1642 RES CITY COUNCIL ADVERTISED FOR BIDSRESOLUTION NO. 1642
WHEREAS, the City Council of the City of Paris did heretofore
advertise for bids in accordance with the laws of the State of Texas
and the Charter of the City of Paris for furnishing all necessary
labor, materials, superintendence and equipment required for the
relocation and adjusting of water and sewer mains at N. W. Loop 286,
between F. M. Highway 79 and U. S. Highway 82 West, in accordance
with detailed plans and specifications provided for said project, which
bids were received until 10:00 0' clock A. M. , Wednesday, October 16,
1974; and,
WHEREAS, M. L. Smyers' bid of $40, 393. 64 was the best bid;
and,
WHEREAS, the State of Texas requires a Joint Use Agreement
establishing the rights between the State of Texas and the City of Paris
with regard to utilities placed within the right of way of the improve-
ment project of N. W. Loop 286, between F. M. Highway 79 and U. S.
Highway 82 West; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the bid of M. L. Smyers for furnishing all necessary
labor, materials, superintendence and equipment required for the re-
location and adj usting of water and sewer mains at N. W. Loop 286,
between F. M. Highway 79 and U. S. Highway 82 West, in the amount
of $40, 393. 64, is hereby accepted and let; and,
BE IT FURTHER RESOLVED, That the Mayor of the City of
Paris, James M. Brunette, be, and he is hereby authorized and directed
to execute on behalf of the City of Paris a contract with M. L. Smyers,
for furnishing all necessary labor, materials, superintendence and
equipment required for the relocation and adjusting of water and sewer
mains at N. W. Loop 286, between F. M. Highway 79 and U. S. Highway
82 West, in the amount of $40, 393. 64, a copy of which is attached
hereto as Exhibit A; and,
BE IT FURTHER RESOLVED, That the City Manager, Kerry R.
Sweatt, be, and he is hereby authorized and directed to execute a
Joint Use Agreement between the State of Texas and the City of Paris
in the form attached hereto as Exhibit B.
