Tri-G._ A.'~.r~t..e..ti.~. ~...P~A.r.tS~_....._..... mt 0sm 1rithin such City and has by proper ordinance authorized the State to enter upon and improve and/or maintain or assist the City in the improvement and/or maintenance of said project; and Whereas, the State HigYiway Comraission under date of Agproved a , program of wcrk which includes the project described above, and Whereas, the State Highway Engineer, acting for and in behalf of the State Hi6h- Fray Cornm.ission in activating such progra.m, hus made it kn.own to the City that the Sta.te wi)1 assist the City in the im_provement and/or maintenance of gaici street project by l`~usniehing the funds necessary to construct, reconstruct or otherwise place said straet in a condition to properly serve motor vehicie traffic thereon by pre,parirg plana for said improvement and supervising the construction, reconot-ructioai or betterment work as prcvided in said plang or may be provided in said plans cor_di- tioned that the CitJ, as contemplated by Senate Bill 415, Acts 46th Legislature, Regular Session, will enter into an agreement with the State for the purpose of determ..inirg the liabilities and responsibilitioe of the parties with reference there- to, determining and providirg adequate and a.ppropriate raeane for the reg,:latyarl of tra;fic, policing and maintenance of the project upon completyon, and, providel further, that the City approves the plang, specifications, alignm.en-ts ard grades oi the prcject; and, provided flzrther, that the City will in3ernnify the State agair_st all dama;es to ad joining, a.butting or other prcperty occasioned by or resulting f:.rom the iristallation, construction, existence, use or maintenance of said street proj- ect and thE passa.ge and en,.'orcement of the ordinance herein referred too 9-45-937 1 D-8 r Adh - AMN~ IdilL Admk A G R E E M E N T Now theref'ore, in consideration of the premises and of the mtztual covenants and agreements of the parties nereto to be by tham reepectively kept and performed as hereinafter eet forth, it is agreed as follows: 1lie Sta-i;e, as itU cnntribution to the improvement of said street projecti will prepa,re or providE for the plra.ris and epecifications, advertise fer bids, and let the construction contract, or otherwise provide for the construction, and will supervise the construction, reconstruction or bettermont work a,s required by said p1ans, and will pay thA cost of those items indicated on the p1.ans as to be pa,id for by the Sta,te, As long as the city etreet is a desigiated highway, the Sta,te will mainta.in said street project except those portions as m,,y be made the City's obliga.tion as mutually a,greed to by the parties hereto. The State will maintain sa,id street project or such portions thereof or extensions thereto as may be indicated on sa,id p1E+ns for State maintenance, a,n,d sucli other portione a,s may be mutua.lly agreed to by the partiee hereto. 'I'he City, in consideration of tho mutual coveriants nerein contained, does hereby agrec to and doeg hereby authorize the State to improve or a.ssist in the improvement of sa.id street pro,ject at the location, to the grades and in the maruzer ahewn on the plans, which plans when approved by both pa..rties hereto wiL1 be a.ttwched hereto, marked "Exhibit A" and berome a part hereof in all respecte. The City will proTide for sa.id street project a. rignt of w^.y frec of all obstructions and of a. width sufficient to properly provide for the improvements shown on the plans, without cost to the Stato and will not, in the future, pernv.t encroachments on stid right of way. The City will provi(ie a.t its own expense for the insta,llation, raising, lowering, removal or other necessary ad,juatment of any and all_utilities or services, whether publicly or privately owned, as may be necesgary to permit proper iinprovement, maintenance and use of said atreet project, ar?d, failuro of the City to promptly caxry out this provigion upon the written reque9t of the engineer shall, if such dela.y reoult3 in additiona,l erpense to the State, be the direct charge and oblioation o]" thc City. . Tne City a,gree3 to pay to the Sta.te pror.mptly the the su'agrade or surfacing made necesga,ry by rcaecn of Xemova,lor a3justment or an.y such publicly or privati rvices, which may occur after 'Uhe completion of the cogt of ma.king repairs to the instGllation, repair, :ly owned utilities or street project. The City agrees that it will refrain from passing an, ordinance fixing a speed limit on the a,bove mentibned street project of under twenty (20) milee pAr hour nor ti;ll it allow the erection of signe, aema.phores and/or si pnale that will give prefer.ence to loeal routes which intersect with the sa.id street project, ner that will slow up, hinder or delay traffic on eaid above mentianed atreet pro,ject. Th;; CiUy will at its own expenae ma.intain all etreet lights, traffic lights and 3i&-ia1 devices on said project, a.nd sweep, flueh and otherwiae keep said street pro,ject in a clean and sanitary conditinn. 2 9-45-93 '1 D-8 Agk .
