1585 RES TX HIGHWAY DEPT IS CONSTRUCTING AND RECONSTRUCTING FM HIGHWAY NO 137RESOLUTION NO. 1585 .
WHEREAS, the Texas Highway Department is constructing
and reconstructing F. M. Highway No. 137 from Loop Highway No.
286 in Paris to 0. 9 Mi. North; and,
WHEREAS, on or about May 28, 1971, certain proposed right-
of -way deeds and easements were forwarded to the City of Paris by
said Texas Highway Department with the request that the City of
Paris acquire and clear at its cost the right-of-way described in
said proposed deeds and easements; and,
WHEREAS, the City of Paris has determined that the right-
of -way designated as Parcels No. 2 and 4 of the above designated
deeds and easements were owned by Babcock and Wilcox Company;
and,
WHEREAS, said Babcock and Wilcox Company proposes to
exchange l. 596 acres of the right -of -way acquired for the new
construction for the 2. 198 acres of existing right-of-way shown as
Exhibit "A" attached hereto and made a part hereof which is to be
made surplus by such construction; and,
WHEREAS, the City of Paris has determined that said pro-
posed exchange of l. 596 acres of new right-of-way land for 2. 198
acres of existing right-of-way land when surplus requires no owelty
from any party; that Babcock and Wilcox Company are the sole ad-
joining owner of said 2. 198 acres of existing right-of-way and
otherwise complies with Vernon's Annotated Civil Statutes, Article
6673a; and, that upon the construction and reconstruction of F. M.
Highway No. 137 and its opening to the traveling public, said 2. 198
acres of existing right -of -way will no longer be needed for the use
of citizens as a road; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That the Texas Highway Department, through and by the
Texas Highway Commission, recommend for approval of the
Attorney General's Office and the Governor of Texas for the ex-
change, without owelty, of 2. 198 acres of existing right -of -way,
when surplus, for the conveyance by Babcock and Wilcox Company
to the State of Texas of 1. 596 acres of new right-of-way on and for
F. M. Highway No. 137, in the City of Paris, Lamar County, Texas;
and said delayed conveyance to be for the State's interest in 2. 198
acres of surplus right-of-way to Babcock and Wilcox Company.
