1738 RES CITY COUNCIL IS INTERESTED IN AVIATION SERVICES BEING AVAILABLE AT COX FIELDRESOLUTION N0. 1738
WHEREAS, the City Council of the City of Paris is interested
in aviation services being available at Cox Field for the citizens of
Paris and surrounding area; and,
WHEREAS, the City of Paris is not using Room No. 5 of the
Cox Field Hangar for municipal purposes and does not forsee the
need for such room for the next two years; and,
WHEREAS, James M. Wrenn, Jr. and I. N. Burchinal, Jr. de-
sire to lease Room No. 5 for office space, classroom and testing
activities, for a term of one (1) year, beginning March 1, 1976 and
ending February 28, 1977, with the right of an option for an addi-
tional year; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the Mayor of the City of Paris, James M. Brunette, be,
and he is hereby authorized and directed to execute on behalf of the
City of Paris a lease agreement with James M. Wrenn, Jr. and I. N.
Burchinal, Jr. , upon the terms and conditions and in the form
attached hereto as Exhibit A.

LEASE CONTRACT
STATE OF TEXAS 0
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LAMAR 0
That the CITY OF PARIS, a municipal corporation, of Lamar
County, Texas, acting by and through its Mayor, James M. Brunette,
duly authorized, herea.nafter called Lessor, and JAMES. M. WRENN,
JR. and I. N. BURCHINAL, JR. of Lamar County, Texas, hereinafter
called Lessee, do hereby contract and agree as follows:
(1) Lessor does hereby lease and let to Lessee, Room No. 5
as shown on Exhibit A attached hereto and made a part hereof for
all purposes, to be used for office space, classroom and testing ac-
tivities, for a term of one (1) year, beginning March 1, 1976 and
ending February 28, 1977.
(2) Lessee agrees to pay rent for the premises herein leased
as follows: $900. 00 in equal installments of $75. 00 each, the first
of which is due and payable on or before March l, 1976, with a like
payment due on or before the lst day of each month thereafter
throughout the primary term of this lease and any extension thereof.
(3) That in the event of the termination of this agreement
before the expiration of this lease and agreement, under the terms
and provisions of the deed from the United States of America con-
veying said Cox Field to the City of Paris, or by reason of any
other condition, act or thing beyond the control of the parties hereto,
this lease agreement shall become null and void, and Lessee shall
be entitled to no compensation for such termination.
(4) lhis agreement is made in all things subject to the terms
and conditions of the deed from the United States of America to the

City of Paris, recorded in Vol. 308, Page 287, Deed Records, Lamar
Cuunty, Texas, all of which is madc a part hereof the same as if
copied herein in full, insofar as such terms and conditions affect
the subject matter of this agreement, and also to all rules, orders
and regulations of the Civil Aeronautics Administration now in effect
or hereafter promulgated, and the parties hereto agree to abide by
and enforce all of the same.
(5) Lessee agrees to indemnify, save, keep and hold harm -
less Lessor from and against any and all demands, debts, liabilities,
suits, claims and causes of action of every kind and character what-
soever for damage or injuries to persons and/or property occurring
on the leased premises resulting from Lessee, Lessee's invitees,
agents, servants or employees use, and Lessor shall not be liable
to Lessee, Lessee's invitees, agents, servants, employees, licensees
or visitors due to the building or any other condition of the premises
being improperly constructed, maintained or being or becoming out
of repair, Lessee hereby waiving any defects therein and agreeing
to hold and save Lessor harmless from all claims for any such da-
mages or injuries, and Lessee must at all times during the term of
this agreement, and any extension thereof, keep and maintain in full
force and effect a policy or policies of insurance, providing at
least $100; 000. 00 per person and $300, 000, 00 for any single occur-
rence for bodily injury or death and $10, 000. 00 for any single occur-
rence for injury to or destruction of property, indemnifying all per-
sons for any and all damages, personal injuries or property damages
sustained in or upon the premises of said leased property, or any
part thereof, as the result of the negligence of Lessee, Lessee's in-
vitees, agents, servants or employees, and shall pay all premiums
due thereon when due. It is expressly provided that such insurance
policy or policies shall and must be written and issued by a repu-
table insurance company or companies, subject to approval by the
City Attorney of the City of Paris, and Lessee or Lessee's insurance
carrier or carriers shall deliver a copy of any such policies to the
City Clerk of the City of Paris, or furnish to said City Clerk a
current letter or certificate from such company or companies, evi-
dencing the fact that such insurance is in full force and effect at a11
times during this lease and any extension thereof.
(6) That Lessee shall not sublet or sublease the leased
premises without the consent in writing of Lessor first had and
obtained.
(7) In the event Lessee shall keep each and every agreement
contained herein and do and perform all the obligations required of
Lessee hereunder during the term of this lease, an option is hereby
given and granted to Lessee to renew and extend this lease for an
additional period of one (1) year from and after the expiration of
this agreement, which option may be exercised by Lessee giving
notice in writing of Lessee's intention to renew said lease thirty (30)
days prior to the expiration of the primary term of the lease.
(8) All notices provided for herein must be made by re-
gistered or certified mail, return receipt requested.
IN WITNESS WHEREOF, the undersigned have executed this
lease agreement on the dates shown in the acknowledgements hereM
under.
