BE TT ORDAINED BY THE CITY aOUNCII, OF THE: CITY OF PARIS:
Seci:ion l:- That in the construction and apnlication of tYris
Ordinance, the follov+ing definitions of words anc phrases shall be adhered
t0 :
(A) The word "vehicle" as used herein shall mean any
device upon which or by which any pe.rson or property is or may be trans-
ported upon the highwaJs, streets or road, except those operated upon
rails or tracks.
(B) The word "park" or "parking" when used herein shall
mean the standing of a vehicle, whether occupied or not, otherwise than a
temporarg stopping of such vehiclp for the purpose of and while actuallT
engaged in loading or unloading passengers or merchandise, or an involuntary
stopping of the vericle by reason of causes beyond the control oi the
occupant of the vehicle.
(C) The word "parking space" as used herein shall mean the
space or section of the street adjacent to the curbing and bounded and
indicated by painted lines unon the surface of the street, extending from
the curbing into the street adjacent to and adjoining a parking meter.
(D) The words "loading zone" when used herein shall rnean
the space or section of the street adjacent to the eurb set aside for the
excl.usive use of loading or unloading passengers, supplies or merchandise.
(E) The word "person" when used herein shall mean one or
more individuals, partnerships, essociations or corporations.
Section 2:- That the parts of the streets in the City of Paris,
described in Section 4 herein, are hereby established and designated as
parking meter zones, and in such zones or such other zones as may hereafter
be created, the City is hereby authorized to install parking mters and to
designate parking meter spaces in accordance with the provisions of th is
Ordinance.
Section 3:- The Cit,y is hereby vested witra authority to enter
into a contract forthe purchase and :installation of parking meters, the
nwnber and style of which shall be discretionary with the City Council of
said City and said number may be increased as the cixcumstances warrant.
Said parking meters are to be paid for exclusively from the receipts from
said meters. The City of Paris is in na way obligated to pay the purchase
price of said reters out of any funds, moneys or revenues of the Gity of
Paris, except from the receipts received by said City from the operations
of said meters. The funds here auth.orized to be paid as the purchase price
of said meters shall never be considered in determining the constitutional,
statutory or other local limitations imposed upon the City with respect to
its power to create debts.
Section 4:- The following described streets and parts of
streets in the City of Paris are hereby designated and established as

That no parking meter shall be installed nor parking
of vehicles shall be permitted in the reserved space adjacent
to or adjoining any Pire hydrant, theatre entrance or hotel en-
tranee.
Provided further that any vehicle of the Police or r'ird
Departme.nts, while in th e discharge of the official duties sha].1
not be affected by any provisions of this ordinance.
Section 5:- That all parking meters shall be placed
upon the curb negt to individual parking spaces and said metere
shall be so constructed as to display a signal showing legal
parking upon deposit therein of the proper coin, or coins of
the United States according to the provisions of this ordinance,
as indicated upon said meters, regulating the parking periods of
the Cit y of Paris; and signa 1 to remain in f ull view until ex-
piration of said pa rking pariod. That said parking sbaces shall
be indicated by painted lines upon the surface of the streets in
said gar king mete r zones, as herein provided.
Section 6:- That when any vehicle shall be parked
next to a parking meter, the own.er or operator of said vehicle
shall park within the area designated by the curb and street
marking lines as indicated f or parallel or diagonal parking; and
upon entering any of said parking spaces situated in Zone I,
as hereinabove set o ut, the owne r or operator of said vehicle
shall immediately deposit in said parking meter a five cent
coin of the United States of America which shall entitle him
to the maximum lE gal parking limit of one (1) hour, or a one
cent coin of the IInited States of America, for twelve (12)
minutes legal parking tirne; provided, however, that the legal
parking time Por parking a vehicle on the 'Kest side of First
Street N. `!J. between the Plaza and a point 83 feet North of
the intersection of First 3treet N. VV. with the Plaza, or on
the Las t s id e of F'ir st Stree t S. VY . betwe en the Plaza and a
p4int 83 feet South o f the intersection of First `:')treet S. uY.
and the Plaza,shall be fifteen (15) minutes upon deposit in
par king meters located on such streets of a one cent coin of
the Uni ted State s of America ; and upon enterin , any of said
parking spaces situated in Zone II, as hereinabove set out,
the owner or operator of said vehicle shall immediztely de-
posit in said meter a f ive cent coin of the United 6tates of
Amer ica which shall entitle him to the maximum legal parking
limit of two (2) hours. It shall be unlawPul for any person
to fail or neglect to deposit the proper coin, or coins, upon
entering said parking space, or fail to park within said desig-
nated area.
Section 15:- That it shall be unlawful and an offaeviceooreposit
or cause uo be deposited w:ithin az y parking meter any slug,
substitute for a five cent coin of the United States of America, and of a
one cent coin of the Uni_ted States of America.
Section 16:- Ar~y individual, partnership, association or
corporation w=aviolate or permit or allow angone prdinance lshalltroi
or supervision to violate Sections 6, 7, 8 or 9 of thi.s s
upon conviction, be fined not less than One ($1.00) Do_llar and no costs.
Section 17:- Any individual) partnership, association, or
corporation 770sha violate or permit or allow anyone under his super-
vision or control to violate Sectio ns 1lt or 15 of this Ordinance shall
upon comTiction be fined not less than Five($5.00) Dollars nor more than
Twenty-five ($25.00) Dollars and aosts.
Section 18:- That the Chief Executive officer of the City of
Paris, `Pexas, shall desionate some person or persons to make collections
of all mone,y deposited in said pa.rking m~ters. It shall be the duty of
such person or persons so designated to remove from the parking meters
the coins so deposited in said meters, and to deliver such coins to the
Direct,or of Finance of the City o.f Paris, Texas.
It sha7.1 be the duty of the -)irector of Fi.nance of the
City of paris, Texas, to count all money so delivered to him and to
deposit such money to the credit of the City of Paris, `iexas, in the
City denository in a speci.al fund called "PARKIIJG ~vETER FUND", whieh
said fund shall be disbursed upon, the order and under the dire6tica2Y:
the City Council of the City of Yaris.
Section 19:- That Ordinance No. 1054 and all other ordinances
and parts of ordinances inconsistent or in conflict with any of the terms
or provisions of this Ordinance are hereby expressly repealed.
Section 20:- That if any sect=ion or pro-Tision or part of this
Ordinance shall b ged invalid or unconstitutional by a>COurt of
competent jurisdiction, such adjudication shall not affect the validity
of this Ordinance as a whole, or of any section, provis_on or p rt thereof
not so adjucxged invalid or unconstitutional,
Section 21:- That the fee required to be deposited in said
msters is hereby levied as a police regulation and inspection fee to cover
the cost of providing parking spaces, parkin; meters and installation a'1d
maintenance thereof, the cost of regulation and inspection, operation,
control and use of the parking meter spaces and zone s created herein; for
the regulation and control of traffic molTing in and out of, and parking in
said parking spaces and zones sa created; and for the cost of any resultant
traffic admir.istration expense.
Section 22:- This Ordinance shall become effect ive on March 18,
1949, such date being not less than ten (10) days from the date of the
passage of this Ordinance.

Section 7:- That if a vehicle shall remain con-
tinuously parked within aParking space for a period of time
longer than the parking limit for such parking space, as shown
by the indicator of said Pa.rking meter, said vehicle shall
be considere d as parked overtime. The parking of a vehicle
overtime, or beyond the time as paid f'or, as provided for
in this ordinance, shall constitute a violation of this or-
dinance, and shall subject said person violating same to the
penalties provided in Section 16 hereoP.
Section 8:- That it sh.all be unlawful and an offense
f'or an y person operating a vhhicle to allow said vehicle to
remain sta nding or parked upon any of the streets within any
of said peLrking spaces within the meter zones described herein
where parking meters are installed , for a longer continuous
period than one (1) hour in Zone I, or for a longer continaous
period than two (2) hours in. ?one II, without Paying an addi-
tional fee.
Section 94- That it shall be unlawful and an of fense
fcr any person to a11ow, permit or suffer any vehiele registered
in his name to be pal-ked outside of or over the lines of any
parking space, described in this Ordinance; to be parked over-
time in any parking space; or to remain parked for a longer
period of time continuously in said parking space, than the
parking limit provided f ar.
Section 10:- That the provisions of Sections 6, 70
8 and 9 shall not apply bePore 8:00 o'clock A. M., nor after
6:00 0' cloek P. "l. , on week days, nor on ~undays or the Pol-
lowing ofPicially de$ignated holidays: Sanuary l, July 43
Thanksgiving Day as proclaimed by the President of the United
Stat e s of Amer ica , and Dec embe r 25. On Saturdays, however ,
said rrovisions shall apply Prom 8:00 o'clock A. M. to 9:00
o' clock F. M'.
Section 11:- That the City of Faris, Texas, shall
be authorized to establish, designa oek r~ bg appropriate-
inarkings upon the surface of streetswlti.ldentify
in said parking meter
zones such "loading spaces" as are,in the opinion of the City
Council, necessary for the conduct of business within said City,
and narking metera shall be omitted from such loafling zones.
And provided, that it shall be an oPPense for any person to
stop or park a vehicle within such loading zones except for the
exclusive use of same Por loading or unloading passengers,
supplies or merchandise.
3ection 12:- That it shall be the duty of each trafPic
or other o fi~cer to make a written record of the nu.mber of any
parking meter at which any vehicle is illegallg ~arked, as pro-
vided by this ordinance, and to make,at the same time, a written
record of the State 1 icense number of s uch vehicle; and such
officer shall promptly report the same to the Folice Department
and shall promptly file a legal complaint of any 8iolation of
this or(iiilance, said complaint to be in the f orm as provided
by the laws of the City of Faris, Texas. aaid Police Officer
ehall, at the same time he makes the record of the parking meter
number and the License number of said vehiele, make a duplicate
of such reco rd upon a card to be placed in a conspicuous place
on s uch vehicle so illegally pa rked. The original of this ticket
shall be Piled with the Corporation Court of said ~;ity.
3ection 13:- That when par:Ang meters shall have been
insta lled as provided herein, that the regulation, control,
operation and use provided for in this Ordinance and the
maintenance of said parking meters shall be vested in the
City Council of the Jity of ='aris, Texas.
Section 14:- That it shall be unlavaful and an offense
for any person to deface, injure, ta mper with, open or will-
fully break, destroy, or impair the usePulness of any parking
meter installed under the terms a nd provisions of this ordi-
nanc e.
