AN ORDINANCE CREATING A POI,ICE RESERVE UNIT IN THE CITY OF
PARIS; DEFINING THE REGULATIONS AND CONTROL OF SAID POLICE RESERVE
UNIT; PROVIDING FOR MONTHLY TRAINING OF SAID RESERVE UNIT; SETTING
FORTH THE QUALIFICATIONS OF THE MEMBERS OF SAID RESERVE UNIT AND
THE MANNER OF THEIR SELECTION; DEFINING THE OFFICERS OF SAID UNIT;
PROVIDING FOR CERTAIN RESTRICTIONS ON CARRYING A PISTOL OR REVOLVER
ON OR ABOUT A MEMBER OF SAID RESERVE UNIT OR IN HIS AUTOMOBILE;
PROVIDING FOR UNIFORMS, BELTS AND HOI.STERS, AND FOR THE TAKING OF
THE OATH OF OFFICE OF THE MEMBERS OF SAID RESERVE; PROVIDING FOR
THE TERMINATION QF MEMBERSHIP OF SAID RESERVE; FROVIDING FOR DISSO-
LUTION THEREOF AT THE WILL OF THE CITY COUNCIL; PLACING CERTAIN
FUNCTIONS OF SAID PARIS POI.ICE RESERVE UNIT UNDER THE CHIEF OF
POLICE,OR HIS ASSISTANT, OF THE REGULAR POLICE DEPARTMENT; PROVID-
ING Ff7R GENERAL RULES AND REGLJLATIONS GOVERNING THE COiVDUCT OF THE
MEMBERS OF SAID RESERVE; PROHIBITING CERTAIN ACTS ON THE PART OF
THE MEMBERS OF SAID RESERVE; AND PROVIDING FOR SUSPENSION OR DIS.-
MISSAL FOR CERTAIN VIOLATIONSo
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1, There is hereby created a Police Reserve Unit under
the conditions, rules and regulations hereinafter set out.
Section 2. The purpose of the Police Reserve Unit shall be to
assist and augment the regular Police Department of the City of
Paris, Texas.
Section 3, The opera-tion of the Folice Reserve Unit shall be
subject to the policy determination of the City Council of the City
of Paris, Texas.
a, The City Council at any time shall have the right to
amend the rules and regulations; adjust the policy;
suggest procedural changes; and to expand or decrease
the membership, or disband, the garis P°olice Reserve
Unit. Any fundamental policy changes in the operation
of said Reserve Unit shall be subject to review and
approval by the Chief of Police, the City Manager and
the City Council.
Section 4. Regular meetings of the Police Reserve Unit shall
be held in the City Hall building on the First Thursday of each
month at 7:30 P. M. and presided over by the Commanding Officer of
the Reserve Unit or his designated assistant under supervision of
the Chief of Police. To such an extent as possible, parliamentary
rules shall be observed and proper order maintained. During these
monthly meetings instruction will be had on police efficiency. It
is recognized that the Police Reserve Unit is a voluntary organiza-
tion and for that reason, strict military discipline is not to be
desired. Howevex, proper functioning and effective service to the
City requires that certain rules and regulations be made and observed.
a. A member must attend 5056 of the meetings during each
quarter, and perform patrol or other Police activiM
ties a minimum of 50% each quarter. Legitimate
reasons for absence will be accepted, but must not
become habitual.
b. The Screening Board shall be made up of two (2)
permanent members - the Chief of Police or his
assistant and the Commanding Officer of the
Reserve Unit.
c, Screening Board Procedure: - The initial interview
of a prospective applicant shall be made by the
Commanding Officer, who will then investigate the
applicant and report to the Chief of Police. The
Commanding Officer shall then submit his recommenM
dations to the Chief of Police who shall determine
if the applicant is to be accepted.
Section 9. Any transfers from one squad to another, if more
than one squad, shall be with the consent of the Chief of Police.
Section 10. The membership of any member may terminate or be
terminated, suspended or demoted at any time for one of the follow-
ing reasons:
a. His own volition.
b. Flagrant and serious violation of Unit or Department
rules and regulations,
c, Repeated minor violations of Unit or Department
rules and regulations.
The method of determining and administering disciplinary ac-
tion shall be under the supervision of the City Council and the
Chief of Police.
Section 11, General policies, procedures, code-ofwconduct,
and manner of operation other than that stated above shall be en-
acted and followed as suggested or instructed by the Commanding
Officer, the Chief of Police or his designated assistant.
Section 12, The Chief of the Paris Police Department shall
be the director and sponsor of the Paris Police Reserve Unit, He
shall aid in developing and establishing policies, directives, and
standard operating procedures, and programs of the Unit. He shall
appoint the Commanding Officer of the Reserve Unit,
The Commanding Officer of the Police Reserve Unit shall be
directly respunsible to the Chief of the Faris Police Department
and shall carry out such policies, orders, and directives as are
issued by or through the Chief of Police or his designated
Assistant. The Commanding Officer shall develop, with the advicc
of the Chief of Police, organizational policies,standard operating
procedures, and training programs of the Unit. He shall be re-
sponsible for seeing th at the overall program of the Unit is pro-
perly adhered to, developing and maintaining continued assignments,
or instructio ns al directed or delegated by the Chief of Police,
The Commanding Officer shall preside over all meetings of the
Police Reserve Unit.
The Commanding Officer and the Chief of Police shall appoint
the Sergeants, if any.
Section 13, Other officers may be provided as the need
arises, e.g., Chaplain, Fire-Arms Instructor, Medical Officer,
Fhotographer, Records and Identification Officer, etc.
Section 14. General Rules
A. Conduct in General
1. A member must be courteous, quiet, civil and
orderly.
2. In performance of duty, he must maintain his
temper, patience, and discretion.
3. He must at all times ref rain from course,
profane, or insolent language; but when re-
quired, act with firmness and sufficient
energy to perform his duty,
4o Members must at all times be civil and re-
spectful toward each other and toward all
other persons on all occasions.
B. Taking Appropriate A.ction
1. Failure to report or to take appropriate
action in the case of crime, disorder, or
other act or condition requiring Folice
action, will be regarded as neglect of
duty and such failure to act will be suff i.-
cient cause for strict disciplinary action.
2. Neglect of duty in some instances, in addi-
tion to violating a Department rule, may be
a violation of a specific State Law and the
provisions of the City Qrdinances.
C. Intoxicating I:iquors
1. A member of the Department shall not drink
intoxicating liquors of any kind immediately
prior to reporting for duty, nor under any
circumstances shall he drink any intoxicants
while on duty or in uniform. Any violation
of this regulation shall be deemed sufficient
cause for dismissal.
2. At all other times a member, if he drinks
intoxicants at all, shall do so in private
and with moderation in order not to bring
justifiable criticism upon himself or the
Department.
D. Imparting Official Business
l. All official business of the`Department must
be treated as confidential and shall not be
transmitted to anyone without first obtaining
permission of the Chief of Police to release
such information.
E. Obedience to Orders
1, Functual attendance, prompt obedience to
orders and conformity to rules of the
Department will be rigidly enforced.
2. A flagrant violation of any Departmental
rule will be cause for charges to be pre-
ferred at the discretion of the Chief of
Floli ce.
F. Members Unable to Report for Duty
l, Members unable to report punctually for
duty for any cause must notify their
superior officer and receive permission
to be absent pri.or to the time set for
the commencement: of their tour of duty,
or when a regular meeting is being helda
G. Violations in General
l. Drinking intoxicating liquors while on
duty or in uniform.
2. Willful disobedience of a lawful ordero
3. For unnecessary violence toward any person,
4. For sleeping on duty or being absent from
a post without a superior's permission.
5. For disrespect shown toward a superior
officer,
6. For indecent, profane, or harsh language
while on duty o:r in uniform.
7. For accepting a bribe.
8. For cowardice.
9. For conduct subversive to the good order
and discipline of the Department.
10. For failure to report for duty or a meeting
without first obtaining permission from a
superior officer.
11. For releasing information concerning Of£icial
Business without permission.
H. Violations Not Covered
1. Those acts, not: specifically stated herein,
which involve moral turpitude, or acts and
violations of Departmental Rules and Regula-
tio ns, or which may bring discredit upon the
individual or upon the Department, or which
may conflict with the policies announced by
the Department from time to time; if such
an act be committed or violation incurred by
a member of the Police Reserve, such action
shall be taken that may be necessary depend-
ing upon the seriousness of the offense and
in the same manner and degree as if the
offense had been specifically stated herein.
I. Penalties for Violation
1. Any member who violates any of the rules and
regulatio ns as stated herein in Sectio ns G
and H above may be immediately suspended by
any superior officer. Suspensions so made
are subject to review by the Commanding Officer
and Chief of Police, who shall determine if the
suspension is to be permanent or temporary.
Their decision shall be final.
Sect:kn 15, Nothing herein shall be construed to in any way
or manner affect the operation of the Paris Police Department or
the rights and privileges of the members thereof under the Civil
Service Act of Texas.
Section 16, That at all. times when a member of the Police
Reserve is accompanied by a member of the regular police department,
the member of the regular poli.ce department will be the person in
charge of the operation being accomplished.
Szction 17. This ordinance shall become effective immediately
upon passage.
