1558 RES MANAGEMENT OF SOLID WASTE DISPOSAL IS OF VITAL CONCERNRESOLUTION NO. 1558 . WHEREAS, the management of solid waste disposal is of vital concern to the residents of the City of Paris; and, WHEREAS, the City is desirous of planning solid waste disposal in order to prevent the same becoming a serious health hazard to the residents of the City and surrounding area; and, WHEREAS, the City Council authorized the application for plann- ing assistance for management of solid waste disposal; and, WHEREAS, the City Council finds that legislative action is need- ed to implement a solid waste system for the City and surrounding rural and urban areas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That Senator A. M. Aik in, Jr. and Representative George Preston be and they are hereby respectfully requested to sponsor legislation before the legislative bodies of the State of Texas which would accomplish the following: (1) Create a solid waste authority to be known as the North East Texas Solid Waste Management Authority with original jurisdiction in all incorporated and un- incorporated areas in Delta, Lamar and Red River Counties and providing for expansion of jurisdiction to contiguous counties or to individual incorporated cities within contiguous counties upon agreement of all member entities. (2) Provide for such authority to be governed by a board that shall be composed of representatives from the member entities as follows: (a) one member shall be appointed from each city and county (b) one additional member shall be appointed from each city for each 5,000 population or portion thereof in excess of 4,999 as reported in the latest U. S. census (c) one additional member shall be appointed from each county for each 5,000 population or por - tion thereof living outside incorporated cities in excess of 4, 999 as reported in the latest U. S. census (3) To grant such authority the power to contract with state and federal authorities and to contract for solid waste management services and to contract with member cities and counties to fix the types of services to be rendered and the fees to be charged property owners for occupied residences, businesses or industries, and the method of payment and collection. (4) To grant such authority the power to regulate solid waste handling or disposal practices or activities within its jurisdiction (Sec. 6, Art. 4477-7 VACS). (5) To grant such authority the powers to assess pro- perties and record liens in the county having juris- diction thereof for all service fees delinquent in excess of eight months providing however that: (a) The compulsory provisions herein shall have been approved by a majority of the residents within the county having jurisdiction. (b) Service fees shall be established after two public hearings, and public notice ten days in advance. (c) Property owners shall be notified of debts six months in arrears by certified mail with receipt signed by addressee. (d) Property owners shall be notified at least 30 days in advance of a public hearing to be held at the courthouse of jurisdiction. Passed and adopted this 14th day of May, 1973. F. D.
