83-035 RES COP DID ADVERTISE FOR BIDS EARTHWORK AT PARIS SANITARY LANDFILLRESOLUTION N0. 83-035
WHEREAS, the City of Paris, did advertise for bids
earthwork at Paris Sanitary Landfill, which bids were
received until 10:00 o'clock A.M., Wednesday, June 1, 1983;
and,
WHEREAS, the best bid for such earthmoving was made by
D. L. Lennon, Inc., P O Drawer 1308, Commerce, Texas 75428,
and it should be awarded the bid for such earthmoving; and,
WHEREAS, the award and letting of the bid for such
construction is subject to concurrence by the Federal
Aviation Administration; and,
WHEREAS, the form of contract for such earthmoving
project is attached hereto as Exhibit A, and such form
should be approved; NOW, THEREFORE,
BE IT RESOLVED BY THE
PARIS, that the bid of D. L.
Paris Sanitary Landfill, in
hereby accepted and let, co
meeting all of the terms and
bid documents; and,
CITY COUNCIL OF THE CITY OF
Lennon, Inc., for earthwork at
the amount of $106,530.00, is
nditioned upon said contractor
specifications included in the
BE IT FURTHER RESOLVED, that the Mayor of the City of
Paris, Joe Graham, be, and is hereby authorized and directed
to execute on behalf of the City of Paris the contract for
earthwork at Paris Sanitary Landfill, upon the terms and
conditions and in the form shown in Exhibit A attached
hereto, with D. L. Lennon, Inc.

CONTRACTOR.
WITNESSETH: That for and in consideration of the payments and
agreements hereinafter _mentioned, Party of the Second Part (CONTRACTOR)
herebv agrees with Party of the First Part (OWNI?R) to commence and com-
plete the construction of certain improvements described as follows:
Furnish all labor, liability insurance, supervision & perform all
operations involved in the excavating, transporting, and spreading as
cover material in designated areas, approximately 67,000 cubic yar.ds of
earth at the Paris Texas Landfill, and to perform trte work in accordance
witll the specifications and contract documents.

the General Conditions of the Agreement and at his (or tlleir) own proper
cost a►Zd expense to furnish all the materials, 'supplies, macliinery, equip-
ment, tools, superintendence, labor, insurance and other accessories and
services necessary to complete the said canst,ruction, in accordance with
the conditions and prices stated in t11e Proposal artached hereto, and in
accordance with the Notice to Contractors, General and Special Conditions
of Agreement, Plans and other drawings and printed or written explanatory
matter thereof, and the Specifications and addenda therefor, as prepared

herein entitled the ENGINLLIZ, each of which has been identified by the
CONTRACTOR and ENGINEER, together with CONTRACTOIl'S written
Proposal and the General Conditions of the Agreement hereto attached,
all of wh ich are made a part hereof a nd collectively evidence and consti -
tute the entire contract.
11ie CONTRACTOR hereby agrees to commence work within ten (10)
days after the date written notice to do so shall have been given to him,
and to substantially complete the same by Augus t 22, 1983.

such eatensions of time as are proviaed by Section II F, Time and
i~otice of Performing Work.
T11e OWNER agrees to pay the CONT]ZACTOIt in current funds the
price or prices shown in the proposal, which forms a part of this con-
tract, such payments to be subject to the General and Special Conditions
of the contract.
