2126 RES CITY COUNCIL AND COMMISSIONERS COURT UNDER ARTICLE 4436a-1RESOLL'TICiV N0. 2126 WHLREAS, the City Council of the City of Paris and the Commissioners Court of Lamar County, under the power granted in Article 4436a-1 of Vernon's Annotated Civil Statutes, established the Paris-Lar.mar County Health Unit, which Unit is under the direction and supervision of the City-County Board of Health; and, WHEREAS, said City Council and Commissioners Court have jointly apgointed Joe Hillhouse acting director of said Health Unit; which appointment was made subject to the approval of t:ze City-County Board of Health, which has been given; and, WHLREAS, said Acting Director renlaces and performs the duties of a cour.ty health off icer and a city health officer, neither oL ~-,';iich may be so appointed while such joint health unit is -n existence; and, I vTHEREAS, under Section 5 of said Article 4436a-1, the City Council and the Commissioners Court are empowered to fix the salaries of eniployees of such joint health unit, anci, prior to changing any such salary, t'ie City Council and the Commissioners Court shall request recommendatiorLs from the City-County Boa.rd of Health; and, tiaHEREAS, the salary of the Acting-, Director of the Paris-Lamar County Health Unit is being considered by the Commissioners Court and the City Council, and the recom- mendations oi the City-County Health Board having been received with regard to the same, it is deemed appropriate that an eMployment contract between said City and County and Joe Hillhouse be authorized, drawn and executed; and, T ~~T"tIEREAS, such contract is recommended in the form of Exiiibit A attached hereto • NOW THEREFORE BE IT RESOLVED BY THE PARIS AND THE COMMISSIONERS Joe Hillhouse, be, and he i Director of the Paris-Lamar terr.is and conditions stated and, CITY COL'NCIL OF THE CITY OF COURT OF L_AMAR COUNTY, That s hereby reappointed Acting County Health Unit upon the in Exhibit A attached hereto; BE IT FURTHER RESOLVED, That the Mayor of the City of Paris and the County Judge, be, and they are hereby authorized and directed to execute such agreement on be- half of the City of Paris and the County of Lamar, re- snectively. D., is wi 11 ing , ab le and qLali-ified to nerform the duties of acting director; NOW, TriEREFORE, in consideration of the mutual ag,ree- ments hereinafter contained and subject to the terms and conditions hereinafter stated, it is hereby understood and agreed by and between the parties hereto as follows: l. City and County do hereby hire and appoint Joe Hillhouse, M.D., as acting director o_f the Paris-Lamar County Health Unit, 2. Joe Hillhouse, M.D., agrees to perform all services required of the director of a health unit. 3. City and County agree to pay Joe Hillhouse, PZ.D., at the rate of One Hundred Fifteen Dollars ($115.00) per day for each complete day of service rendered. 4. The term of this employment is from November l, 1981 through June 30, 1982. 5. The compensation for the term shall be Sixteen Thousand Eight Hundred Sixty-Six and 66/100 Dollars ($16,866.66). 6. The minimum acceptable level of performance dur- ing the term of the employment shall be an average of four (4) days per week. The minimum daily performance shall average seven (7) hours per day. Not withstanding the stated minimum performance, the acting director will be permitted to observe all State holidays. 7. The acting director agrees to visit the Lamar County jail on Monday of each week that is not a State holiday, and, in that event, on the next working day. Al1 other prisoner natients and mental, alcoholic, and narcotic proposed patients will be delivered to the Paris- Lamar County Health Unit after an appointment has been made with the acting director. 8. The acting director shall submit his work schedule for the month no later than the 25th day of the previous month. Said schedule shall reflect work days, days off, holidays, jail visits, and vacation days. On the last working day of each month the acting director shall report any amendment made to that month's schedule. These required schedules shall be furnished to the City rianager of the City of Paris and to the County Judge of Lamar County. IN WITNESS WHEREOF, the parties have hereto executed this agreement.
