RESOLUTION N0. 2138
<br />WHEREAS, Resolution No, 2130 is hereby amended to
<br />read as follows:
<br />WHEREAS, the City Council of the City of Paris did
<br />heretofore in Resolution No. 1675 authorize the prepa-
<br />ration of construction plans under Infiltration-Inflow,
<br />Phase II, of the Sewerage Facility Plan and Environmental
<br />Assessment Project No. C-48-1248; and,
<br />WHEREAS, the City Council of the City of Paris has
<br />concZuded that the best interest of the City of Paris will
<br />t:e served by the termination of said Infiltration-Inflow
<br />~"~ase II contracts with Hayter Engineering, Inc., for
<br />engineering services, due to the uncertainty of the
<br />availability of federal funding for the construction phase
<br />of such project; and,
<br />bJHEREAS, the cancellation of such Hayter Engineering,
<br />Inc., contract is hereby found to constitute an emergency,
<br />and the City Clerk of the City of Paris is directed to
<br />forthwith notify, in writing, the parties with whom the
<br />City of Paris has contracted in connection with the
<br />Infiltration-Inflow project, of the City's desire to
<br />terminate said agreements, due to the uncertainty of the
<br />availability of federal funds for the construction phase
<br />of said project which the City Council finds to be good
<br />cause; NOW, THEREFORE,
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
<br />PARIS, tizat all contracts authorized by Resolutions No,
<br />1376? 1676, 1950, 1990 and 2095 with Hayter Engineering,
<br />Inc., are hereby cancelled; and,
<br />BE IT FURTHER RESOLVED, that the City Clerk give
<br />notice, in accordance with contract provisions, of the
<br />City's intention to terminate the agreements on the
<br />31st day of December, 1981, by delivering such written
<br />notice by certified mail, return receipt requested, and
<br />the Director of Finance of the City of Paris, H. C. Greene,
<br />is hereby directed to make final payment, if any be justi-
<br />fied under such contracts, no later than February 25, 1982;
<br />and,
<br />BE IT FURTHER RESOLVED, that said contractors be and
<br />they are hereby afforded an opportunity for consultation
<br />with the City Council of the City of Paris acting for the
<br />City of Paris, terminating party, at its regular Council
<br />Meeting on the 14th day of December, 1981, at 7:00 0'clock
<br />P. M., in the Council Room, City Hall, Paris, Texas; and,
<br />BE IT FURTHER RESOLVED, that the necessity to conserve
<br />pub lic funds being obligated under the terms of the exist-
<br />ing contract authorized in connection with the Infiltration-
<br />Inflow project require the declaration of an emergency and
<br />we so declare.
