch (1") wide. Hang a razor knife on a string beside outline. Arrange wall
Barriers so that they can be easily cut with one pass of razor knife. Tape or paint with
luminescent paint, the word "EXIT" inside outline in letters at least six inches (6") high and
one inch (1") thick.
Windows: Install window or windows into Containment Area to allow view to fullest extent
possible. Locate as required by the OWNER'S ON-SITE REPRESENTATIVE.
Negative Pressure:
The following requirements are intended to provide a satisfactory negative pressure
ventilation rate in the Work Area.
PRESSURE DIFFERENTIAL: Provide a fully operational ventilation system within the
Work Area maintaining continuously a pressure differential across Work Area of 0.02
inches of H2O.
Location of Exhaust Units: Locate exhaust unit(s) so that makeup air enters Work Area
primarily through decontamination facilities and traverses Work Area as much as
possible. This may be accomplished by positioning the exhaust unit(s) at a maximum

distance from the worker access opening or other makeup air sources.
Vent to Outside of Building, unless authorized otherwise, in writing by the OWNER'S
REPRESENTATIVE. This may involve the use of additional lengths of flexible or rigid duct
connected to the air outlet and routed to the nearest outside opening. At the completion of
the work, reinstall window panes which have to be removed temporarily.
The containment area must remain under negative pressure throughout the lead
remediation process.
Testing the System: Test ventilation system before any lead-containing material is
removed. After the Work Area has been prepared, the decontamination facility set up, and
the exhaust unit(s) installed, start the unit(s) (one at a time). Demonstrate operation of
ventilation system to the OWNER'S ON-SITE REPRESENTATIVE.
Demonstration of the Operation of the ventilation system to the OWNER'S ON-SITE
REPRESENTATIVE shall include, but not to be limited to, the following:
Plastic barriers, sheeting move lightly in toward Work Area.
Curtain of decontamination units move lightly in toward Work Area.
There is a noticeable movement of air through the decontamination unit.
Measurement of the air pressure.
Modify the Ventilation System as necessary to successfully demonstrate the above to the
satisfaction of the OWNER'S ON-SITE REPRESENTATIVE.
Use of System During Abatement Operations: Start exhaust units before beginning work
(before any lead-containing material is disturbed). After abatement work has begun, run
units continuously to maintain a constant negative pressure until decontamination of the
Work Area is complete and area has achieved clearance. Do not turn off units at the
end of the work shift or when abatement operations temporarily stop. Provide full-time,
24 hour per day monitoring of the Work Area to assure security, continuous operation of
the ventilation system, and fire safety. ,
Do not shut down ventilation system during encapsulating procedures, unless authorized
by the OWNER'S ON-SITE REPRESENTATIVE.
Start abatement work at a location farthest from the exhaust units and proceed toward
them. If an electric power failure occurs, immediately stop abatement work and do not
resume until power is restored and exhaust units are operating again.

At completion of abatement work, allow exhaust units to run to remove lead dust that may
have been generated during abatement work and cleanup and to purge the Work Area
with clean makeup air.
Dismantling the System:
When a final inspection and the results of final testing indicates that the area has been
decontaminated, exhaust units may be removed from the Work Area. Before removal
from the Work Area, remove and properly dispose of prefilter, and seal intake to the
machine with 6 mil polyethylene to prevent environmental contamination from the filters.
Extension of the Work Area:
If the containment barrier is breached in any manner that could allow the passage of lead
debris or airborne lead, then add affected area to the Work Area. Provide temporary
containment as required in accordance with this scope of work.
Additional Containment Requirements:
Stairs and Ramps: Do not cover stairs or ramps with unsecured sheet plastic. Where
stairs or ramps are covered with plastic, provide treads securely held in place, over
plastic. Do not cover rungs or rails with any type of protective materials.
Scaffolding inside the Work Area: Cover containment floor plastic with a plywood or
hardboard of sufficient thickness to protect plastic from punctures and tears. Wrap edges
and corner of each sheet with adhesive tape. At completion of abatement work, wrap
plywood or hardboard with two (2) layers of 6 mil polyethylene and move to next Work
Area or dispose of as lead-contaminated waste in accordance with Section 02080.24.
Containment constructed on Scaffolding Deck: Cover deck (floor) of scaffolding with the
following layers as a minimum: One layer of 10 mil thick, clear, reinforced, polyethylene
sheeting as bottom layer, turned up walls at least fourteen inches (14"). One layer of
corrugated cardboard over bottom layer. Follow with two individual layers of 6 mil thick
clear polyethylene, installed in same manner as Primary and Secondary Barriers for
floors. Install Drop Cloth as final layer. Proceed with installation of wall barriers for the
type of containment construction required.
3.4 Removal
The CONTRACTOR will perform the removal and disposal of the damaged flaking paint
in accordance with current applicable local, state and federal regulations. The Contractor
will minimize the creation of lead contaminated dust and airborne particles using
methods and procedures that create the least amount of dust.

3.5 Disposal
This section describes the disposal of lead containing or lead contaminated components
and/or waste materials. Disposal includes packaging of all non-metal waste materials
and shall be accomplished by land filling or incineration as appropriate. Approval by
OWNER is required prior to all recycling or disposal activities.
Testing of waste will be performed to determine disposal requirements. The testing shall
be conducted by the Owner's Representative. The Owner's Representative shall verify
that all the waster has been properly segregated, containerized, and classified in the
following categories:
Place all waste generated during the project in a DOT approved drum lined with a 6 mil.
disposal bag in an enclosed dumpster, truck or designated secure storage area.
Separate waste materials into the following categories and label all disposal drums.
a. Non-Hazardous Solid Waste:
• After thorough cleaning, plastic sheeting and duct tape used during
abatement.
b. Hazardous Solid Waste:
• Paint chips
• Rags, sponges, mops, HEPA vacuum filters and contents, respirator
cartridges, protective clothing, shower water filter(s) and other
materials used during abatement.
• Wood Components if applicable
c. Hazardous Liquid Waste (as determined by testing)
• Waste water
All waste shall be handled and disposed of according to local, city, state, and federal
regulations. All waste assumed to be hazardous shall be transported off-site to the
approved disposal site by CONTRACTOR.
Disposal of Non-Hazardous Solid Waste (as categorized by Owner's
Representative)
Materials are to remain in 6 mil disposal bags or wrapped in polyethylene sheeting.
Transport waste in enclosed trucks or dumpsters.
Disposal of Non-Hazardous Liquid Waste(as categorized by Owner's
Representative)

Dispose of liquid waste by pouring into sanitary sewage system if permission is received
from publicly owned treatment works facility (POTW). Do not dispose of liquid waste by
pouring onto ground or into storm drain. If the liquid waste contains phosphates or other
chemicals advise treatment facility of quantity of liquid and that it is likely to contain
phosphates.
Properly filtered shower water shall be disposed of as non-hazardous liquid
waste. All filters hall be disposed of in accordance with applicable
regulations.
Disposal of Hazardous Liquid or Solid Wastes (as categorized by Owner's
Representative):
a. Comply with Resource Conservation Recovery Act (RCRA), Department of
Transportation (DOT), state and local regulations.
b. Comply with DOT and state regulations for containers. The most stringent
regulation shall apply.
c. All waste is to be hauled by a licensed waste hauler with all required licenses
from all state and local authorities with jurisdiction.
d. Load all waste material into properly sized disposal bags, polyethylene
sheeting, and prior to being placed in lead-tight drums. Prior to transporting, all
materials are to be contained in a DOT approved sealable steel drum with one
of the following:
• One, 6-mil layer of sheet polyethylene, duct tape all seams or
• One, 6-mil disposal bag; or
• Two, 4-mil disposal bags
e. Protect interior of truck or dumpster with two (2) layers of 6-mil polyethylene
sheeting will all seams sealed with duct tape.
f. Load containerized waste in fully enclosed dumpsters or trucks for transport.
g. Do not store containerized materials outside of the Work Area. Take containers
from the Work Area directly to the designated storage area or enclosed
dumpster or truck.
h. At completion of hauling and disposal of each load submit copy of Uniform
Hazardous Waste Manifest to Owner's Representative.

3.6 Clearance
The lead risk assessor shall confirm job completeness by determining whether LBP
has been abated according to the abatement plan. Once the surface has passed a
visual inspection wipe sampling for lead dust concentrations shall be collected by the
Owner's Representative and conducted as follows:
a) Post-abatement or removal to determine if previously specified clearance
criteria has been met in each area of remediation. The clearance level
has been established at 40 micrograms per square foot (µg/ft) on
horizontal surfaces.
b) The specific location and number of samples will be determined upon
conclusion of the remediation. If at any time the post-abatement or
removal wipe samples exceed the clearance levels identified. The
Contractor shall be responsible additional cleaning of the area to attempt
to achieve clearance levels. If additional cleaning is required, the
Contractor will perform the re-cleaning with no adjustment in the contract
price. In addition, the Contractor will be responsible for the costs of
retesting, and the on-site industrial hygiene technician's time on-site
during the cleaning activities.
4.0 CONTRACTOR SUBMITTALS
Submittals required for proper execution include but are not limited to the following:

the project. If a document expires during the course of the project, workers will not be
allowed to perForm abatement operations until an updated document has been submitted
to the OWNER'S REPRESENTATIVE.

CONTRACTOR RESPONSIBILITIES:
Illegible submittals will be rejected and returned for re-submittal.
Schedule submittals according to general flow of Work and so as to allow for adequate
and timely review of submittals by CONSULTANT.
Review submittals prior to submission and submit to CONSULTANT in accordance with
provisions herein.
Verify field measurements, construction criteria, catalog numbers and similar data.
Coordinate submittals with requirements of Work and Contract Documents.
CONTRACTOR'S responsibility for errors or omissions is not relieved by
CONSULTANT's review.

5.0 CONSTRUCTiON NOTES
The CONTRACTOR will be responsible for routing water and electricity to the work
areas. Water and electrical service are present on the site at this time.
Prior to any lead paint abatement activities the CONTRACTOR will provide a licensed
electrician to provide power lock-out and tag-out of all circuits to be affected by the lead
paint abatement activities. Lock-out/Tag-out must meet OSHA 1910.147 requirements.
All electrical circuits in the regulated and/or contained area shall have ground-fault
interrupter (GFCI) units installed.
Exhaust negative pressure ventilation system to outside of building.
The CONTRACTOR shall be responsible for installing hard barriers in any window
openings utilized for exhaust of negative pressure and shall ensure that the building can
be secured between work periods. If necessary, a hard barrier decontamination unit
shall be constructed at the site to ensure building security.
Toilet facilities are not available on the project site, the CONTRACTOR shall arrange for
temporary self-contained toilet units for use by CONTRACTOR'S personnel throughout
the duration of abatement activities.
The CONTRACTOR shall install one fire extinguisher in the work area for each 1,000
square feet of work area or fraction thereof. Additional fire extinguishers shall be
installed in the Equipment Room and Clean Room of the decontamination unit.
The CONTRACTOR shall conduct a safety meeting for CONTRACTOR'S employees
with emphasis on operation of fire extinguishers and emergency exits in case of fire.
CONTRACTOR shall have posted emergency phone numbers for the fire department
and police.
CONTRACTOR shall store a minimum of volatile substances on the job site and in fire
resistant containers only.
6.0 PRODUCTS
Amended Water: Provide water to which a surfactant has been added. Use a mixture of
surFactant and water which results in wetting of the ACM and retardation of fiber release
during disturbance of the material.
Disposal Baqs: Provide as a minimum, individual, 6 mil thick, leak-tight, manufactured
polyethylene bags.

P_olyethvlene Wrap: Provide minimum 6 mil polyethylene sheeting as a wrapping for
large sections of rigid waste material and for construction of floors and critical barriers in
the containment areas. Provide minimum 4 mil polyethylene sheeting for construction of
walls of the containment.
Tri-Sodium Phosphate: Provide a detergent solution for cleaning abated surfaces.
7.0 VISUAL 1NSPECTION/WIPE TESTING
The CONSULTANT shall verify that the Work performed is in compliance with applicable
regulations and that the building areas beyond the Work Area and the outside
environment remain free of contamination.
Upon completion of the lead paint abatement, in a particular area, and a satisfactory
visual inspection by the Owner's Representative in a given work area, a preliminary
cleaning shall be performed by the Contractor. This cleaning includes removal of any
contaminated material, equipment or debris including polyethylene sheeting from the
work area. Where polyethylene sheeting has been used, it shall be sprayed or misted
with water for dust control, debris removed, and then the sheeting removed by folding it
in upon itself. The following methodology shall be utilized during the cleanup prior to
clearance.
a) The lead-contaminated dust or debris shall be containerized in accordance with
the work plan.
b) Once the polyethylene sheeting, is removed from the work area, cleaning shall
begin. It shall be done in the following sequence: HEPA vacuum; Tri-Sodium
Phosphate (TSP) wash (or other cleaner approved by the Owner's Representative);
clean water rinsing and HEPA vacuum.
HEPA vacuum all surfaces. Begin with ceilings and proceed down the walls,
including window, doors, all trim, and ending with floors. Begin vacuuming at the
farthest corner away from the entrance to the work area. Wash all of the surFaces
vacuumed in the same sequence previously described. The Contractor shall utilize a
5-10% tri-sodium phosphate (TSP) detergent solution or other equally effective
cleaning agent and allow the surface to dry. The Contractor shall clean water rinse
all surFaces after washing.
c) HEPA vacuum all surfaces, as detailed above.
d) The wastewater from cleaning shall be contained and disposed in accordance
with this work plan.

Post-abatement or removal to determine if previously specified clearance criteria has
been met in each area of remediation. The clearance level has been established at 40
micrograms per square foot (µg/ft2) on horizontal surfaces. The specific location and
number of samples will be determined upon conclusion of the remediation. If at any time
the post-abatement or removal wipe samples exceed the clearance levels identified. The
Contractor shall be responsible additional cleaning of the area to attempt to achieve
clearance levels. If additional cleaning is required, the Contractor will perform the re-
cleaning with no adjustment in the contract price.
PERSONAL MONITORING:
The CONTRACTOR shall perform air monitoring as required to meet OSHA
requirements for maintenance of Time Weighted Average (TWA) and excursion limit
fiber counts for types of respiratory protection provided. The OWNER will not be
providing air monitoring services to meet these OSHA requirements. Note: Results of
Personal Monitoring shall be submitted to the CONSULTANT within 72 hours of the
time samples are obtained. A listing of all personal monitoring results obtained during
the project shall be submitted to the CONSULTANT with the CONTRACTOR closeout
submittals.

OSHA VIOLATtON STATEMENT - 3 YEARS
The following is the citation history for NCM Demoiition and Remediation, LP (including former names and/or
predecessor identities, as applicable). NCM and/or its predecessors have not received any wiilful or repeat
citations.
NCM Demolition was issued one citation by Maryland Department of Labor, OSHA (December, 2011) (OSHA
Activity#315827253). The citation was issued because a#oreman did not use appropriate personal protective
equipment when testing a 13.8 kV switchgear cabinet. A reduced penalty of $4200 was paid. OSHA classified
the citation as Other.
MARCOR Environmental, LP was issued three citations by the California Department of Labor, OSHA (April
2011) [OSHA Activity #3156077881. 7wo of the violations related to the hearing conservation program and
one violatton related to an inventory of chemicals being used per the hazard communication standard. A
reduced penalty of $4,039.20 was paid. OSHA classified all three of the violations as Other.
CST Environmental, LP was issued three citations by the Nevada OSHA (February 2011) [OSHA Activity
#314888967J. Two citations were related to the use of a floor bufFer to remove mastic without having a proper
notification submitted prior to pertorming the activity. The errors were corrected by amending the notification
to include the use of a floor buffer. The third citation was issued for failure to perform proper final air
ciearance. This was corrected by providing all employees an eight hour asbestos refresher course with an
emphasis on final air clearance requirements. A reduced penalty of $1,664 was paid. OSHA classified these
violations as Other.
CST Environmental, LP was issued one citation by the Ohio Department of Labor, OSHA (December 2010)
[OSHA Activity #395039453] concerning adequate use of fall protection equipment. Superoisor overseeing
selective interior demolition failed to properly mark opening in floor, a potential fall hazard. Materials were
immediately obtained and the opening was properly secured during time of inspection. Retraining was held for
supervisor and employees on properly securing potential fall hazards. A reduced penalty of $3,500 was paid.
CST Environmental, LP was issued one citation by the Ohio Department of Labor, OSHA (December 2010'
[OSHA Activity#394100637] concerning dust control on a demolition project. The number of fire hoses used
during the demolition process was increased to suppress the creation of dust. Proper PPE's were used at all
times to protect employees from exposure to dust. No fine was issued. OSHA classified this violation as Other.
CST Environmental, Inc, was issued one citation by the Industrial Commission of Arizona, Division of
Occupational Safety and Health (March 2010) [OSHA Activity #314384363J related to an incomplete
decontamination unit installed at a regulated work area. The cited conditions were immediately corrected to
the inspector's satisfaction. The citation was issued as non-serious without monetary penalty. OSHA
classified this violation as Other.
CST Environmental, LP was issued three citations by the Florida Department of Labor (March 2010) [OSHA
Activity#314495225]concerning housekeeping. One citation was related to items not kept cleared from work
areas, passageways exposing employees to possible trip, fall or cut hazards. The demolition debris was
immediately removed from the work area and properly disposed. Two citations related to the temporary use of
an extension cord (or hoses) in an inactive stairway to perform the work. The cords were immediately
removed from the stairuvay when identified as a potential trip hazard. Workmen were advised to secure cords
(or hoses) overhead or outside the potential path of travel. A reduced penalty of $3,037 was paid.

CST Environmental, Inc. was issued one citation by Cal-OSHA (November 2009) jOSHA Activify #3116696831
related to the requirement for permits to demolish structures over 36' in height. Although CST maintains a
Cal-OSHA Annua! Activitv Permit for demolition of structures over 36' in height, a project specific permit had
not been issued prior to preparation of the structure for work. A reduced penalty of $750 was paid.
MARCOR Remediation, Inc. was issued two citations by Nevada OSHA (May 2009) [OSHA Actrvity
#313241648] conceming proper grounding and medical certiflcations. One citation related to improperly
grounded equipment. The other citation related to missing documentation of inedical examinakion for two
employees. Both items were immediately corrected to the inspector's satisfaction. No fine was issued. .
OSHA classified this violation as Other.
