1274 ORD SAFEGUARDING LIFE AND PROPERTY FROM ELECTRICAL HAZARDSORDINANCE N0. 1274 CAPTION ~ AN ORDINANCE for safeguarding life and property from Xlectrica,l hazards by regula.ting and providing for the stallation of electrical wiring devices and equipment, defining the scope of ~lectrical work covered by this 4rdinance, adopting the provisions and regulations of tte National Electrical Code as a minimwn standard for the installation of Electrical Wiring, providing that Electrical wires shall be encased in metallic conduit in certain instances and installations, specifying the number of outlets allowed per circuit,providing the manner in which service entrance shall be installed, providing for the regu- lation of installing Electrical Signs, requiring a permit to do Electrical work, providing fees for Electrical Permits and Inspections, providing for the office of Electrical Inspector and defining his qualifications and duties, creating an Electrical Board and defining its duties, providing for the Licensing of Electrical Contractors, requiring the registration of Journeymen Electricians, providing a penalty, providing a saving clause, and repealing all Ordinances or parts of Ordinances of the City of Paris, Texas in conflict with this Ordinance. SE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. Title. The title of this ordinance sha11 be "The Paris Electrical Ordinance". and may be cited as such and it will be referred to in this ordinance as "this Code". Section 2. Purpose. The purpose of this code is the practical safe- guarding of persons and of buildings anxl their corltents, from electrical hazards arising fmtn the use of electricity for light, heat, power, radio, signaling and for other purposes. Section 3. Scope. The provisions of this ordinance shall apply to all installations of and work done on electrical conductors, fittings, devices, motors, appliances, fixtures, signs and gaseous tubing, hereinafter referred to as "Electrieal Equipment", within or on public and private buildings and premises, with exceptions as provided herein. On all installations of electrical conductors or equipmerct hereafter made and all existing installations which are altered, a11 work shall be done in a manner that will conform with the requirements for a sufficient and safe electrical system. Repair and maintenance work shall b e such that if any electrical conductors or equipment are removed and later replaced., they shall be replaced in a manner which conforms with this codea Section 4. National Electrica.l Code ReAUlations Adopted. The Regulations la.id down in the National Electrical Code Qs approved by the American Standards Association, for ths installation of electrical wiring, devices and equiFxnent are hereby adopted as the minimum standard for the installation of all electrical - Adik ASk 2 wiring, devices and equipment of the City of Paris, Texas, except as otherwise specifically provided in this Ordinance, arrl the sane is hereby ma.de a pa.rt of this Ordinance as fhlly and to the same extent as if copied herein in full, provided that the present or current issue of said National Electrica.l Code and any subsequerit amendments thereto shall be cansidered as the "NATIONAL ELEGTRICAL CODE" as that term is used herein, and provided flirther, that in event of any conflict between the provisions of this Ordina.nce and said National Electrical Code, then in such event the provisions of this Ordinance shall govern. Section 5. Responsibilitv for Safe Work. This ordinance shall not b e construed to relieve from or lessen the responsibility or liability of ary party owning, operating, controlling or installing any electrical equiF.anent for daraages to persons or property caused by any defect therein, nor shall the City of Paris be held as assuming any such liability, by reason of the inspeetion or reinspection authorized herein; or the certificate of approval issued as herein provided; or by reason of the approval or disapproval of any equipment authorized herein. Section 6. Electrical Inspector. There is hereby created the office of Electrical Inspector. The person chosen to fill this office shall have had at least six years experience as an electrician, or shall be a graduate of an appraved School of Electrical Engineering, or a licensed Electrical Engineer with two years experience in the field of Electrical Engineering. He shall be appointed by the City Manager and shall perform the duties imposed upon him by this ordinance under the supervision and direction of the Director of Public Works. Section 7. Authoritv of Electrical Inspector. The Electrical Inspector shall have full police power and shall have the right to arrest any person who violates any of the regulations of this or•dinance. It shall be the duty of any manber of the Police Depart,ment to assist the Electrical Inspector in the exercise of such police power upon request of said Electrical Inspectoro The Electrieal Inspector shall have the right during reasonable hours to enter any building or premises in the discharge of his official duties for 3 the purpose of making any inspection, re-inspection or test of electrical equipment or installations thereat or therein. When any electrical equip- ment is found by an inspector to be dangerous to persons or property because it is defective or improperly installed, the person, fiim or corporation owning the e2$trical equipment shall b e notified in writing and shall have any changes or repairs made as required by the Electrical Inspector which , will place such equipment in safe condition. If such work is not completed within the period specified by the Insoector in the notice, the Inspector shall have the authority to disconnect or order the disconnection of electric service to the dangerous electrical equipmnto In cases of e.mergency, when rbecessary for safety ta persons or property, or when electrical equipment may interfere with the work of the Fi.re Department., the Senior Officer of the Fire Depa.rtment at the site shall have the authority to ijmediately cause the disconnection of any electrical equipmerrt. Seetion 8. Special Perm.ission. The Electrical •Regulations of this Code may be modified or waived by special permission in particular cases where such modification or waiver is reasonable, does not differ from the intent of the ordinance, and does not create an injustice. Such pezmission shall in all cases be obtained frcm the Electrical Inspeetor in writing prior to starting the work, and a copy of the permission shall be filsd in the office of the Dire ctor of Public Works, Section 9, E1e ctrical Contractor: License Required. The term "ELECTRICAL 00NTRAC'IbR" as used in this Ordinance is defined to mean and include any persono finn or corporation engaged in the business of, or holding themselves out to the public as being engaged in the busiress 4 installing or repairing, or con- tracting to install or repair any electrical wiring, conduits, fixtures, de- vices, apparatus and equipment for carrying, using or consuming ele ctrical energy for which a pemlit is required by the provisions of this Ordinance. QUALIFICATIONS. Before any person, finn or corporation shall engage in the business of electrical Contractor as defined herein, application shall be made ~ to the Ele ctrical Inspe ctor for license. The applicant sha]1 then be re- quired to appear before the E],ectrical Board and be examined as to his qualifi- cations to do elOctrical work. Any such applicant must make a grade cf severity - _ ~ ~ 4 (70) per cent on the examination given by the Board before being erititled to receive a license. Before a license shall be granted to an applicant, a fee of Fifty ($50•00) Dollars sha.ll be paid to the ~'ity of Paris, Texas, and the applicant shall execute and deliver to the City , for approval, a Bond in the sum of Five Hundred ($500.00) DoZlars, having as surety thereon a reeognized surety company authorized to do business in this State, said Bond to be conditioned for the faithflzl performance of all wark entered upon or con- tracted for, in strict accordance with the terms and requirements of this Ordinance. Such License when issued, shall entitle the holder thereof to en- gage in the busiress of Electrical Contractor for a period-of One (1) year fran the date of issuance, unless sooner revnked, and may be renewed by the holder upon pa.yment of an annual renewal fee of Fifty ($50.00) Dollars and a renewal of th e Borxi required herein. No license issued in accordance with the provis io ns of th is Ordinance shall be transferable. Any holder of a license who shall permit or allow same to be use d by an9 other pa rty to obtain a perm it to cb ele etrical uorc as spe cifie d in this Ordinance, shall be sub3ect to having such license revoked by the Dire ctor of Public Works. Section 10. Jaurneyman Electrician: Regist ration recuired. The term "Journeyman Electrician" as used in this Ordinance is defined to mean and in- clude any person who works Por or urxier the supervision of an Electrical Con- + tractor 4ad~-'installing or repairing electrical wiring, devices and equiFment. All Jouz•neymen Electricians before being pennitted to do any electrical work in the City of Paris, Texas, shall make application to the Electrical Inspectar for regist ration as Jaurneymen Electricians. Such Applicants shall be recgzired to appear before the Electrical Boa.rd and take an e.xamination as to his ex- perience and ability to do electrical work in accordance with the provisions of this ordinance. An applicant shall be required to rrake a grade of seventy (70) per cent or better, before he sha11 be~fentitled to registration as a Jaurneyman Electrician. TIA d*QftXcan,aerd7Ciciear.1,. The Board shall issue to every applicant that passes a ~ satisPactory examination, a Certificate of Registrationglupon payment of a ~ registration fee of Ten ($10.00) Dollars. Such Certificate of Registration shall be renewed by the holder thereof upon payment of an annual renewal registration fee of Ten ($10.00) Dollars. 5 A Journeyman Electrician to qua7_ify for an examina.tion before the Electrical Board must prove that he has had four years actual experience as an apprentice. In event any applicant fails to pass the examination given by the Board, he sha11 be entitled to a second exarnination after the expiration of Thirty (30) days, and should he fail on the second examination, a third exaraination shall not be had until the expiration of Two (2) Months from the date of the last examinationo ' The Inspe ctor shall be empowered to is sue a temporary permit to a Journeyman Electrician upon the payment of Ten ($10.00) Dollars fee and said permit shall be good until the first meeting of the Board. Nothing in this Section shall be construed to prohibit the employinent of apprentices or helpers working under the supe rvision of a registered Ele ct ric ian, Section llo Susp.etmi.on< of Registration and License. Upon presentation t,o F~~ r. the Director of Public Worksftthaholder of any license or certificate of registration issued under this ordinance has willful.ly or consistently violated any provision of this ordinance or is incompetent to comply with such provisions, or that such holder has been found guilty of violating such ordinance, the Director of Public Works shall fix a time and place for a meeting of the Electrical Board to consider such charges and shall notify such holder of sudl certificate or license to be present at such meeting. Such notification shall be in writing and shall be delivered to such holder at least five days prior to such meeting. Upon hearing such charge the Electrical Board sha.ll, by written opinion, determine ubether or not such charges are justified, and in the event of an affirrnative finding the certificate of registration or license of such holder, as the case may be, shall by said Board be revoked or suspended for a period of not less than thirty days and not more than two years. Section 12. Existing Licensesand Certificates of ftegistration. Any current license held by an electrical contractor or certificate of registration held by Journeyman electrician under the provisions of existing ordinances of the City of Paris, shall remain valid until the expiration of the same under such existing ordinance, but any application for renewal or renewal there#~ shall be subject to all the terms and provisions of this ordinancea I - AO. Aft~ - Amk b Section 13. Lapse of License or Certificate of Registration. In the event that any holder of a certificate i registration or license issued pursuant to this ordinance allows the same to lapse for a period of more than six months for any cause, any attempted renewal of such license or certificate of registra- tion shall be considered as a new applicationo Section 11+. Home Owners Rights. Notring herein contained shall pro- hibit any bonafide home owner from personally installing electrical conductors or equipinent within his own home provided that the oJmer shall fi.le with the Electrical Inspector approved plan: and specifzcations; sat:isfy the Electrical Inspector as to his ability to install electrical wiring; apply for and secure a nermit; pay required fees; do work in accordance vaith this ordir.ance; apply for an inspection; and receive certif icate of approval. Electric Signs. All classes of electric signs whether of the gas tube, sign re~tacle or reflector type, including gas tube window signs and autside building outlining sYall be considered electric signs within the meaning of this ordinance. :'ortabls inside displays or small signs using self- oontained transformers with currerit consumption not to exceed 200 watts ma.y be connected by attachment plug to present circuit providing all other requirements of this ordinance are complied with. All signs must be on separate circuits in conduit fncn the distributing panel and not more than 1320 watts will be allowed on each circuit. All signs except portable signs must be grounded directlj- to the conduit service. All signs must bear the Underwriters Laboratories, Inc., inspection label or sha.ll be inspected and approved by the Electrica.l Inspector before being installed. When an electric sign is to be hung over the si.dewalk there must be a clears:nce of eight (8) feet from the siclewalk to the lowest point of the sign and no sign shall exterxl to within two (2) feet of the curb line of sidewalk, except by spe cial permis sion of the Ele ctrical Inspe ctor, Section 19a. Tanporar:y Permits. Upon application therefor the Electrical Inspector may, in his discretion, issue a temporary permit authorizing the con- nection of service tc> any building or electrical installation for a period r,ot to exceed ten (10) days in cases where the immediate connection of such service i.s by him considered necessary, desirabls and reasonably safe, provided that it appears that applicant for such temporary permit can and will qualify for a regular permit under the provis ions of this ordinance wit hin a reasonahle length of time. A fee of Two ($2.00) Dollars sYall be paid by the applicant for any such temporary pemit and the same may be renewed from time to time for periods not in excess of ten (10) days, at the discretion of said Electrical Inspector~ a ~ , Y. s:~~. _ y Alk .r. AML a 10 Section 20. Caridemnation. If, in the judgm+erit of the Electrical Inspector after inspection, any electrical installation is unsafe or dangerous to persons or property, the Inspector sha.ll have the pawer to cause such electrical installation to be disconnected from the source of electrical energy supplying the same, in which event he shall notify the Texas Power and Light Company oi such action. Thereafter, it shall be unlawful for any person to cause or permit electric current to be supplied to such electrical irBtallation until the same shall have been made safe and the inspector shall have issued a certificate of approval to that effect. When the Electrical Inspector condemns all or any part{of any electrical installation, the owner may, withiti five days after receiving written notice thereof, file a petition in writing for review of said action of the Electrical Inspector by the Electrical Board, such petition to be filed with the Dire ctor of Public Works, and upon recei.pt of such petition the Director of Public Works shall arrange for a meeting of said Board and said Board shall make a decision in accordance with its findings within seven (7) days after the filing of such petition, which decision shall be final. Section 21. Electrical Board. There is hereby created an Electrical Board, which shall consist of five members, one of whom shall be the Fire Marshal of the City of Paris, one shall be an electrical contractor licensed under this ordinance, ore shall be ajourneyman electrician who holds a certificate of registration under this ordinance, one shall be an owner of rental property within the fire limits of the City of Paris, and one shall be a general building corYtractor engaged in the general construction busi- ne ss in the City of Paris. All such Board Membe rs, except the Fire Marshal, shall be appoint ed by t he City Council and sh all hold offi ce for a period of two years from the date of their appointment and qualification, or until their successors have been appointed and qualified. Any member of the Board may be removed for cause by the City Council upon reooomndation of such removal for a cause by the City Mana,ger, or may be removed by said Ceuncil without such recom¢nendation if it finds that the removal of a member or members is for the best interests of the public. Ah Adak _ i u Upon the failure or refusal of ang manber of said Board to qualify as a member thereof, or in the event of a vacancy in such Board for any cause, the City Council sha11 immediately appoint a qualified person to fill the unexpired terra for any such vacancy. It shall be the duty of the Board to pass upon the qualifications of all persons, firms, or corporations, applying for eertificates to do electrical work as defined in this ordirance in the City of Paris. There sha11 be issued certificates to such persals, firms, or corporations, as shall pass a satis- factory examination as herein referred to, but this certificate shall not authorize any one to enter into a cantract for or do any installation, maintenance or repa.ir of any electrical work unless such person shall have paid his annual registration fee as required by this Code. ` ~ ~ , 5.,:;~`~►: tim w awrparati:oa aiq riL su appeal wM Board for a review of any decision of the Electrical Inspector, provided that su ch appeal is made in wrriting within five (5) days afte r su ch pe rson firm, or oo rporation shall have been notified of such decision by the Electrical Inspector. Such appeal shall be taken by the filing of written notice thereof with the Director of Public Works, upon receipt of which the Director of Public Worlcs shall immediately call and arrange for a meeting of said Board, and said Board shall proceed to determine whether or not the action of the Electrical Inspector complies with this ordinance and within seven (7) days shall ma.ke a decision in accordance with its findings, which decision shall be final. The Ele ctrical Board shall keep a Minute Book in whi ch shall be re- corded all trarxsactions and business of the Board. The Minute Book and other rewrds shall be kept in a manner designated by the Secretary. Section No. 22. Texas Pawer and Li#it Company, its agents or employees, shall ma.ke all connections fmm the prnrrer lines to the electric service installations. It shall be unlawful for any ather person or persons to do so. Section 23. All Circuses, carnivals and road shows using portable equipanerit shall anploy a licensed electrical oontractor to supervise all electrical installations. Section 21+. It shall be unlawflzl for any person, firm, or oorporation Ak .dhok .mb, a 12 to sell, expose for sale, offer to sell, dispose as a premium or offer far rent and repair any electri cal material, conductors, eqaignent, apparatus or appliance within the City of Paris which is not approved by the Electrical Inspectar, or beari.ng tYe Underwriters seal of approval. Section 25. It shall b e unlawful fo r any pe rson or persons to use slugs, pennies or any method of abridgment of fuses, ftiase blocks or in any wa,y defeat the pu rp ose of a flzs e or cir cu it b reake r. Section 26. All fees accumulated by this ordinance shall be paid to the ~ity ~i ~~y for deposit to the account of the City of Paris, Texa.s. Sectim 27. Pena.lt . Any person, firni or coYporation who sha11 violate any of the provisions of this ordinance sha11 be deemed guilty o£ a mis- - demeanor, and upon oonviction therefor, sha.ll be fined in any sum not exceed- ing Twa Hundred ($200,00) Dollars, and each and every day's cortinuance of any viola.tion of the prarisions of this ordinance shall constitute and be deemed a separate offense. Section 28. Validit,y. If any Section, Sub-Section, clazse, or phrase of this ordinance shall for any reason be h3t1d to be unconstitutional or i.nvalid, such holding or decision shall not affect the validity of the re- maining portims of this ordinance. Section 29. Repeal of Ccnflicting Ordirances. All ordinances or parts of ordirrances of the Cit,y of Paris, Texas conflicting with the pro- ~y~`~,; visio ~this ordinance are hereby repealed. ,~V~^fi~ox. /y V 1 .
