1837 RES CITY COUNCIL AUTHORIZED EXECUTION OF WATER PURCHASE CONTRACT BETWEEN LAMAR COUNTY WATER AND COPRESOLUTION N0. 1837 , WHEREAS, the City Council of the City of Paris did heretofore authorize the execution of a water purchase contract between the Lamar County Water Supply District and the City of Paris, which con- tract was executed on the 17th day of July, 1967; and, WHEREAS, in accordance with the terms thereof the parties thereto have mutually agreed to an addendum. thereto entitled Addendum No. 1, which is att~ched hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL Or THE CITY OF PARIS, That Addendum No. 1 to Water Purchase Contract between Lamar County Water Supply District and the City of Paris be, and the same is hereby approved, and the Mayor of the City of Paris, James M. I<, Haynes, City ttorney ADDENDUM NO. 1 TO WATER PURCHASE CONTRACT LAMAR COUNTY WATER SUPPLY DISTRICT A ND THE C ITY OF PA R IS, PA R IS, TEXA S STATE OF TEXAS 0 KNOW ALL MEN BY THESE PKESENTS: COUNTY OF LA MA R 0 ' That Paragraphs A 1 and C4 of the Water Purchase Contract between Lamar County Water Supply District and the C.ity of Paris, entered into on the 17th day of July, 1967, is hereby amended to read as follows: • "A. The City of Paris Agrees: 1) Quality and Quant.ity - to furnish the District at the points of delivery hereinafter specified, during the term of this contract or any renewal or extension thereof, potable treated water meeting applicable purity standards of the Texas DepartmenC of Public Health in such quantities as may be required by the District not to exceed the design supply of 50, 000, 000 gallons per month, to be delivered at a uniform rate. Said rate not to exceed l, 760 gallons per minute. This quantity is to be distributed be- tween the seven points of connection as follows: Flow Meter Controller East 725 g, p, m. 671- -611- South 70 g, R m, 2'= 2'° Southwest 55 g, p, m. 2" 2" West 230 g, p, m. 4" 4" Northwest 200 g, p, m. 3" 3" North 300 g, p, m. 4" 4" Northeast 180 g, p, m. 2" 2" EXIIIBIT A ! The District may obtain an eighth point of connection from the City, located southeast, and further may redistribute the above quantities of water by reducing any combination thereof to provide 150 gallons per minute flow to this future connection so long as the total rate of delivery does not exceed 1760 gallons per minute. "C. General 4) Modification of Contract - that the provisions of this contract pertaining to the schedule of rates to be paid by the District for water delivered are subject to modification during the month following the end of the City of Paris' fiscal year. Any increase or decrease in rates shall be based on a demonstra b1e : increase or decrease in the cost of the performance hereunder, including a"base cost" of 8¢ per 100 cubic feet of water as that term is defined in Section 31-17, Sub- paragraph (b) of the Code of Ordinances of the City of Paris, but such cost shall not include capitalization of the City's system. The "base cost" shall be increased or decreased at the end of each City of Paris quarter. Other prov.isions of this contract may be modified or altered by mutual agreement. " IN WITNESS WHEREOF, the parties hereto, acting under authority of their respective governing bodies, have caused this addendum to be duly executed in multi counterparts, each of which shall be considered an original,, on this 13th day of December, 1977.
