1659 ORD CONTAINING HEARING ON PROPERTIES LOCATED AT 613, 619 AND 623 10TH ST SEORDINANCE NO, 1659 , AN ORDINANGE GONTAINING A HEARING ON PROPERTIE5 LOCATED AT 613, 619, and 623 lOTH STREET, S. E„ IN THE CITY OF PARIS, BE- LONGING TO J. M. HIX; AND AN C?RDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING IN THE PREMISES TO CONSTI- TUTE A NUISANCE AND TQ BE A FIRE HAZARD TO LIFE AND PRO- PERTY AND A HAZARD TO THE LIFE AND WELFARE OF THE INHABI- TANTS OF THE AREA, AND QRDERING SAID RUSBISH, LUMBER~ AND REFUSE FROM THE HOUSES, WHICH WERE T4RN DOWN, REMC?VED FRQM THE PREMISE5p IN ORDER TO ABATE SUCH NUISANCE, WHEREAS, a Public Hearing was, on this the llth day of November, A. D. , 1963, called to order by the Mayor of the City of Paris, C. L. Walker, at 7:00 o tclock P. M., in the City Council Room, in the City of Paris, Texas; and, WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed a date for hearing on the resolution referred to the Committee by the City Council on October 14, 1963, and that said Committee fixed said hearing at 1:30 P. M, , on October 30, 1963, and the hearing was had thereon. That proper notice was given to the owner and to the tenants in the structures located at 613 lOth Street, S. E. and 623 lOth 5treet, S. E. , and that said hearing was held in accordance with Ordinance No. 1470, passed by the City Council on the 9th day of March, 1959. That at said hear- ing, the Committee heard evidence from several persons residing in the immediate area of the properties involved, and had the benefit of pictures taken of various portions of the three structures and various portions of the premises involved. That the members of said Committee inspected and visited the structures and premises in question, and that said Committee found that each of the three structures were in such state of deterioration and dilapidation to create a serious fire hazard to life and property; that each of said buildings was dilapidated and was dangerous to life and pro - perty and was a dangerous structure to life and property. That said bui.ld- ings are in such a state of dilapidation and decay that neither of the three structures are capable of repair, The Committee further found that the condition of the premises and structures involved were such that the Committee recommended to the City Council that they be declared a nui- sance and that the owner and occupants be ordered by the City Council to tear down and remove the same from the lots involved. That said Committee filed a complete report of its hearing and its findings with the City Clerk of the City of Paris, on the 4th day of November, 1963, and furnished a copy to the owner, at 628 6th Street, S. E. , and to the tenants, at 613 lOth Street, S. E. and 623 l Oth 5treet, S. E. ; and, WHEREAS, the City Council has fully heard and considered the testimony presented upon this hearing and the complete transcript of the testimony re- ported by the Building Hazard Inspection Committee; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1, That the structures at 613, 619, and 623 lOth Street, S. E„ have been torn down by the owner, and that the two structures containing tenants have been vacated by the tenants. That much of the lumber is piled against the fence of adjoining lots and disorderly and scattered about the premises, and that the nails have not been removed from any of said lumber, and that the premises are left unguarded, which permits children to play on and about said stacks and piles of lumber. That the rubbish, lumber, and other materials are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the same is hereby declared a nuisance. That the owner, J. M. Hix., is hereby ordered and directed to remove said lumber, timber, rubbish, and other items, which are the remains of the razed structures, from the premises, and thereby abate such nuisance, within thirty (30) days from the date hereof. The City Manager is directed to furnish the owner, J. M. Hix., a copy of this ordinance. That in the event the owner, J. M. Hix., reiuses to comply with this order, the City Attorney, Ben P. Mooring, is hereby directed to proceed to enforce this ordinance by injunction in the District Court of Lamar County, Texas, as provided for in Ordinance Noo 1470.
