WHEREAS, the City Council
desirous of inviting the State
Public Transportation Division
assist the City of Paris in the
on highways inside the City ot
Texas warrants; and,
of the City of Paris is

WHEREAS, in order to receive the assistance of the
State Department ot Highways and Public Transportation it is
necessary to enter into an intergovernmental agreement a
copy of which is attached hereto as Exhibit A, which should
in all things be approved and which would be in the best
interest ot the City of Paris to execute; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Mayor of the City of Paris, Joe Graham, be
and he is hereby authorized and directed to execute Traffic
Signal Agreement Type B; Freeway Type B, torm date 10-76,
D-18 in the form as shown on Exhibit A attached hereto which
will cover current proposed projects and future projects.

within the City which c.onsist in part of the freeway type highway; and
WHEREAS, frc,m time to time the City requests the S[ate to install traffic
signals on such highways; and
WHEREAS, the Sta[e under the provisions of Minute Order 70179, dated July 31,
1975, has autliority to Lnstall traffic signals i.n cities of over 15,000 population
on freeway type highways; and
WHF.REAS, the City lias a population of over 15,000 according to the latest
Pederal Census;

NOW, THEREFORE, in consideration of, the premises and of the mutual covenants
ancl agreements of the parties hereta to be by them respectively kept and
performed, as hereinafter aet fortti, it is agreed as fol2ows:

supervise constriyction.
3. The City hereby consents to the t.onstr.uction af tfie highway traffic
signal(s) by the approval of the location anel manner of construction as shown on
plans and described in specificaticins.
4. The CiCy will operate and maintain the highway traffic signal(s) at thEi
expense upon completion of the installation(s) by the State.
5. The City will pay all power costs for operating the signal(s), including
all power necessary for installation and teatictg nf the signals prior to comple-
tion of the installation by the State.
6. The City will obtain written aproval of the State Department of Highways
and Public Transportatlon before making any changes in the design of operation and
timing of the aignal(e) or before removing any part of the installation(s).
7. The City will return any and all parts of said highway traffic signal
installation(s) to the State ehauld it (they) be removed by the City for any
reason other than for installatton on a Sr.ate or Feder,il rnimbered hiQhway route at

Nothing in this agreement shall he construed to place ariy liability on the
City for personal injury arising out of the construction of such project.
Furthermore, i[ is not the intent of this apreement to impose upon the City the
liability for injury to person or property arising out of the construction of the
project by the 5tate's contractor unless the Sr_ate itself would be liable for such
injtiry or damage.
Nothing herein rnntai«ed shall be construed to place (ipon the 5tate any
manner of liability Eor, injury [o or death of persons or for damage to or loss of
property arising out of or in any manner connected with the use of the project,
and the ctty will save ttie 5tate harmless from any damages arisi'ng from said main-
[enance 3nd/or use of satcl I>roject.
