1608 RES CITY COUNCIL IS DESIROUS OF DEVELOPING ITS PARKSRESOLUTION N0. 1608 , WHEREAS, the City Council of the City of Paris is desirous of developing its parks in a manner that will provide the best use and enjoyment thereof for the citizens of Paris; and, WHEREAS, the City Council encourages and wishes to commend the action of the Young Women's Christian Association of Paris and Lamar County for its interest in improving Walker Park by adding thereto a log cabin to be placed on the property included in lease agree- ment attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE PARIS, That the lease agreement the same is hereby approved; and, CITY COUNCIL OF THE CITY OF attached hereto as Exhibit A be and BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, F. Mallory, , Mayor AGREEMENT OF LEASE STATE OF TEXAS 0 KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR 0 THIS AGREEMENT OF LEASE, and permit for use of space hereinafter described, is made this 8th day of April, 1974, between the CITY OF PARIS, Paris, Texas, a municipal corporation, herein- after known as Lessor, and the YOUNG WOMEN' S CHRISTIAN ASSOCIATION OF PARIS AND LAMAR COUNTY, hereinafter known as Lessee, WITNESSETH: 1. That the said Lessor does by these presents lease and demise unto the said Lessee a space 22'. x 40', being a part of the hereinafter described property, said 22' x 40' space being situated on said pro- perty as shown by Exhibit A attached hereto and made a part hereof: Lying in the Northwest Section of the City of Paris, Lamar County, Texas, and being more particularly described as Lot 5 of Block 241, being a tract of land in the Asa Jarman Survey, City of Paris, Lamar County, Texati, (1csc.ribcci as follows: BEGINNING at the point of intersection of the south line of Shiloh Street and the East line of 18th St. , N. W. ; THENCE East along the South line of Shiloh Street, 1119. 5 feet; THENCE South 454. 53 feet to a point; THENCE West 484. 72 feet to a point; THENCE South 445. 72 feet to a point; THENCE West 635. 23 feet to a point; THENCE North along the said East line of 18th St. , N. W. 900.72 feet to the place of beginning, and con- taining 18. 18 acres of land. 2. This lease is for a term of ten (10) years, beginning on April l, 1974 and ending March 31, 1983, and the annual rental therefor being the sum of $1.00 and other good and valuable consi- deration, which rental is payable on or before the lst day of April of each year. EXHIBIT A 3. 'Iliis said lease is subject to the following conditions: (1) That the 22' x 40' space leased herein shall be used for park and recreation purposes, and available to the public without dis- crimination of race, creed, color, sex or national origin. (2) It is understood by and between the parties hereto that the Lessee shall maintain the premises within the leased area in good condition and free of hazards. ' (3) Lessee must arrange the use of the building and property so as not to interfere with the use being made of the adjoining park property or interfere with the use of the adj acent streets by the public. (4) Lessee shall and must at all times during the term of this agreement keep and maintain in full force and effect a policy or poli- cies of insurance, providing at least $100, 000. 00 per person and $300, 000. 00 for any single occurrence for bodily inj ury or death and $10, 000. 00 for any single occurrence for injury to or destruction of property, indemnifying all persons for any and all damages, personal inj uries or property damages sustained in or upon the premises of said leased property, or any part therevf, as the result of the negli- gence of Lessee, its agents, servants or employees, and shall pay all premiums due thereon when due. It is expressly provided that such insurance policy or policies shall and must be written and issued by a reputable in5urance company or companies, subject to approval by tlic: (;ity Attoriic:y of thc City of ['aris, and Lcsscc or its inSurancc carrier or carriers shall deliver a copy of any such policies to the City Clerk of the City of Paris, or furnish to said City Clerk a current letter from such company or companies, evidencing the fact that such insurance is in full force and effect at all times during this lease and notify the City Clerk of the City of Paris of the termination of any sucn policies. (5) If the use of this said space is for other purposes than provided for under Project No. TEX-OSC-107G, or as otherwise approved by the Secretary of Housing and Urban Development, this lease shall be terminated and the properties and use thereof shall revert to the City of Paris.
