WHEREAS, the City of Paris did heretofore in 1952
procure an easement for the purpose of constructing a main
interceptor line from the City of Paris to the Camp Maxey
Sewer Treatment Plant; and,
WHEREAS, a portion of said easement crossing lanci
currently owned by Richard B. Swint and wife, Susan B. Swint
has been replaced with a line constructed upon an easement
from Richard B. Swint and wife, Susan B. Swint to the City
of Paris, dated September 14, 1982, recorded in Book ,
Page , Deed Recor_ds, Lamar County, Texas, for which a
part of the consideration for- the same was the abandonment
of the easement containing the by-passed line with the City
of Paris retaining the right to use the old line for by-pass
purposes when necessary for repair of the new line or
construction on the new line; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY

of the County of Lamar and State of Texas, acting by and
through its duly authorized officer, Joe Graham, Mayor, he
being duly authorized by Resolution No. , passed by the
City Council of the City of Paris, on the lOth day of
January, 1983, a copy of whicYi is attached hereto as Exhibit
A, for and in consideration of the sum of TEN AND N01100
DOLLARS ($10.00), and other good and valuable consideration,
to it in hand paid by RICHARD B. SWINT AND WIFE, SUSAN B.
SWINT, of the County of Lamar and State of Texas, the
receipt whereof is hereby acknowledged, has quit claimed,
and by these presents does quit claim, unto the said RICHARD
B. SWINT AND WIFE, SUSAN B. SWINT, a11 its rights, title,
interest, claim and demand not herein expressly retained in
and to all that certain tract or parcel of land situated in
Lamar County, Texas, and described as follows:
Situated about 5 miles North 20 Deg. East of
the City of Paris, County of Lamar, and State of
Texas, a part of the Thomas Askins Survey #6.
BEGINNING at a stake for corner in the West
Boundary Line of Stillhouse Road at the present
Southeast corner of a 45 acre tract of land,
conveyed Bedford B. Harlan by deed recorded in
Vol. 319, Page 550, of the Deed Records of said
County and State;
THENCE West a distance of 1097 feet to a
stake for corner;
THENCE South 86 Deg. West a distance of 200
feet to a stake for corner;
THENCE West a distance of 644 feet to a stake
for corner at the Southwest corner of said 45 acre
tract of land;
THENCE South 2 Deg. West a distance of 452
feet to a stake for corner at the Southeast corner
of a 7.11 acre tract of land conveyed Bedford B.

for corner at the present Southeast corner of said

Stillhouse Road at 506 feet being the Northeast
corner of a 25 acre tract of land shown as Tract 1
in deed to Bedford B. Harlan as recorded in Vol.
317, Page 593, continuing on a total distance of
2218 feet to the place of beginning and containing
224.78 acres of land.
Being the same property described in deed
from Dixie Ann Harlan to Richard B. Swint and
wife, Susan B. Swint, dated December 29, 1971, of
record in Book 532, Page 182, Deed Records, Lamar
County, Texas.
with all and singular its rights, title, interest, estate,
claim and demand in and to the hereditaments and appurte-
nances thereto belonging or in any wise pertaining; to have
and to hold the above released rights, titles, interests,
claims, and demand, to the said RICHARD B. SWINT AND WIFE,
SUSAN B. SWINT, their heirs and assigns, forever, so that
neither the CITY OF PARIS, nor its successors or assigns,
nor any person or persons claiming under it, shall at any
time hereafter, have, claim or demand any right or title to
or interest in such property, premises or appurtenances, or
any part thereof, at any time hereafter.
HOWEVER, IT IS EXPRESSLY EXCEPTED from this Quit
Claim the right of the CITY OF PARIS of by-pass into the
abandoned main interceptor line extension which crosses the
above described property for purposes of repair or con-
struction upon the newly constructed line which is located
within the easement from RICHARD B. SWINT AND WIFE, SUSAN B.
SWINT to the CITY OF PARIS, dated September 14, 1982,
recorded in Book , Page , Deed Records, Lamar
County, Texas, which easement is expressly excepted from
this Quit Claim.
