1733 RES STATE OF TX ENTERED INTO AGREEMENT WITH ST LOUIS-SAN FRANCISCO RAILWAY CORESOLUTION NO. 1733 , WHEREAS, the State of Texas, acting by and through the State Department of Highways and Public Transportation, has entered into an agreement with St. Louis-San Francisco Railway Company to re- construct its crossing with Bonham Street; and, WHEREAS, the City Council of the City of Paris is in favor of such reconstruction and wishes to cooperate in said project by tem - porarily closing Bonham Street traffic and providing for detour routes during working hours, upon the terms and conditions and in the form of the agreement attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That Bonham Street at its crossing with St. Louis-San Francisco Railway Company be temporarily closed during working hours of crossing reconstruction project; and, BE IT FURTHER RESOLVED, That James M. Brunette, Mayor of the City of Paris, be, and he is hereby authorized to execute on behalf of the City of Paris the agreement between the State of Texas and the City of Paris, providing for detour routes during the time of reconstruction of the Bonham Street railway crossing, upon the terms and conditions and in the form attached hereto as Exhibit A. Haynes, City ttorney DETOUR AGREEMENT STATE OF TEXAS COUNTY OF L.AMAR This AGREEMENT made this 3rd day of December, 1975, by and between the State Department of Highways and Public Transportation of the State of Texas, hereinafter referred to as the State, party of the first part, and the City of Paris, Lamar County, Texas, a public municipal corporation having a population in excess of 15,000 at the last Federal Census, acting by and through its duly authorized officers, hereinafter called the City, party of the second part. W I T N E S S E T H Whereas, on Loop Highway 469, same being Bonham Street at the St. Louis- San Francisco Railway Company, ET AL Crossing, same being between west llth and 12th Streets in said City, said Company is to reconstruct planking and remove abandoned track at MP 583.067, Hwy. Station 9+23.7, as provided in an agreement dated April 15, 1975, between the Rai1road Company and State. Whereas, said Railroad has requested that traffic be removed from the construction site during working hours. A G R E E M E N T NOW, therefore, in consideration of the premises and the mutual coven- ants and agreements of the parties hereto to be by them respectively kept and performed, it is agreed as follows: 1. The City will route west bound traffic to the right on 9th Street N.W. to Graham; west on Graham Street to 13th Street N.W.; south on 13th Street N.W. to Bonham Street; thence west on Bonham Street. 2. The City will route east bound traffic to the left on 12th Street N.W.to Graham; east on Graham Street to llth Street N.W.; south on llth Street N.W. to Bonham Street; thence east on Bonham Street. 3. The State is to clearly sign this route as a"detour", providing suffi- cient traffic control signs to properly regulate traffic on the detour, in- cluding one-way arrows and stop signs, and maintain such signing until the railway crossing reconstruction project provided in agreement dated April 15, 1975, has been completed. EXHIBIT A 4. Items 1, 2, and 3 above are in addition to the Municipal Maintenance Agreement as same applies to Loop Highway 469. The duties and responsibil- ities of State and City as provided by the Municipal Maintenance Agreement remain inviolate under this agreement.
