5ECTION l. That Ordinance No. 1518 bes and the same is hereby amended as follows: Effective with the gas bills rendered on and after the date of passage and approval of this ordinance, the general service rate for the sale of natural gas rendered to residential and commercial consumers within the City Limits of Pariss Texas, by Lone Star Gas Company, a Texas corporation, its successors and assigns, is hereby fixed and determined as follows: First 1, 000 cubic feet or fraction thereof $l. 67 gross; $1. 50 net All over 1,000 cubic feet @$.8433 gross per MCF; $.759 net per MCF No gas bill wi11, be rendered to any residential or commercial consumer served under the above rate not consuming any gas during any monthly billing period. ADJUSTMENTS The amount of each net monthly bill computed at the above stated rates shall be subject to the following adjustments: Plus 1/2 of 1°jo of the amount computed at the above stated rates for each whole point by which the average of the 12 most recent monthly values for the "A1X Item Consumer Price" Index compiled by the United States Department of Labor on a 1957-1959 base, or adjusted thereto9 exceeds 112; plus or minus the amount of any increase or decrease, respectively= in the present authorized intra-company city gate charge as fixed by the Railroad Commission of the State of Texas or other re- gulatory body having jurisdiction for gas delivered to Lone Star Gas Companyxs distribution system for sale to residential and commercial consumers in the City of Paris; plus an amount equivalent to the proportionate part of any new tax, or increased rate of tax' or governmental imposition or charge (except state,, county, city and special district ad valorem taxes and any taxes on net income) levied or assessed against the Company or on its gas business, as the result of any new or amended law, ordinance or contract, after January 1, 1966. Each gross monthly bill shaU be adjusted proportionately. Company at its option may forego the application of any adjustment if such adjustment wou.ld result in an increase in the monthly bill; however, failure of Company to apply any adjustment shall not constitute a waiver of Companyzs rightg from time to time or at any time, to make any adjustment in whole or in part, in any sub- sequent current monthly bill that may be applicable to such bill under the pro - visions of the foregoing adjustments. Provided, however, that none of the foregoing adjustments wi11 be made by the Lone Star Gas Company without notice to the City Council of the City of Paris and after a hearing thereon if demanded by the City Council. Net rate shall apply to a11, bills paid within ten days from monthly billing date. The above rate is applicable to each residential and commercial con- sumer per month or for any part of a month for which gas is used at the same locatio n.
