1474 RES TX HIGHWAY DEPT IS PLANNING TO CONSTRUCT AND RECONSTRUCT FM HIGHWAY NO 137RESOLUTION NO. 1474 .
WHEREAS, the Texas Highway Department is planning to con-
struct and reconstruct F. M. Highway No. 137 from Loop Highway
No. 286 in Paris to 0.9 Mi. North; and,
WHEREAS, on or about May 28, 1971, certain proposed right-
of-way deeds and easements were forwarded to the City of Paris
by said Texas Highway Department with the request that the City
of Paris acquire and clear at its cost the right-of-way de-
scribed in said proposed deeds and easements; and,
WHEREAS, the City of Paris has determined that the right-
of-way designated as Parcels No. 2 and 4 of the above desig-
nated deeds and easements are owned by Sabcock and Wilcox
Company; and,
WHERFAS, said Babcock and Wilcox Company has proposed to
the City of Paris to exchange 1.596 acres of the right-of-way
needed for the new construction for the 1.875 acres of existing
right-of-way shown as F-xhibit "A" attached hereto and made a
part hereof which is to be made surplus by such construction;
and,
WHERFAS, the City of Paris has determined that said pro-
posed exchange of 1.596 acres of new right-of-way land for
1.875 acres of existing right-of-way land when surplus re-
quires no owelty from any party; that Babcock and Wilcox
Company are the sol e adjacent owners of said 1.875 acres of
existing right-of-way an d otherwise complies with Vernon's
Annotated Civil Statutes, Article 6673a; and, that upon the
construction and reconstruction of F. M. Highway No. 137 and
its opening to the traveling public, said 1.875 acres of
existing right-of-way will no longer be needed for th e use of
citizens as a road; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
That the Texas Highway Department, through and by the Texas
Highway Commission, enter into an agreement with Babcock and
Wilcox Company to recommend for approval of the Attorney
General's Office and the Governor of Texas for the exchange,
without owelty, of 1.875 acres of existing right-of-way, when
surplus, for the immediate conveyance by Babcock and Wilcox
Company to the State of Texas of 1.596 acres of new right-of-
way on and for F. M. Highway No. 137, in the City of Paris,
Lamar County, Texas; and said delayed conveyance to be for the
State's interest in 1.875 acres of surplus right-of-way to
Babcock and Wilcox Company.
