1569 RES COP ENTERED INTO TRAFFIC SIGNALIZATION PROJECT UNDER TOPICS PROGRAMRESOLUTION NO. 1569 , WHEREAS, the City of Paris has heretofore entered into a Traffic Signalization Project under the Topics Program; and, WHEREAS, the City of Paris desires to change the traffic signal steel poles at the corners of the Plaza to combination signal and illumination poles at an additional construction cost of $1, 100. 00, which expense must be fully borne by the City; and, WHEREAS, the Director of Finance reports that $1, 100. 00 is available to be used for such purpose; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the Mayor of the City of Paris, F. D. Mallory, III, be, and he is hereby authorized and directed to execute an agreement in the form attached hereto as Exhibit A, which will obligate the City of Paris to pay $1, 100. 00 for combination signal and illumination poles at the corners of the Plaza. BE IT FURTHER RESOLVED that the Director of Finance, H. C. Greene, is hereby authorized and directed to pay to the State of Texas $1, 100. 00 in accordance with said contract. In the event the amount as paid is more than the actual cost of the City's share, as herein established, then the excess amount will be returned to the City. C 45-9-33 T 9037 (2) Lamar County STATE OF TEXAS ~ X COUNTY OF TRAVIS X THIS AGREEMENT, made this 25th day of June, 1973, by and between the City of Paris, Paris, Texas, hereinafter called the "City Party of the First Part, acting by and through its City Council and the State of Texas, hereinafter called the "State", Party of the Second Part, acting by and through its State Highway Commission. WHEREAS, the City desires construction changing the traffic signal steel pole (4 each) at the corners of the downtown square to the combination signal and illumination pole on Loop 469 in the City of Paris as outlined in Field Change Request No. 2. The estimated construction cost of this work, excluding preliminarq engineering, amounts to One Thousand One Hundred and No/100 Dollars ($1,100.00), including contingencies and construction engineering. NOW THEREFORE, it is understood that this proposed work will be constructed by the State and the City will transmit to the State with the return of this agreement, executed by the City, a warrant or check made paqable to the State Treasurer, Account of Trust Fund No. 927 in the amount of One Thousand One Hundred and No/100 Dollars ($1,100.00), to be used in paying for the proposed work required by the City. It is further understood that the State will construct only the work for the City as requested and required by the City and the cost of the work, excluding preliminary engineering, will be borne by the City. In the event upon completion of this work it is found that the amount previously collected is insufficlent to pay the City's portion, then the City upon request of the State will forthwith supplement this amount by an amount equal to the City's actual 1.
