VVHEREAS, Ordinance No. 1252, adopted by the City Council of the City of Paris on the 8th day of October, 1951, authorized and established certain rates and charges to be made by Southwestern Bell Telephone Company for various classes of service rendered in the City oi Paris by said company under franchise from said City; and, WHEREAS, by application dated October 20, 1954 duly filed with the City of Paris, presented vo and fully considered by the City Council, Southwestern Bell Tel.ephone Company has made formal applica- tion for an increase in local exchange rates and charges for the various classes of service; arid, GJHEREAS, extensive hearings on such application have been held and conducted by a committee of the Council under authorization of and from the Council, and report of its findings and recommendations duly made and submitted to the Council, iollowing which the Council by re- solution adopted on June 13, 1955 for:nally denied and rejected such application; and, _NHEREAS, Soui:hwestern 3e11 Telephone Company immediately following the action of the Couneil in denying such application for rate increases filed in the Sixty-Second Judicial District Court of Lamar County, Texas itsapplication and petition for a permanent in- junction wherein and whereby said company alleges that the telephone rates and charges authorized and established by the above mentioned ordinance No. 1252 have become confiscatoxy in that they do not allow and provide for a fair rate of return on the fair value of telephone company pronerty used and useable in connection with the operation and maintenance of the raris District Exchange, based upon which allega- tion the telephone company seeks under the protection of such injunc- tion to immediately place into effect a certain specified schedule of rates and charges for telephone services, which proposed schedule, rates and charges are, in the apinion of the Council, grossly excessive and will unquestionably produce earnings fcr the telephone company in excess of a fair rate of return on the fair value of the property of said company used and useable in connection with the operation and maintenance of the Paris District Exchange; and, u'JHER;A5, the nereinafter schedule of rates for local exchange telephone service will unquestionably produce for Southwestern 3e11 Telephone Company a fair rate of return on the fair value of such properties; and, WHEREAS, it is the opinion and belief of the City Council that the enactment and adoption of such hereinafter established schedule of rates and charges is in the best interests of the welfare of the City of Paris and telephone subscribers in said City in that the establish- ment cf the same is essential iri order to defeat the design and purpose of Southwestern Bell Telephone Company to place into effect a much higher schedule of rates and charges under the protection and authority of the permanent injunction which it seeks in the above mentioned suit pending in the Sixty-Second Judicial District Court of Lamar County, Texas; NOiU, THEREFORE: BE IT ORDAIPIED ?3Y THE CITY OOUNCIL OF THE CITY OF PARIS: Section 1. That Southwestern 3e1.1 Telephone Company be authorized and place inta effect on the lst day of August, 1955 the following schedule of rates for local exchange service in the Paris District Exchange in accordance with the provisi.ons of the Charter of the City of Paris and the franctlise granted to said company by said City, to-wit: ~ Class of Service Gne Party Business Flat Rate Business Extension Station Flat One Party Residence Service Two Party Residence Service Four Party Residence Service Residence Extension Station Commercial PBX Trunk Commercial PBX Station Semi-Public Service (Guarantee) Local Messages Under Guarantee-each Local Messages Over Guarantee-each Coin Telephone Charge Per Local Message Extension Semi-Public - Coin Extension Semi-Public - Non-Coin Monthlv Rate ~SD ~Q 0 tD 3 '0 See' a), below 1.50 .24 per day .05 (See Sec. .04 (See Sec. .05 (See Sec. 1.50 1.00 (a) The rate for a flat rate PBX Trunk is one and one-half times the rate for one party business flat rate service. Rates andcharges for miscellaneous services and equip- ment shall remain as heretofore established except as superseded by those rates and charges containEd in the Schedule of Miscellaneous Rates and Charges attached hereto and made a part hereof; provided, however, that Southwestern Be11 Telephone Company shall have -the right to file f-rom time to time with the City ;lerk different rates and chargeF for such miscellaneous services and equipment, such different rates and charges to become ef:ective 30 days after filing unless oi:herwise ordered by the City Council. 5ection 2. That authc>rity to increase tiie charge for local messages from coin box telephones to ten cents (10fl per message is hereby granted, to become effective when -the Telephone Company com- pletes equipment modifications necessary to the due rendition of telephone service frem such coin box telephones on this basis. With the making effective of a charge of ten cents for local messages from such coin box telephones, the rate to the subscriber to semi-public coin box telephune service shall be eight and three- quarters cents (8 3/4fl per message for calls over the daily guarantee and ten cents (10¢) per message for calls unc:er the daily guarantee. Sectirn 3. Al1 ordinances heretofore passed by the City Council of the City of Paris in ccnflict with any provision of this ordinance relatir.g tc the establishment of rates and charges for telephone service are here'oy repealed. Section 4. fJotning in tnis ordinance contained shall be construed now or hereaiter as limitino or modifying, in any manner, the right and power of ttie city under the law to regulate the rates and charges cf Southwestern 3e7.1 Telephone Comparly.
