1329 ORD PUBLIC WORKS DEPT OF COP IS DESIROUS OF OBTAINING ON BEHALF OF CITY AND PRIVATE CROSSING EASEMENT OR LICENSE FOR CONSTRUCTION/MAINTENANCE OF ACCESS ROADORDINANCE N0. 1329 .
Whereas, The Public Works Department of the City of
Paris is desirous of obtaining on behalf of said City a pri-
vate crossing easement or license for the construction and
maintenance of an access road across the St. Louis-San
Francisco 8c Texas Railway Company right of way and railroad
tracks at a point 1372 feet North of the centerline of Center
Street at its intersection with the centerline of said rail-
way right of way; and,
Whereas, said railroad company is willing to grant
such easement and license upon the terms and conditions spe-
cified in a proposed private crossing contract and a reement
dated September 13, 1954, being its Form 1521~ Local ~Revised
July 1952), upon the terms and conditions therein specified
and hereinafter referred to; and,
Whereas, it appears that the making and execution of
such contract and agreement on behalf of the City of Paris
is necessary, desirable and to the best interests of said
City; NOW, THEREFORE :
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
That the City of Paris enter enter into a certain pri-
vate crossing contract and agreement as proposed by and be-
tween the St, Louis-San Francisco & Texas Railway Company,
dated September 13, 1954, granting unto the City of Paris the
right to construct and maintain a private road crossing upon
the following terms and conditions:
(1) Said private road crossing, 14 feet in width,
extending 120 feet in an easterly and westerly direction
over the right of way and main track of the railway of
said railroad company, the centerline of which is at mile
582.64 in the Redding Russell Headright, Lamar County,
Texas at a point 1372 feet northerly measured along the
centerline of said ma.in track at its intersection with
the centerline of public road crossing at Center Street.
(2) Said roadway 40 feet in width will connect with
the private road crossing described above, the centerline
of which roadway tnrill extend southerly parallel with and
70 feet perpendicularly distant in an easterly direction
from the centerline of the ma.in track aforesaid, a dis-
tance of approximately 245 feet to the southerly right of
way line of the railroad company.
(3) The City of Paris shall provide and maintain
necessary drainage and construct and maintain the cross-
ing, except between the rails.
(4) Said railray company shallconstruct and maintain
the crassing between the rails for which the City of Paris
shall pay to said railroad company in advance the sum of
Fifty (00.00) Dollars.
(5) All other terms and conditions specified in said
above mentioned form, contract and agreement shall be in
full force and effect and binding upon the City of Paris.
The T~Iayor of the City of Paris is hereby authori.zed and
directed to make and execute such written contract and agreement
on behalf of the City of Paris and said City is hereby bound and
obligated to all the terms and provisions thereof.
This ordinance shall become eff'ective immediately upon
passage.
