2050 RES CITY COUNCIL REQUESTED TO PROVIDE EMERGENCY AMBULANCE SERVICE TO LAMAR COUNTYRESOLUTION N0. 2050 . WHEREAS, the C.ity Council of the City of Paris has been re- quested to provide emergency ambulance service to that area of Lamar County outside the city limits of the City of Paris, by the Commissioners Court of Lamar County, Texas; and, WHEREAS, the form of contract to provide such service is attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That emergency ambulance service be extended to that area of Lamar County outside the city limits of the City of Paris, upon the terms and conditions stated in the contract attached hereto as Exhibit A, and that the Mayor of the City oE Paris, Michael E. Malone, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the ambulance service contract with the Commissioners Court of Lamar County, Texas, in the form of Exh.ibit A attached hereto. City cnvQnants and az;zees ttlat it will furnis'i and nro-vide adequate emPrgency ambulance service to all persons within the County of Lamar, without regard to race, color, sex or national origin. 2. Citv covenants and agrees that it will cor.lnly with a1I safety requirements of the law pertainir.g to the furnishing of emergency ambulance service anci that all vehicles used as a.mbulances wi11 be distinctly marked and colored as required by State iaw and City ordinances. The ambul.ance service sha11 be referred to as "CITv OF PAR.IS AMBULANCE SERVICE" ar_d the vehicles used in Draviding said service shall bear the City of Paris decal caith the adclition~l wOrds,"servirg PARIS and LA~~~A?t COU?JTv " 3, City agrees t'nat amaulance attendants will be certi- fied by the Texas State Department of Health under the terms of the Emerge::cy Ambulance Act; that each emergency ambulance shall. have the services af a driver and attendant, onp of wham has satisfactorily completed the Red Cross Advanced Fir.st-Aid Coizrse or certified b,v State of Texas as Emergency Care Atten- dant or who is qualified as an Emergency Medical Technician- Ainbi:lance; that a?1 attendants mast complet.e the course of the EXHIBIT A Emergency Medical TEChnician (EMT) basic training course with- in six (6) months from date of ernployr.lent; that all persons driving equipment used as aMbulances rnust have a valid State of Texas Chauffeur's License, with one attendant on each ambu- lance being EMT cE.rtified by the State Board of Health and Special Skills certified in airway management, intravenous therapy, and Mast trousers by January l, 1982. 4. City agrees ta nrovided State of Texas Certified EMT Course, and to possess an in-service training pxogram agree- nent with one or both of the lacal hosUitals. 5. City agrees that each vehicle used as an ambulan.ce sha11 be equipped with a two-way radio which transmits and receives on frequencies designated by the FCC. Ttie radio communications to and from said ambula.nces and centr.al dispatch shall be in coordination with and by the knowledge of the Lamar County SherifIl's Office and the Paris PoliLe Department, and McCuistion and St. Joseph, each hospital furnishing its own radio equinment which must meet all require- ments for the State Medical Services Cornmunicatian System attached hereto as Exhibit A. 6. City agrees that all vehicles used for emergency service will meet or exceed Amer.dment -1 of Fed. Spec. KKK-A-1822 attached hereta as Exhibit B, and meet the minimal equipment listed on Exhibit C attached hereto, and that all ambulances and aceessory equipment shall be subject to inspectian by desig- nated representative of the County, and if at any time same are not in compliance with the provisians hereof, or if any ambu- lance is in need of inechanical repairs in order to insure its satisfactory operation, the said vehicle must be removed from service. 7. City agrees that it will ar:swer all emergency calls within the limits of the City and County, and that no person within the City ana county shall be refused emergency service, and further agrees that transfer --mer-erLcy service whpn di_- rected by a medical doctor wi11 not be refused, and agrees to deliver patients ta McCuistian and St. Joseph Hospital in the fallowing manner: (a) To the hosgital that victim, his personal phy- sician or next of kin so designate, ox (b) To the nearest hospital irom. the accident site of the victim when his personal physician or next of kin canr_ot respo-id to the ambulance di.rector"s inquiry. 8. City agrees that at alI times during the effeCtive period of this contract to have nrocured and kept in force and effect policy ar policies of public liability insurance covering each mator vehicle operated under_ this contr_acL in the minimum amounts of $100,000.00 for bodily injury or death to any one persan and $300,000.00 for all persons injured in any one accident or occasa,.on and $25,000.00 for property dam- ages arising out of any ane accident or occasion. 9. City agrpes to furnish the Caunty Judge, Lamar County, an annual operating stateme-tit relating to revenues, expenses, call statistics, and the status o£ delinquent and uncollectable accounts, and that all non-medical records of the services ren- dered under this contract, and training and certification rec- ords of all eMployees, be available far inspection and review by such County Judge or his designated representati.ves, and to furnish a monthly report in the 'LarM af Exhibit D attaehed hereto. 10. City agrees to oDerate the ambulance operation in accordance with the r.equirements of State law and applicable requirements of City and County as may be in effect, ].l, City agrees that i_t wi11 have a minimum of three (3) ambulances which meet the ambulance and equipment require- ments as set out in Paragraph 6 above, manr.ed with a crew of two (2) pexsons each, available to the citizens of the City and County twenty-four (24) hours ger day, scven (7) days Der week, 12, County agrees that non-emergency transfer service from points within the City or County to points inside or out•- side the County shall be made at the nrerogative of the City; that ambulance service from poir.i:s outside the County to any destination shall be made at the prerogat:ive af Ci.ty and shall not be covered by this contract. 13, The County a~rees to pay to City $60,000,00 annually for providing emergency ambul_ance service to that area of the County outside the carnorate limits of the City of Paris, which arnual cost is to be paid in monthly oayments af $5,000.00 each. The first of said monthly payments to be made on the lst day of September, 1980, with a like payment being made on the first day of each rnonth thereaf ter , 14, This agreement shall be effective and the term thereof shall commence on the lst day of Sentember, 1980, and shall ex- pire on the 31st day of. Aurust, 19$1. 15. It is further under•stood and agreed that neither the County nor any of its agents, servants or empl.oyees shall be considered to be in the business af_ providing arnbulance service, and the relationship between the parties shall not be considered that of a partner::hip or jaint venture, and that the sta.tus of the City sha11 be that of an indenendent contractor providinh services to the County and its inhabi_tants in exchange for the payment of amour.ts herein set forth. ~ 16, It is mutually understood and agreed between the parties that the payL:_ents r:ade by the County to City shall in na way afiect the ricrt of" City to collect the charges hereinafter set out in Paragraph 17 from persons far ambu- lance service rendered, and it is exDressly understood and anreed that no one shall be en.titled to free ambulance service under this contract, a3zd diligent efforts shall be made to collect accounts outstanding in keeping with good and ethical busin.ess practicES. 17. In the event that the County desires continued ambu- lance service beyond the er_d of this contract, being August 31, 1381, County sha11 give written notice to the City or~ or be- fore June 1, 1981, of its desire for service for an additional term, and upon receipt of saici natice on or before June 20, 1981, City will del.iver to Caunty the rates and contract price upon which it caill deliver service, and thereafter on or before July l, 1981, County wi11 execute the contract for service £or the additional term upon the same terr,is anci conditio:7s as stated therein.
