1601 RES CITY COUNCIL APPROVED ADVERTISEMENT FOR BIDSRESOLUTION NO. 1601 WHEREAS, the City Council of the City of Paris has heretofore approved the advertisement for bids for a sign making machine, to be used by the Street Department for making traffic signs, and did on the 14th day of January, 1974, authorize the advertising and taking of bids at 10:00 o'clock A. M. on the 6th day of February, 1974; and, WHEREAS, the best bid for said sign making machine is made by the 3M Company and it should be awarded the contract for such machine; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the bid of 3M Company, in the amount of $2, 674. 51, is hereby accepted and let, and the Mayor of the City of Paris, F. D. Mallory, III, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the agreement between the City of Paris and the 3M Company, upon the terms and conditions and in the form as shown in Exhibit A attached hereto. THE CONTRACT SUM The Owner shall pay the Contractor for the performance of the Contract, subject to additions and deductions provided therein, in current funds as follows: BASE PROPOSAL: For all materials and equipment necessary for complete installation of the VAL 1 Sign Machine and all appurtenances thereto and 100 STOP sign faces consisting of 50 - 30" octagon and 50 - 24" octagon for the sum of TWO THOUSAND SIX HUNDRED SEVENTY-FOUR DOLLARS AND FIFTY-ONE CENTS, ($2,674.51). ARTICLE 4. ACCEPTANCE AND PAYMENT Payment shall be due thirty days after completion of the work provided the work be then fully completed and the contract fully performed. Upon receipt of written notice that the work is ready for final inspection and acceptance, the Owner shall promptly make such inspection. If, when the Owner finds the work acceptable and the contract fully performed, he shall promptly issue a final certificate, over his own signature, stating that the work provided for in this Contract has been completed and is accepted by him under the terms and conditions thereof, and that the payment found to be due the Contractor, and noted in said certificate, is due and payable. Before issuance of payment the Contractor shall submit evidence satisfactory to the Owner that all indebtedness connected with the work have been paid or otherwise satisfied. ARTICLE 5. THE CONTRACT DOCUMENTS The Invitation for Bids,Instructions to Bidders, Proposal, General Conditions,and General Requirements, together form the Contract and they are as fully a part of the Contract as if fully repeated herein and are attached hereto as Exhibit A. Greene, City Clerk AGREEMENT BETWEEN THE CITY OF PARIS AND MINNESOTA MINING AND MANUFACTURING COMPANY THIS AGREEMENT niade this 22nd day or February in the year Nineteen Hundred and Seventy-four, BY AND BETWEEN The CITY OF PARIS, Paris, Texas, a municipal body politic and corporate in perpetuity hereinafter called Owner, and MINNESOTA MINING AND MANUFACTURING COMPANY, Traffic Control Products Division, hereinafter called the Contractor, WITNESSETH, that the Owner and Contractor for the consideration hereinafter named agree as follows: ARTICLE l. SCOPE OF THE WORK The Contractor shall furnish all of the materials and equipment contained in the bidding documents authorized for advertisement for bids by the City Council of Paris, Texas, on the 14th day of January, 1974, prepared by Phil Ransom, Traffic Safety Coordinator, acting in behalf of the Owner and shall do everything required by this Agreement, the General Conditions of the Contract and the Specifications. ARTICLE 2. TIME OF COMPLETION The work to be performed under this Contract shall be commenced and completed to allow the Owner to place into operation the equipment provided for herein, on or before June 30, 1974. All work required in the base bid shall be completed by Contractor by coordinating his work with the Director of Public Works, John Cooke. The contract price shall be subject to reduction for any loss in grant awarded by the Texas Traffic Safety Administration and the U.S. Department of Transportation under which this project is partially funded due to delay or delays beyond the above date which are due in part or totally to the action or lack of action by the Contractor.
