1521 RES CITY COUNCIL ON 26TH DAY OF OCTOBER 1972 RECEIVED BIDSRFSOLUTION NO. 1521 WHEREAS, the City Council of the City of Paris did hereto- fore on the 26th day of October, 1972, receive bids to remove a 20' x 76' masonry and wood shed from the premises of 811 Bonham Street; and, WHEREAS, the low bidder was Jenkins Welding with a bid of $1.00; and, WHEREAS, it is right and proper that the City of Paris should enter into a contract for said removal; NOW, THERFFORE, BE IT RESOL VED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the Mayor of the City of Paris, James W. Farris, be, and he is hereby authorized and directed to execute the contract attached hereto as Exhibit A on behalf of the City of Paris. Passed and adopted this 31st day 9)f October, 1972. THIS AGREEMENT made this 31st day of October in the year Nineteen Hundred and Seventy-two BY AND BETWEEN THE CITY OF PARIS, Paris,Texasa municipal body politic and corporate in perpetuity hereinafter called the Owner, and NED JENKINS d/b/a JENKINS WELDING & MACHINE CO. hereinafter called the Contractor, WITNESSETH, that the Owner and the Contractor for the consideration hereinafter named agree as fol ~ows : ARTICLE 1. SCOPE OF THE WORK T h e C o n t r a c t o r s h a 11 perf:orm the work as follows : Remove from premises at 811 Bonham Street a 20' x76' masonry and woood shed as approved by the City Council of Paris, Texas on the 9th day of October, 1972. EXHIBIT A ARTICLE 2. TIME OF COMPLETION The work to be performed under this Contract shall be commenced within seven (7) calendar days of the date of this contract and be completed within thirty (30) calendar days. ARTICLE 3. THE CONTRACT SUM The Owner shall pay the Contractor for the performance of the Contract for the removal of a 20' x76' masonry and wood shed from , Lot3, Block 127 for the sum of ONE AND N0/100 ($1.00) DOLLARS ARTICLE 4. PROTECTION OF EXISTING BUILDINGS The Contractor shall protect and hold the Owner harmless from liability resulting from the performance of work under this Contract. Equipment used shall not in any manner interfere or otherwise delay the work of M. D. Misso Construction Company and the renovation of the Paris Police Facility and the Contractor shall be liable for all damage to said building including all costs for reclaiming such losses. ARTICLE 5. DIRECTION OF WORK The direction of work and administration of the Contract shall be by Edward E. Houk, Architect. The architect will be the Owner ' s representative during work i.nder this Contract until final payment is made. It is mutually agreed between the parties to this -agree- ment that the arch1tect shall inspect and observe all work provided for herein. He has the authority to stop work whenever such stoppage may be necessary to insure the proper execution of the work herein provided for.
