BE IT ORDAIIVED BY THE CITY COUNCI LOF THE CITY OF PARIS a Section 1, DEFINITIONS - The following definitions shall apply in the interpretation and the enforcement of this ordinance: A. MIIK - Nlilk is hereby defined to be the lacteal secretiont practi- cally free from colostrum) obtained by the complete milking of one or more healthy cows,, which contains not less than 8 percent milk solids-not-fat and not less than 34 percent milkfat. A-1. GOAT MIIK - Goat milk is the lacteal secretiong practically free from colostrumq obtained by the complete milking of healthy goats. The word "milk" shall be interpreted to include goat milk. B. NQLKFAT - Milkfat, or butterfatg is the fat of milk. B-lo CREAM - Cream is a portion of milk which contains nat less than 18 percent milkfat. g-2, SpUR CREAM - Sour cream is cream the acidity of which is more than 0.24 percentg expressed as lactic acid. B-3. LIGHT CREAM, COFFEE CREAM, OA TABIE CREAM - Li9ht creamg coffee creams or table cream$ is cream which contains less than 30 percent milkfat. g-4. WHIPPING CREAM - th'hipping cream is cxeam which contains not less than 30 percent railkfat. B-5. LIGHT WHIPPING CREAM - Light whipping creaaa is whipping cream which contains less than 36 percent milkfato B-6o HEAVy CREAM9 OR HEAVY WHIPPING CREAM • Heavy cream or heavy whipping creamg is whipping cream which contains not less than 36 percent milkfat. g-7, HpLF pNID HALF - Half and half is a product cnnsisting of a mix- tvre of milk and cream which contains not less than 11.5 percent milkfat. g..9, REpDN,'TITU'IED, OR REWNBINED 9 HAI.F ADID HAI.F • Reconstituted, or recombined, half and half is a product resulting from the combination of re- constituted milk or reconstituted skim milk with cream or reconstituted creamg which contains not less than 11.5 percent milkfat. g_g, yVHlppEp (REAM - Whipped cream is cream to which a harmless gas has been added to cause whipping of the product. It may also contain svgart other harmless flavoringg and a harmless stabilizer. C. CON(ENTRAIED WIK - Concentrated milk is a fluid product unsteri- lized and unsweetenedp resulti.ng from the removal of a considerable portion of the water frnm milk. When rec.ambined with waterg in accordance with instruc- tions printed on the containers the resulting product conforms with the stan-- dards for milkfat and solids-not-fat of milk as defined above. C-1. ODNCENTRATED MII1C PRODUCTS - Concentrated milk products shall be taken to mean and to include homogenized concentrated milk, vitamin D concen- trated milks concentrated skim milkg concentrated flavored milk, concentrated flavared drink, and similar concentrated products made from concentrated milk or concentrated skim milkv as the case may beg and whicht when recombined with water in accordance with instructions printed on the containerg conform with the definitions of the corresponding milk products in this section. G2. DRY AII1C --Dry milk is milk from which at least 95 percent of the water has been removed. D. SKIM MIIK - Skim milk is milk from which a sufficient portion of milkfat has been removed to reduce its milkfat content to less than 4 percent. D•1, NONFAT, FAT-FREEs OR DEFATTED MIIK - Nonfats fat-freep or de- fatted milk is skim milk which contains not more than 0.1 percent tnilkfat. D-2. SKIM-MIIK SOLID6 - Skim-milk solids shall be deemed to include wncentrated skim milk andnonfat dry-mi.lk solidg. D-3. NONFAT DRY-MIIIC SOLID6 • Nonfat dry-mi.lk solids shall mean nonfat milk from which at least 95 percent of the water has been removed. E. FIAVORED IuQIK - Flavored milk is a beverage or confection consirting of milk to which has been added a syrup or flavor made from wholesome ingre- dients. E•1. FIAVORED DRINK, OR FIAVORED DAIRY DRINK - Flavored drink, or flavored dairy drink, is a beverage or confection consisting of skim milk to which has been added a syrup or flavor made from wholesome ingredients. E--2. FIAVORED REDONSTITUTED AUIK - Flavored reconstituted milk is a flavored milk made from reconstituted milk. N Ah Alk Aww~ Agh E-3. FLAVORED RECON.STINTED DRINKs OR FIAVORED RECON.STIIUTED DAIRY DRINK - Flavored reconstituted drink, or flavored reconstituted dairy drinko is a flavored drink made frora reconstituted skira milk. E-4o MIIK OR SKIM-MIIK BEVERAGE - A milk beverage or a skim-milk beverage is a food compound or confection consisting of milk or skirri-milk as the case may beg to which has been added a syrup or flavor consisting of wholesome ingredients. F. BUTIERIuQIK - Buttermilk is a fluid pmduct resUlting from the churning of milk or cream. It contains not less than 8 percent milk solids- not-fat. MF-1. CULTURED BUTTERMTLK.-Cultured 4 buttermilk is a fluid product resulting from the ired milk is a fluid OT semifluid product souring or treatment, by a lactic acid or other cul- ;men.t9by a lactic acid OT other CUZtUTep Of ture, of pasteurized skim milk or pasteurized re- constituted skim milk. VITAtuQN D IuIIIK - Vitamin D milk is milk the vitamin D content of which has been increased by an approved method to at least 400 U.S.P. Units per quart. G-1. FORTIFIED MIIK ANQ I+ULK PRODUCTS - Fortified milk is milkg other than vitamin D milk, the vitamin and/or mineral content of which has been in- creased by a methodand in an amount approved by the health officer. Fortified milk products are those milk products defined in this ordinancel other than vitafnin D milk productsv the vitamin and/or mineral content of which has been increased by a method and in an amount approved by the health officer, and to which skim-rnilk solids may or may not have been added. The label shall con- tain the word "Fortified" and shall clearly show the amount and source of each vitamin and/or mineral addedo H. REGbNSTITUTED, OR RECOMBINED, MIIK - Reconstituted g or recombined, milk is a product which resalts from the recombining of milk constituents with waterg and which complies with the standards for milkfat and solids-not-fat of milk as defined herein. H.J. RECONSTITUTED, OR RECOtuBINED9 CREAM - Reconstituteao or recom- bined, cream is a,product which results from the combination of dry cream, butter,, or miTk`fat,°vaith creamp milkp skim milkp or watert and which coraplies with'the milkfat standards of cream as defined herein. H-2. REGnNSTITUTED9 OR RE(OIuBINED, SKIM AaIK - Reconstituted, or re- combined# skim rnilk is a product which results from the recombining of skim- r►ulk''constituents with water, and which contains not less than 8 percent milk solids-not-fat. J, HpNqGENIZED NIIK - Homogenized milk is milk which has been treated in such a manner as to insure bxeak-up of the fat globules to such an extent thato after 48 hours of quiescent storages no visible creamseparation occurs on the milkv and the fat percentage of the top 100 milliliters of milk in a quart bottle, or of proportionate volumes in containers of other 5izesldoes not differ bymore than 10 percent of itself from the fat percentage of the remaining milk as determined after thorough mixing. The word "milk" shall be interpreted to include homogenized milk. K. N[IIK PKODUCTS - Milk products shall be taken to mean and to include creamg sour creamp half and halft reconstituted half and halfg whipped cream, concentrated milk, concentrated milk productsg skim milkg nonfat milkg flavored milk, flavored drink, flavored reconst1tuted mk v~d~~,ceconstituted drinkg milk or skim milk beverage~ butterrnilk~j~cut`tu`re dm~ Pk.' vtan~n' D milko fortified roilkp fortified milk productsv reconstituted or recombined milk# reconstitated creamp reconstituted skira milkp and any other product made by the addition of any substance to milkt or to any of these milk productsp and used for similar }wrposedg and designated as a milk product by the health officer. L. PASTEURIZATION - The term "pasteurizationg""pasteurized'• and similar terms shall be taken to refer to the procsssof heating every particle of milk or m31k products to at least 143 degrees F., and holding it at such temperature continuously for at least 30 minutesg or to at least 161 degrees F.9 and holding it at such temperature continuously for at least 15 seconds, in approved and properly operated equipment: PMVIDgD that nothing contained in this defini- tion shall be construed as barring any other process which has beendemonstrated to be equally efficient and which is approved by the State health authority. M. ADULIERATED AND MISBRANDED MIIK AND MIIK PRODUCTS - Any milk or cream to which water has been addedg or any milk or milk product which contins any unwholesome substancgp or whichg if defined in this ordinancep does not conform with its definition, shall be deemed to be adulterated. Any milk or milk product which carries a grade labels unless such grade label has been awarded by the health officer and not revokedp or which fails toconform in any other respect with the statement on the label, shall be deemed to be mis- branded. N. MIIIC PRODUCER - A milk producer is any person who owns or controls one or more cowsp a part or all of the railk or milk products from which is soldv or offered for sale. p. MILK DISTRIBUTOR - A milk distributor is any person who offers for sale or sells to another any milk or milk products for hwnan consumption as such. O-lo PFtODUCER-DISTRIBUTUR - A prodvicer-distributor is a milk producer who is also a milk distributor. p. DAIRY, OR DAIRY FARM - A dairy,0 or dairy farmg is any place or premises where one or more cows,are keptl a part or all of the milk or milk products fram which is sold or offered for sale. p-1, PROD[C€R DAIRY - A producer dairy is a dairy farm which sends milk or cream to a milk plant for processing. p•2. MIIK HAUIER - A milk hauler is any personI other than a milk prodvicer or a milk-plant employees who transports milk and/or milk products to or froma milk plant or a collecting plant. Q. ZIK pIANT - A milk plant is any place# premisesg or establishment where milk or milk products are collectedg handled, processedg storedo pas- teurizedl bottledp or prepared for distributiong except an establishment where milk or milk products are sold at retail only. R. I-EALTH OFFICER - The term "health officer" shall mean the Directarr of the Department of Public Health a~dt~.3a~ce of the City of PTwOpOtolU ~ or his authorized representatives. R-1. STATE HEALTH OFFIGER - The term "State Health Officer" shall mean the State Health Officer of the State of Texas. S. AVERAGE BACTERIAL PIA1E Q}UNTq DZRECT MICRiOSCQPIC CAUNT9 AND (700LIA1G TEMPERATURE - Average bacterial plate count and average direct microscopic count shall be taken to mean the logarittumic averageg and average caoling temperature shall be taken to mean the arithmetic average of the respective test results of the last four consecutive samples, taken upon separate days, irre- spective of the 6-month period referred to in Section 6. T. PERSON - The word "person" shall mean any individualp partnershipp corporations, companyg firm, trusteeor association. U. AND/OR - Where the term "and/or" is usedo "and" shall apply where possible, otherwise "or" shall apply. Section 2. Tl-E 5AIE OF ADULIERATED, MISBBAAmED 9 OR UNGRADED hff I1C OR MI Lc PR0DUCTS PROHIBITED - No person shallp within the City of Paris or its police jurisdiction# produce, sellg offer or expose for salet or have in possession with intent to sells any milk or milk product which is adulteratedo misbranded, or ungraded. It shall be unlawful for any persong elsewhere than in a priitate home, to have in possession any adulteratedt misbranded, or un- graded milk oxmilk products PROVIDED that in an emergency the sale of ungraded pasteurized milk or pasteurized milk products may be authorized by the health officer, upon the approval of the State health authoritys in which case they shall be labeled "ungraded." Any adulterateds misbrandedp and/or improperly labeled milk or milk products may be in►pounded by the health officer and disposed of in accordance with State law. Section 3. PERMITS - It shall be unlawful for any person to bring into, send intop or receive into the City or its police jurisdiction, for sale, or to sell, or offer for sale there3n, or to have in storage where milk or milk products are sold or served, any mi.lk or milk products defined in this ordi- nance, who does not possess a permit from the health officer of the City. Every milk producer, milk hauler, milk distributor, and operator af a milk plant shall secure a permit. Ociy a person who complies with this ordin- ance shall lx entitled to receive and retain such a permit. Permits shall nct be transferable with respect to persons and/or locations. Such a permit may be temporarily suspended by the health officer upon violation by the holder of any of the terms of this ordinance, or for inter- ference with the health officer in the performance of his duties, or may be revoked after an opportunity for a hearing by the health officer upon serious or repeated violations. FEES. Every milk producer, milk hauler or operztor of a dairy or dairy farm shall make application to the Director of the Paris-L.anaar County Health Unit, upon forms prescribed and furnished by the Director, for z permit to pro- duce milk, operate and do business in the City of Paris. Such person shall pay therefor in advance the sUtn of Five ($5.00) Dollars, and thereupon shall receive a permit in writing to produce milk, operate and eb business in said City in accordance with the provisions of this ordinance, which permit, unless revokad as herein provided, shall continue in force until the end of the calendar year in which such permit is issued, and such permit shall be non-transferable and shall be annually renewed upon application and payment of a like sum in accordance with and sub3ect to the conditions and terms of this ordinance. Every rnilk distributor, whether of Grade A pastearized aailk and/or milk products or Grade A raw milk and/or milk products, and every operator of a milk plant doing business in the City of Parf.s or vvithin its police jurisdiction shzll maka applicati,an in writing to the Director of the Paris-Lamar County Health Unit, upon forms prescribed and furnished by said Director, for a per- mit to distribute milk and/or milk products and tooperate and do business in the City of Paris, paying therefor in advznce a fee of One Hundred Fifty ($150.00) Dollars for a permit authorizing such persvn, firm or ccpporation, to distribute milk and/or milk products and to operate and do btasiness in the City of Paris for a period of one year from the dafieihereof, and thereafter, at the end of each calendar month during such permit year every such milk distributor and/or operator of a milk plant shall make a written repat to the health officer showing the total amount of such milk and/or milk products pro- duced, processed and/or distributed in the City of Paris during such preceding calendar month. Upon receipt of such report, the health officer shall compute in accordance with the following schedule the additional fee to be paid by any such permit holder and prepare invoices therefor in triplicate, scnding one of such invoices to the permit holder, one to the City Clerk of the City of Paris, and retaining the third for his files. Thereafter, within ten (10) days from the date of such invoice, such permit holder shall pay to the City of Paris monthly the additional fee shoam by such invoice, such fee to be computed as follo A~ he pt~e o thirty (30) cents per one thousznd (1000) gallonq of e milk,pro6 c2d; process d'or distributed within the City of Paris. In the event that any person, firm or corporationshall operate in thc City of Pzris both a milk plant and as a distributor of milk and/or milk products, such permit holder shall be required to secure only one permit, and shall be required ta report only that phase of his operations which is the greater byvolume, that is his production or his distribution, whichever is the greater by voluune, and shall pay the fees hereinbefore prescribed for such operation. Any permit granted pursuant to the provisions of this Section shall be immediately revoktd by the Director of the Health Unit upon failure of any permit holder to promptly pay the fees prescribed by this Section, and such permit shall be non-transferable and shall be zenewed annually in accordance with and subject to the terms and conditions of this ordinance.
