WHEREAS, the City Council of the City of Paris, did at its
regular meeting on the ~4th day of March, 1977, approve the ad-
vertisement for bids for furnishing all plant, labor, material and
equipment, and performing all work required for repair work at the
Paris Public Library, in accordance with ~etailed plans and specifi -
cations, dated March 1977, which bids were received until 10;00
o'clock A, M. , Wednesday, April 6, 1977; and,
WHEREAS, the best bid for such repair work was made by
Western Waterproofing Co. , Inc. , and it should be awarded the con-
tract for such repair work; and,
WHEREAS, the form o~ contract to furnish such repair work
is attached hereto as Exhibit A; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COJNCIL OF THE CITY OF
PARIS, That the bid of Western Waterproofing Co, , Inc. , Dallas,
Texas, for repair work at the Paris Public Library, consisting of
cleaning and sealing exterior masonry stone walls, caulking and
sealing exter~r joints and structural cracks, cleaning and caulking
all exterior openings, an~ lime stabilizing soil around exterior of
building, within 70 calendar days, in the amount of $9, 38~. 00, is
hereby accepted and let, conditioned upon said contractor meeting
all of the terms and specifications included in the bid documents;
and,
BE IT FURTHER RESOLVED, That the City Man~ger of the
City of Paris, I<erry R. Sweatt, be, and he is hereby authorized and

NOTICE TO BIDDER
The City of Paris will receive sealed bids until 10:00 A.M.
Wednesday April 6, 1977, for furnishing all plant, labor, material and
equipment, and performing all work required for repair ivork at the Paris
Public Library, consisting of cleaning and sealing exterior masonry and
stone walls, caulking and sealing exterior joints and structural cracks,
cleaning and caulking all exterior openings, and lime stabilized soil
around exterior of building, complete with appurtenances, located at
326 South P4ain Street, within the City of Paris, Texas.
Sealed bids addressed to the Fionorable Mayor and City Council,
Office of the City Manager, City of Paris, Texas, P.O. Box 1037, will be
received until 10:00 A.M. Wednesday April 6, 1977, at which time all
bids received will be publicly opened, tabulated and referred to the
Mayor and City Council for consideration at the City Council Meeting to
be held on Monday April 11, 1977.
Proposals shall be accompanied by a cashier's or certified check
upon a Dlational or State Bank in an amount not less thar_ five (5%) per
cent of total maximum bid price, payable without recourse to the City
of Paris, Texas, or a Bid Bond in the same amount from a reliable surety
company, as a guarantee that bidder will enter into a contract and
execute Performance Bond within ten (10) days after notice of award
of contract to him.
The successfuZ bidder must furnish Performance Bond upon the Form
provided in the amount of 100% of the Contract Price and a Material and.
Labor Payment Eond upon the Form provided in the amount of I00% per cent
of the contract price from The State of Texas to act as surety, or
other surety or sureties acceptable to the owner.
The right is reserved, as the interest of the owner may require to
reject ang and all bids, and to waive any informality in bids received.
Plans, Specifications and Bidding Documents may be secured from the
office of the Director of Public Works, 120 East Kaufman Street, Paris,

"The Standard Specifications For Construction in the City of Paris"
shall be included herein the same as if reproduced in full. Bidder
may exar.tine said General Conditions at the Office of the Directar
of Public Works, 120 East Kaufman Street, Paris, Texas.
SPECIAL C024DITIODTS
SC. 1 General
The provisions of this secti.on of the Specificatians shall
govern in the event of any conflict between them and the
"General Conditions of Ayreement:
SC. 2 Engineer
The word "Engineer" in these Specifications shail be under-
stood as referrina to the City Engineer of the City of Paris,
ENGINEER of the owner, or such other ENGINEER or inspector as
may be authorized by said 0WNER to act in any particular
position.
SC. 3 Location of Project
This project is located at the Paris Public Library,326 South
Aiain Street, Paris, Texas.
SC. 4 Scope of Work
The work to be performed under this Contract consists of
furnishing all materials, labor, supervision, tools and equipment
necessary to perform the specified repair work, at the Paris
Public Library Building, consisting of cleaning and sealing
exterior masonry and stone walls, cleaning, caulking, and
sealing all exterior joints and structural cracks, lime stabilizing
soil around tize outside perir.meter of building, complete with
appurtenances, as shown an sketches, pZan, and specified herein.
SC. 5 Time Allotted For Completion
The time allotted for the completion of alI items of work
shall be sixty (60) consecutive calendar days, which time shall
begin on the tenth (lOth) day after the issuance of the work order.
The work order sha11 consist of a written request by the
Engineer for the Contractor to proceed with the repair work on
the project.
SC. 6 Forrts, Plan, and Specifications
Forms of Proposal, Contract and Bonds, Plan and Specifications
r.iay be obtained at the Office of the Director of Public Works, 1.20
East Kaufr_an Street, Paris, Texas, upon deposit of Ten Dollars
($10.00), which sum so deposited will be refunded, provided the
prospective bidder complies with one of the following requirements:
(a) If no Proposal is submitted: All documents must be
returned.
(b) If Proposal is submitted: Al1 docunents, except
Proposal F'orm submitted as Bid must be returned to
the Office of the City Manager within fifteen (15)
calendar days from and after the time and date of re-
ceiving Proposals.

Provided the prospective bidder complies with neither of
the two above requirements, the sum of Ten Dollars $10.00)
shall become the prope.rty of the City of Paris, Texas.
SC. 7 Award of Contract
The City of Paris will notify the successful bidder, in
writing, within ten (10) days after the date o£ receiving bids,
of its acceptance of his Proposal. The Contractor shall complete
the execution of the required Bond and Contract within ten (10)
days of such notice.
SC. 8 Liquidated Damages For Delay
The Contractor agrees that time is the essence of this
Contract, and that for each day of delay beyond the number of
calendar days herein agreed upon for the completion of the work
herein specified and contracted for (after due allowance for
such extension of time as provided for in the General Conditions
of Agreement) the owner may withhold, pern!anently, from the Con-
tractor's total compensation, the sum of thirty-five Dollars
($35.00) as stipulated damages for such delay.
SC. 9 Examination of Site of Project
Prospective bidders shall make a careful examination of the
site of the project, conditions to be encountered, improvements
to be protected, and safety requirements necessary to protect the
public, and keep the Library open to the public.
SC. 10 Qualifications of Low Bidder
Before being awarded a contract the low bidder shall submit such
evidence as the Engineer-ma~• require to estahlish his financial
responsibility, experience and possession of such equipment as
may be needed to prosecute the work in an expeditious, safe and
satisfactory manner.
Should the low bidder fail to produce evidence satisfactory to
the Engineer on any of the foregoing points he may be disqualified
and the work awarded to the next low bidder qualifying.
SC. 11 Addenda
Bidders desirinq further information or interpretation of the
Plans or Specifications must make request for such information to
the Engineer, prior to 48 hours before the bid apening. Answer tc
all such requests will be given in writing to all bidders, in
Addendum Form, and all Acldenda will be bound <<*ith, and made a part
of, the Contract Document. No other Explanation or interpretation
will be considereci official or binding. Should a bic3der find
discrepancies in, or omissions from, the Plar.s, Specifications,
or other Contract Documents, or should he be in doubt as to their

meaning, he should at once notify the Engineer in order that a
written addendum may be sent to all bidders. Any addenda
issued prior to 24 hours of the opening of bids will be mailed
or delivered to each contractor contemplating the submission of
a proposal on this vvork. The Proposal as submittecl by the Con-
tractor will be so constructed as to include any addenda, if
such are issued by the Engineer prior to 24 hours of the Bid
Opening.
SC. 12 Engineer's Authority and Duty
Reference is made herein to Section 2.02 of the GENERAL COI3-
DITIONS OF AGREEMENT. The first two sentences of said
Section 2.02 are hereby deleted and replzced with following:
"Unless otherwise specified, it is mutually agreed between
the parties to this B.greement that the ENGINEER shall in-
spect all work included herein. Inspection of the work by
the ENGINEER shall not relieve the CONTRACTOR of his ob-
ligations necessary to insure the proper execution of the
contract. The ENGINEER shall have the authority to stop
the worlt whenever such stoppage may be necessary in his
opinion for the protection of the interests of its Owner.
It shall be the complete responsibility of the CONTRACTOR
to supervise and manage his operations."
All other sentences and paragraphs of said Section 2.02 shall
remain and govern the Contract as stipulated.
SC. 13 Right of Engineer to modify Methods and Equipment
Section 2.13 of the GENERAL CONDIiIOtd5 OF AGREEMENT shall be
deleted.
5C. 14 Protection Against Accident to Employees and the Pubiic
The last sentence of Section 3.09 of the GEN'ERAL CONDITIONS
of AGREEMENT is hereby modified to read as follows: "The CON-
TRACTOR and his sureties shall indemnify and save harmless the
Oj9I3ER, the ENGINEER, and all their officers, agents, and
employees from all suits, actions, or claims of any character,
name and description brought for or on account of any injuries
or damages received or sustained by any person or persans or
property, on account of any negligent act or fault of CONTRACTOR,
his agents or employees, in the execution of said contract; or
on account of the failure of the CONTRACTOR to provide necessary
barricades, warniny lights or signs; and will be required to pay
any judgement, with costs, which may be obtained against the
OWNER and/or ENGINEEP, growing out of such injury or damage. "
All other sentences and paragraphs of said Section 3.09 shall
remain stipulated.

SC. 15 Insurance
The CON'TRACTOR shaZl obtain, maintain during the life of the
Contract, and provide copies to the Owner, of the following in-
surance policies which shall be obtained from insurance company
licensed to do business in the State of Texas, in the amount and
for the purposes stated and subject to the OWPIER`S approval.
Insurance policies shall be obtained by the CONTRP.CTOR and
approved by the OWNER prior to the commencement of the work.
(a) rATorkmen's Compensation and Employer's Liability Insurance
Workmen's Compensation and Employer's Liability Insurance
in the amount and terms required by applicable statute
for all employees engaged in work on the project under
this Contract, and in case of any such work sublet, the
Contractor shall require the subcontractor similarly to
provide Workmen's Compensation Insurance for all the
latter's employees to be engaged in such work unless such
employees are covered by the protection afforded by the
Contractor's Workmen's Compensation Insurance.
(b) Public Liability and Property Damage
The Contractor's Public Liability Insurance shall be in
an amount not less than $100,000 for injuries, including
accidental death, to any one person, and subject to the
same limit for each person, in an amount not less than
$300,000 on account of one accident, and contractor's
Property Damage Insurance in an amount not less than
$50,000.
SC. 16 Disposal of Waste and Surplus Excavation
All excavated earth in excess of Frhat required for backfilling
shall be removed from the job site and disposed of in a satis-
factory manner.
SC. 17 Guaranty Against Defective Work
The CONTRACTOR shall indemnify the OWNER against any reoairs
which may become necessary to any part of the work pex'farmed under
the contract, arising from aefective workmanship or materials used
therein, for a period of two (2) years from the date of final
acceptance of the work.
SC. 18 Cleanup
At the conclusion of the work, all tools, temporary structures
and materials belonging to the CONTRACTOR sha.ll be promotly re-
maved and all dirt, rubbish and otller foreign substances shall be
disposed of.
The CONTRACTOR shall thoroughly clean al.l equipment and

materials installed by him and shall deliver over such materials
and equipment undamaged in a bright, clean, poZished and new
appearing condition.
SC. 19 Fxisting Utilities and Service Lines
The CONTRACTOR shall be responsible for the protection of all
existing utilities or service lines crossed or exposed by his
construction operations. Mhere existir.g utilities or service
lines are cut, broken or damaged, the COr'TRACTOR shall replace or
repair the utilities or service lines with the same type of
original material and construction, or better, at his oFm cost
and expense.
SC. 20 State Sales lax
The City of Paris requires that no State or Municipal Sales

SC. 21 Wage Rates
All employees of the CODiRACTOR on the work to be performed
under this Contzac,t srall be the minimum allowed in compliance
with the civil status of the State of Texas and to conform with
the U.S. Department of Labor Employment Standards Administration,
in accordance with provisions of the Davis-Bacon Act.
Current wage rate will be issued as an addendum to the Proposal
and Specifications.

TECFiNICAL SPECIFICATIONS
HI-PRES5URE PIATER CLEANING
A. SCOPE:
Furnish and install a11 labor, equipment, and materials,
necessary to thoroughly clean all exterior manonry and stone
walls, as specified herein.
B. QUP.LIFICI,TIONS OF WORKMEN:
Only skilled and experienced mechanics, engaged full time in
Hi-Pressure Water Cleaning, shall be permitted to do the Hi-
Pressure cleaning herein described.
C. PREPARATIOD7 OF SURFACES:
Provide aZl necessary shields, barriers, window and door pro-
tections, in order to properly execute this work with the least
possibZe inconvenience to the occupants and general public using
the building.
D. APPLICATION:
All exterior masonry and stone surfaces as described shall
be cleaned by the Hi-Pressure tti7ater Cleaning Method. The purpose
of this cleaning method is to thoroughly remove all dirt, grime,
discoloration, and loose particles from the surface of the masonry
and stone walls in such a manner as to cause no disruption and
harm to the face of the masonry or stone. The action of this
cleaning method is to be one of scouring and scrubbing only.
The pump used to develop this pressure is to be gasoline or
diesel driven, capable of maintaining pressure of 1200 P.S.I. at
minimum elevation of 300 feet above the pump.
A special nozzle design will be used to project the water at
1,000 to 1,200 pounds pressure. This nozzle is to contain a de-
vice allowing the water stream to be aerated thereby breaking up
the force of the water stream as the results of aeration.
If necessary, where dirty surfaces require, the masonry or
stone wall surface shall be soaked prior to cleaning with the Hi--
Pressure Water Nozzle by previous wetting with hose or perforated
pipe. Where extremely dirty areas occur it may also be necessary
to draw through the top of the aerating nozzle a fine aggregate
or sand approximately 50 to 60 mesh to remove these areas of dirt.

B. QUALIFICATTQN OF WORKMEPd:
Only skilled and experienced mechanics, engaqed full time
in sealing exterior, masonry and stone wall work will be per-
mitted to do seaZing work.
C. COLOR SELECTION:
Water repellant material shall be transparent and free from
permanent color, and shall result in no pronounced change in
color from natural color of existing masonry and stone walls.
D. PRODUCT HANDLING:
Water repellant material shall be delivered to the site in
sealed containers, with the manufacturer`s name and trademark
clearly indicated thereon. Each shipment of water xepellant
material shall be accompanied by a statement of r►anufacturer
certifying that it complies with Federal or American St-andard
Specifications.
E. MATERIALS:
All sealing materials shall be applied according to manufacturer's
printed directions.
1. Water Repellant Silicone: Shall be "Pecora P-55 Colorless
Silicone 47ater Repellent Water Ease Chemical" or equal quality
material approved by the Engineer before application.
F. PREPARATION OF SURFACE:
The Contractor will not be permitted to apply the water
repellant silicon coating until the exterior walls have been
thoroughly cleaned by the Hi-Pressure Water Cleaninq Method,
and aZl joints, structural cracks, and exter.ior openings have
been cleaned and caulked, and all exterior wall surface and
caulking have dried according to specifications relating to
these items.

G. APPLICATION OF SZLICON WATER P.EPELLAN'i' CHEMICAL:
Immediately after the surface has dried, and all caulking
has cured the exterior wall surf.ace shall be covered with a
continuous, uni£orm water-impermeable coating. The solution
shall be applied under pressure, using 5 to 10 P.S.I. ai.r
pressure, with the spray nozzle held close to the masonry
surface in such a manner as to cover the entire masonry and
stone wall surface thoroughly and completely with a liberal
coating of chemical.
H. PROTECTION OF IMPROVEMENTS ADID GENERAL PUBLIC:
The Contractor shall provide all necessary shields, barriers,
window and door protections, in order to properly execute this
work with the least possible inconvenience to the occupants,
and the general public using the building and grounds.
The Contractor shall take extra precautions to protect
aluminum windocv and door frames, and any painted surfaces,
since the alkalinity of this material tends to damage such areas.
Chemical shall not be applied when temperature is below 400 F.

A. SCOPE:
Furnish and install all labor, equipment, and materials
necessary to provide a complete watertight installation of
all windows, doors, and other exterior openings.
B. QUALIFICATION OF WORICMEI3:
Only skilled and experienced mechanics, engaged full time
in cleaning and caulking exterior type work shall be permitted
to do this work.
C. COLOR SELECTION:
The Contractor shall submit standard color chart of the
caulking material to be used to the Engineer for his sel.ection
and approval.
D. PRODUCT HANDLING:
Caulking material shall be delivered to the site in sealed
containers with the manufacturer's name and trademark clearly
indicated thereon. Each shipment of caulking material shall be
accompanied by a statement of the ma.nufacturer certifying that
it complies with Federal ar American Standard Specifications.
E. D'1ATERIALS :
Al1 r,iaterials shall be appZied according to manufacturez's '
printed directions. Al1 materials used in association with
caulking shall meet the requirements of manufacturer's printed
literature.
1. Caulking shall be "Pecora SynthacaZk G.C.-9", or equal
quality material approved by the Engineer.
F. PREPARATION OF JOINT SURFACE:
Remove existing old caulking from the joint around windows,
doors, and other exterior openings to be caulked, and thoraughly
clean the joint of all dust or other laose or foreign material,
preferable with compressed air, for a depth of not less than
1/2 inch.

G. JOINT TREATMENT:
I-There joints are more than 1/2 inch in depth, backup
material may be used to control the depth of joint, and enable
the sealant to be installed under pressure.
Al1 joints shall be primed, if necessary, with a thin coating
of primer applied with a small brush.
1. Back-up Material shall be polyethylene foam rod stock, ar
as otherwise recommended by the caulking manufacturer. Rope
shall be 1/8" larger in diameter than the space to be filled
and must be free from oils, solvent, ar bituminous material.
H. APPLICATION OF CAULKING MATERIAL:
After joints have been cleaned, and back-up material installed
where needed, the joints shall be filled with caulking materials,
using a hand caulY.ing gun, or a pressure gun.
Toole the joint surface to compress the compound into the
joint, thereby assuring complete contact with the surface to be
sealed. Tooling without the aid of a slicking agent is preferred.
However, should conditions require a slicking agent, the use of
clean water and Tolune ar Xylene will be permitted.
Caulking shall not be applied when the tertperature is less than
40° F.

work joints, and any exterior structural cracks, existing in
masonry walls, including parapet wall coping, and cornice pra-
jection, and control joints.
E. QUALIFICATION OF WORIQ"iEN:
Only skilled and experienced mechanics, engaged full time in
caulking work, shall be perm:i.tted to da the cleaning and caulking
herein described.
C. COLOR SELECTION:
Contractor shall submit standard color chart of the joint and
crack caulking material to be used to the Engineer for his
approval.
D. PRODUCT HANDLIIVG :
Caulking and sealing material shall be delivered to the site
in sealed containers with the manufacturer's name and trade mark
clearly indicated thereon. Each shipment of material shall be
accompanied by a statement of manufacturer certifying that it

and using compressed air, for a depth of not less than 1/2 inch.

joint may be necessaxy, or back-up material may be used to
control the depth of joint, and enable the sealant to be in-
stalled under pressure.

SOIL STABILIZATION
A. SCOPE:
Furnish and install all labor, materials, and equipment
necessary to complete the lime stabilization application
as described herei.n.
Stabilize the soil around the entire perimeter ot the
main building, stabilization shall begin at the exterior
foundation wall and extend away from the building a minimum
of 6 feet. The depth of stabilization shall be a minimum of
10 feet below existing ground elevation.
B. MATERIALS:
1. Shall be Hydrate Lime ASTM C-207.
2. Industrial detergent shall be added to the lime at the
rate of 1/2 pint per sack of lime ta serve as a surfactant
agent.
C. APFLICATION:
1. Proportion the lime slurry within the range of 2.5 to
3.0 pounds of hydrated lime per gallon of water. Check the
specific gravity of the slurry with Ertco Hydrometer No. 2545
at both the mixer tanks and injection pipes. The lime sZurry
shall be continuously agitated to insure uniformity of mixture.
2. Injection pipe (s) shall penetrate the soil at approxi-
mately two foot intervals to a depth of ten feet below existing
ground elevation. These holes shall be located beginning two
feet away from the foundation walls and extending out six feet
from the foundation walls around the entire perimeter of the
building. Inject material to refusal at each interval. The
lawer portion of the injection pipe shall consist of a hole
pattern that will uniformly disperse the lime slurry throughout
the entire depth. Injection pressures should be adjusted to
inject the greatest quantity of slurry possible within a range
of 50 to 200 P.S.I. pump pressure.
3. Scarify the free surface lime into the top four inches
to six inches of soil and Zightly recompact upon completion of
the pressure injection.
4. The Contractor shall locate all underground utility and
service lines before drilling holes and take precautions so
that no damage will occur to them.
