1713 RES ST OF TX AND JOHN C CULPEPPER JR AGREED JOHN C CULPEPPER JR MAY CONSTRUCT STORM SEWERRESOLUTION N0. 1713 . WHEREAS, the State of Texas and John C. Culpepper, Jr. as owner of the Village Green Shopping Center, have agreed that John C. Culpepper, Jr, as owner of the Village Green Shopping Center, may construct a storm sewer within and a building across the Texas Highway Departmert right of way and easement, upon the terms and conditions and in the form of the agreement attached hereto as Exhibit A; and, WHEREAS, the City Council of the City of Paris is agreeable to the conditions of such agreement and the covenants made by John C. Culpepper, Jr, as owner of the Village Green Shopping Center, hold - ing the Paris City Council and its duly appointed agents and employees harmless against any action for personal injury or property damage sustained by reason of the construction and/or maintenance of the storm sewer and/or building within the limits of the right of way and easement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That James M. Brunette, Mayor of the City of Paris, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the agreement between the State of Texas, City of Paris and John C. Culpepper, Jr. as owner of the Village Green Shopping Center, upon the terms and conditions and in the form attached hereto as Exhibit A.
