2051 RES CITY COUNCIL ON 11TH DAY OF AUGUST 1980 APPROVED ADVERTISEMENT FOR BIDSRESOLUTION NO. 2051 WHEREAS, the City Council of the City of Paris did heretofore on the llth day of August, 1980, approve the advertisement for bids for the construction of Concrete Basketball Courts at Johnson and Record Parks, which bids were received until 10:00 o'clock A. M. , Wednesday, September 3, 1980; and, WHEREAS, the best bid for such construction project was made by Wayne Clement, d/b/a Clement Construction Company, and he should be awarded the contract for such project; and, WHEREAS, the form of contract for such construction project is attached hereto as Exhibit A, and such form should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the bid of Wayne Clement, d/b/a Clement Construction Company, for the construction of Concrete Basketball Courts at Johnson and Record Parks, in the amount of $9, 890. 00, is hereby accepted and let, conditioned upon said contractor meeting all of the terms and specifications included in the bid documents; and, BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, Michael E. WAGE RATES: All employees of the Contractor on the work to be performed under this contract shall be the minimum allowed in compliance with the civil statutes of the State of Texas and to conform with the U. S. Depart- ment of Labor Employment Standards Administration, in accordance with provisions of the Davis-Bacon Act. (a) Payrolls and basic records relating tliereto will be maintained during the course of the work and preserved for a period of 3 years thereafter for all laborers and mechanics working at the site of the work. Such records will contain the name and address of each such employee, his correct classification, rates of pay (including rates of contributions or costs anticipated of the types descrihed in Section 1(b) (2) of the Davis-Bacon Act), daily and weekly number of hours worked, deduc- tions made and actual wages paid. Whenever the Secretary of Labor has found, under 29 CFR 5.5 (a) (1) (iv), that the wages of any laborer or niechanic include the amount o` any costs reasonably anticipated in providing benefits under a plan or program described in Section 1(b) (2) (B) of the Davis-6acen Act, the contractor shall maintain records ►vhich show that the convr:itment to proviGe such benefits is enforceable, that the plan or program is firancially responsible, and that the plan or program haS been cori--unicated in writirg to the laborers or mechanics affected, and records which show the costs anticipated or the actual ccsts incurred in Providing such benefits (29 CFR 5.5 (a) (3) (i)). (b) The Contractor will submit weeF;ly a copy of all payrolls to the City of Paris, Paris, Texas for availability to the DOL, a; required by paragraph 152.59 (a). The copy sha)1 be accompanied by a statement signed by the employer or his aqent indicating that the payrolls are correct and complete, that the wage rates contained therein are not less than those determined by the Secretary of Labor and that the classifications set forth for each laborer or mechanic conform with the work he perfo rnied. A submission of a"Weekly Statement of Com- pliance" which is required under this contract and the Copelan d regu- lations of the Secretary of Labor (29 CFR Part 3) and the filing with the initial payroll or any subsequent payroll of a copy of any findings by the Secretary of Labor, under 29 CFR 5.5 (a) (1) (iv), shall satisfy this requiremert. The prime contractor shall be responsible for submission of copies of payrolls of all subcontractors. The contractor will make the records required under the labor standards clauses of the contract available for inspection by authorized rep- resentatives of the Department of Labor, and wil] permit such repre- sentatives to irterview employees during working hours on the job. Contractors employing apprentices or trainees under approved programs shall include a notation on the first weekly certified payrolls sub- mitted to the City of Paris, Paris, Texas for availability to the DOL, that their employment is pursuant to an approved program and sha]1 identify the program (29 CFR 5.5 (a) (3) (ii). 2. GUARANTY AGAINST DEFECTIVE WORK: The Contractor shall indemnify the owner against any repairs which may become necessary to any part of work performed under this contract, arising from defective workmanship or materials used therein, for a period of one (I) year from the date of final acceptance of the work. 3. CLEANUP: At the conclusion of the work, all tools, temporary struc- tures and materials belonging to the Contractor shall be promptly removed and all dirt, rubbish and other foreign substances shall be disposed of. 4. INSURANCE: The Contractor shail maintaiii such insurance as will protect him and the Owner from claims under Workman's Compensation Acts and from any ot}ier claims for damages for personal injury, including death, which may arise from his operation he, by himself, or by any subcontractor or anyone directly or indirectly employed by either of them. Certifica- tion of such insurance shall be filed with Oti:-ner. Coverage shall be as follows: (a) 4lorkman's Compensation Insurance and Employ,~r's Liahility Insur~ince shall compl_y with State Laws and with minimum limits of $100,000.00. (b) Contractor's public liability with lirnits not less than $100,000.00 each person, $300,000.00 each accident and property damage with limits not less than S100,00.00 each accident, $200,000.00 aggregGte. The insurance hereinbefore specified shall be covered until all work re- quired to be performed under the terms of the contract is satisfactorily completed or evidenced by formal acceptance by tlie Owner. 5. SPECSFICATIONS FOR CONCRETE DASKETBALL COURTS AT JOHN50N AND RECORD PARKS PARIS, TEXAS SITE PREPARATION This item shall consist of preparing the Basketball Court Site for construction operations by the removal and disposal of all ob- structions from the designated area. Such obstructions shall be considered to inelude all vegetation, concrete, shrubbery, and all other debris. It is the intent of this item to provide for the removal and disposal of all obstructions and objectionable materials from the construction site. SUBGRADE PREPARATION AND GRADING After the site of the work has been properly cleared the grading work may proceed in conformity with the Plans and Specifications. Soft, spongy and other unstable subgrade materials shall be removed and shall be replaced by select materials and compacted as specified. The entire construction site shall be scarified to a depth of 6-inches, adding necessary select material, and compacted in an approved method to a satisfactory density, and to the subgrade elevations indicated on Plans. The 6-inch layer of subgrade im,mediately below the concrete surface shall be compacted to 95% density in accordance with the Standard AASHO T-99, Test Method. REINFORCED CdNCF.ETE SURFACE DESCRIPTION This item shall consist of a pavement surface of Portland Cement Concrete, with reinforcement as shown on Plans, constructed as herein specified on the prepared subgrade in canformity with the thickness and typical cross sections shown on Plans. Concrete shall be considered of satisfactory quality provided it is made of accepted materials, mixed, placed, finished and cured in accordance with requirements of this Specification and has a minimum compressive strength of 3000 P.S.I. at 28 days. SP-1 cnMErrr The cement shall be type I of a Standard Brand of Portland Cement, and shall conform to requirements of ASTM Designation C-150. Any cement which has become partially set or which contai.ns hard lumps or cakes, shall not be used. FORMS The Side Forms shall be wood or metal, of approved Cross-section, and of a height not less than the proposed edge thickness of the concrete section and a minimum of ten (10) feet in length. Forms shall be of ample strength and shall be properly braced to withstand the loads imposed there upon without springing or settlement. The Forms shall be free from warps, bends or kinks and shall show no variation from the true plane for face or top. Forms shall remain in place until the concrete has taken its final set. EXPANSION JOINT MATERIALS Boards for expansion joint filler shall be of the size, shape and type indicated on Plans, and shall be bituminous coated fiberboard, or of Redwood, or Cypress. They shall be sound and shall be free from warps, knots, sapwood, checks and splits. STEEL REINFORCZNG BARS Steel reinforcing bars shall be open hearth new deformed billet steel of structural, intermediate or hard grade, ASTM Designation A-15 or later revision. All reinforcing shall be clean, free from rust in the form of loose or objectionable scale and of the type, size and dimensions shown on the Plans. Reinforcing bars shall be securely wired together at all intersections and splices, and installed in their required position as shown on the typical slab detail. PLACING CONCRETE Unless otherwise provided for on the Plans, the full width of the finished concrete surface shall be constructed monolithically. The concrete shall be rapidly deposited on the subgrade in successive batches and shall be distributed to the required depth and for the entire width of the paved area by shoveling or other approved methods. The placing operation shall be continuous. Traverse or construction joints will not be permitted. Special care shall be taken in placing and spading the concrete against the Forms and at all joints and assemblies so as to prevent honeycombiny. No concrete shall be placed when the air temperature is less than thirty- six (36) degrees farenheit, also no concrete shall be placed on a frozen subgrade. sp- z FINISHING CONCRETE When the concrete has been deposited, it shall be approximately leveled and then struck off to such elevation that when mechanically tamped the concrete shall be thoroughly compacted and finished to the required line, grade and section shown on Plans with all voids filled. While the concrete is still workable, it stiall be tested for irregularities with a ten (10) foot straightedge placed parallel so as to bridge depressions and to toUCh all high spots. The finished surface of the concrete pavement shall at no place exceed one-sixteenth (1/16) inch per foot from the nearest point of contact, and in no case shall the maximum ordinate to a ten (10) foot straightedge be greater than one-eighth (1/8) inch. Any surface not within the tolerance limits shall be reworked or refinished. All exposed concrete surface shall be given a light broom finish. The edges of sla.b and all joints shall be carefully tooled with an edger. CURIAIG CONCRETE SURFACE Immediately after the finishing of the surface the pavement shall be covered with a continuous, uniform, water-impermeable coating. The rate of application shall be such as to insure complete coverage and shall not exceed two hundred (200) square feet per gallon of curing compound. The coating shall be sufficiently transparent and free from permanent color to result in no pronounced change in color from that of the natural concrete at the conclusion of the curing period. FINAL SITE GRADING After the concrete paved basketball courts have been constructed and approved, the Contractor shall grade the perimeter of each basketball court a minimum distance of 20 feet to insure proper site drainage. A1so all slopes adjacent to the paved area shall be graded uniformly on all sides and finished approxi.mately 1" below top of concrete pavement. Select material (good top soil) shall be added by the Contractor where reqnired to properly backfill the concrete paved area. The Contractor will be required to grade final drainage swales as indicated, and where shown on the Plans. PAYMENT Payment will be made for two paved basketball courts complete in place where indicated, and approved by the Engineer. The work shall include subgrade preparation, site grading, furnishing all materials, labor, equipment, supervision and other incidentals necessary to complete the work according to the details shown on Plans, and in accordance with the Specifications. Payme nt will be made in one total payment for two concrete paved basketball courts, upon acceptance of the work herein contracted for. CD-']
