AN QRDINANCE REGULATING PAWNBRQKERS; PROVIDING FOR OCCU-
PATIONAL LICENSE FOR ALL PAWNBROKERS; PROVIDING FOR APPLICA-
TION AND PAYMENT OF LICENSE FEE; PROVIDING FOR DAILY RECORDS
TO BE KEPT AND FURNISHED TO THE POLICE DEPARTMENT; PROVIDING
FOR VISITATION AND EXAMINATION OF THE PREMISES AND GOOD5 BY _THE
POLICE DEPARTMENT; PROVIDING A PENALTY; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH; ADOPTING THE STATE LAWS REGULAT-
ING PAWNBROKERS; AUTHORIZING THE PUBLICATION OF THE CAPTION
AND PENALTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE,
WHEREAS, pawnbrokers often take in pawn articles of various descrip-
tions and assume the possessor thereof to be the true owner; and,
WHEREAS, many stolen articles find their way into pawn shops and in-
adequate provisions are now provided for the location of such stolen articles;
and,
WHEREAS, the protection of the public peace and property creates a
necessity for the enactment of this ordinance; NOW, THEREFORE,
BE IT C?RDAINED BY THE CITY COUNCIL QF THE CITY OF PARIS:
Section 1, That all laws and regulations provided for by the State Qf
Texas are hereby acbpted and made a part of this ordinance, and all pawn-
brokers shall be regulated, in addition thereto, by the provisions of this or-
dinance.
Section 2. It shall be unlawful for any person, firm, corporation,
partnership, or association to pursue the occupation of pawnbroker or to en-
gage in the business of loaning money or holding as security, goods, wares or
merchandise of any kind, without first having obtained a license therefor from
the City of Paris, Texas and displaying such license as herein provided.
Section 3. Every person, firm, partnership, corporation, or association,
before opening, maintaining or operating a business of pawnbroker, shall make
an application to the City Clerk for a license for each business place or estab-
lishment maintained or operated, upon a form to be furnished by the City Clerk,
which shall contain such information as the City Clerk shall require.
Section 4. A separate license and application shall be required for each
establishment or place of business, regardless of the ownership of such business.
Upon application and payment of the annual license fee, in the amount of Twenty-
Five ($25. 00) Dollars, the City Clerk shall issue a license to the applicant, which
license shall state upon its face the address and business to be conducted and name
under which the business is to be conducted, and such license shall be conspicuously
posted in the place of business of the licensee where it may be readily available for
inspection by the public.
Section 5. That licenses shall be due and payable on or before the lst day
of January of each year and shall be valid for the calendar year for which issued.
No licenses shall be transferrable or assignable and shall be valid for the use of
the licensee named therein only.
Section 6. That licenses shall be valid only at the address stated in the li-
cense, provided, however, that should a licensee desire to change his place of
business to another location he shall notify the City Clerk previous to the change,
and upon proper notification the City Clerk shall isSUe, without charge, a new li-
cense authorizing the operation of such business at the new location.
Section 7. That each and every person, firm, or corporation engaging in
the business of pawnbroker shall keep a complete set of daily records as furnished
by the City of Paris, which shall be written at the time of the taking in pawn of
every article, and shall contain a description of the article and the name and
address of the person offering such article for pawn and the amount loaned upon
such article and the final disposition of each article.
Section 8. That all articles taken in pawn by such licensee shall be num-
berea or marked in such a manner and in such detail as will make identification
of such article clear and positive.
Section 9, That the daily records required to be kept by this ordinance
shall be prepared in duplicate, and the duplicate or carbon copy of such record
shall be furnished upon request to the Police Department of the City of Paris,
Texas.
Section 10. That the daily record required to be kept by this ordinance
shall be open at all times to the examination and inspection of any police officer
of the City of Paris, Texas, under the direction of the Chief of Police, and upon
demand, the owner, manager, or employee of such business shall point out and
identify any article on the premises of the licensee.
Section 11. That it shall be the duty of the Chief of Police of the Police
Department of the City of Paris to furnish each licensee coming under the provi-
sions of this ordinance, with the daily records as described in Section 7 of this
ordinance, without cost to the licensee, and if the Chief of Police fails or neg-
lects to furnish such licensee with the daily records, no penalty for failure to
keep and maintain such daily records shall apply to such licensee, provided,
however, that nothing in this section shall exempt the licensee from purchasing
the license as required in this ordinance or the penalty provided for the failure
to do so.
Section 12. That it shall beimlawful and shall constitute a misdemeanor for
any person, persons, partnership, firm, or corporation, to violate any provision
of this ordinance, and shall, upon conviction, be punished by a fine of not more
than Two Hundred ($200. 00) Dol}.ars.
Section 13. That all ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby., repealed.
Section 14. That if any section, sub-section, word, or phrase of this or- _
dinance shall for any reason be held to be unconstitutional or invalid, such deci-
sion shall not affect the remaining portions of this orduance, but such remaining
portions shall remain in full force and effect.
Section 15. That the City Clerk is hereby authorized and directed to publish
the descriptive caption of this ordinance, together with the penalty clause as re-
quired by law.
Section 16, The effective date of this ordinance shall be immediately upon
passage and publication.
